Got a call at work so i can make payment arrangements on a  loan they threated me that if I didn't pay I was going to get suppeona and have a warrant issued for my arrest so do I believe it or report it they have me scared don't know what to do I told them the payment they wanted was to much for me I'm a single mother crying to make it

I rec'd a voicemail stating the samething; however I called and spoke with a live person.  They stated a payday loan was deposited into a closed account 2/13.  I haven't had an account with this bank since 2009.  She stated that I needed to get the information from the bank and call her back on what the situation is before they came to my house to serve me check fraud court papers.

The bank stated that the account was closed in 2009 and that it was sold to a debit agency in 2010 for the $74 still owing when it was closed (due to no activity they charged me monthly bank fees that I wasn't aware due to a savings account having $2.00 when I closed my checking).  The bank manager gave me the phone number to the collection agency which is not this Internal Account Attribution place calling.  

I called IAA back with the information that they needed to contact whoever sold them the account and she stated that a payday loan was deposited into that account in 2013.  How is that possible when it was closed years prior?  She said that I must have got the money deposited under one account number then I changed it to the closed one.  Really, I will call my attorney and see you in court.  She told me to have a good day - what a joke that they are calling on old accounts that were sold and sold and sold again.

I googled the phone number (855) 339-2898, and came across your review below.  I wanted to respond back and share my story. Today, 7/30/2013, I received a call Private Number on my cell phone.  First off, I don't answer restricted calls. So this man left a voicemail and said his name was Keith Miller and his office had just received a summons with my name on it, to appear in court.  He said that he'd be servicng me the summons within 24hours and that he's either be coming to my home or place of employment, and I needed to make myself available.  If I wasn't available, it would be a "failure to appear" and I would have to pay additional costs for that. He hung up by saying, "SEE YOU SOON"....!

Then, I receive a call from my mother that the same man called her and told her that "I" provided him with her number as a point of contact, and that he wanted her to give me the message that he was in my area and would be serving me papers regarding a court case! Of course, my elderly mom freaked out and said that IF she spoke with me that she would let me know, but never verified any of my information with him.

This is definitely a scare tactic that these payday lenders (Collection agencies) use on ppl, and they block their number, because they're collecting on illegal activity.  When I found out from my State Attorney General's office that the payday loans were illegal in my state, I was very furious, as I felt deceived. I had paid these ppl so much money back on fees and interest alone.  And that was when I seized further payments.

I wouldn't sign anything they sent you and I'm sure they will contact you again with further threats!  If they are licensed payday lenders in your state, that's one thing, but if they aren't...which may of them are not, then they can't collect on illegal debt.  If they call again from a Private number, tell them that you're willing to pay when they release their information from private and it can be verified.  I would bet that seize the calls!

Yesterday, received a call from Private Name/Private Number.  The man said he had papers to serve me the next day regarding fraud.  I tried to ask more questions and he said if I was not available, someone would come arrest me. I asked him what it was about and he said the only way it could be stopped was if I contacted the IAA and he gave me a number of 855-339-2898 and a case number.  I called the number and they knew my name and said it was about a payday loan from VIP and that I still owed $595 and if I could pay that today plus a 9.95 processing fee they would send me a letter that everything had been cleared up.  He told me he was recording the conversation.  He also knew my social security number.  I panicked and said I could not pay that amount and did not even have that amount of money and then he said he could do a "hardship" case where I paid $1100 over four months and calculated a payment for every two weeks plus a $9.95 processing fee for each payment or I would go to jail.  I'm a single parent and was terrified, so I gave him my debit card number, even though I told him it would not even leave me money for food.  He then transferred me to someone named Andrea Lotempio at the number 706-402-1403 who discussed payment arrangements and said they would e-mail me documents to electronically sign and take out the first payment today and the server would be stopped but if I defaulted I would regret it.  I checked on my bank site and they had taken the money out under NCW billing from Cheektowago, NY.  I looked into it further and it just made no sense at all when I talked to people they said if someone serves you they do not call you first nor do they tell you it can be fixed by calling a company or threaten jail.  I called the bank and had my debit card cancelled and had a dispute case brought up and the money put back in my account.  I was told by my bank that they were getting a lot of different scam debt collection calls this month.  Today, in my e-mail I received a link to sign documents by Kelly Winters, admin@ncwbilling.com.  It was through an Internet document service.  I did not open them because if I would do that I would be agreeing to the terms, so I never saw what was on them.  I basically had three calls, the person who was going to serve which was unlisted, this man who I did not even understand his name from this IAA, which he said was International Arbitration Association, which I looked up and does not even fit anything and then transferred to someone from NCW billing which is what they billed it through on my bank.  I am a single parent of a special needs son and was just about ready to break emotionally because of everything and I was afraid I would be arrested.  Has this happened to anyone before or does anyone have any advice on how to deal with this?  Should I just delete the document they sent because I will not sign that and they are smart enough to go through a document service so they have proof of that.  My debit card is cancelled, so they cannot get into my bank account.  Can anyone help me please?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Got a call from a will Thomas at my job stating that he need to serve me papers and left a case number with my employer stating that I needed to call to set up am appointment to b served papers, really who does this and where do they get your information from, what can be done about this.

I just got a similar call from a Tori Walker.  She stated that she was going to serve me papers on a particular date  and that I need to be home when she did so.  She calls several times a day.  Crazy thing is she doesn't state who she works for only that the file has been forwarded to her office, the company the debt is with, or anything. It's very creepy. What can be done to stop these calls when they call under "unknown" then leave an 855 number?

Recieved a call from this number stating there were 2 charges pending against me, that they needed to serve papers, wanted me to give them my address... Also called family and friends trying to locate me... first of all they called my house already, why would they call other people... second if they were legit why would they ask for me to give them my address.. This is a scam, and when i told the guy that there were scammers, he got very hostile and argumentive with me, which again makes me believe they are scammers.. He was not professional at all...

A man by the name of Adam Lynch called our office looking for an employee.  He said he had a claim number and a phone number of 855-339-2911.  When asked what company he was from or the name of the company that the number belonged to he said that he left the office without that information.  What, he doesn't know who he works for???

Yes, it IS a scam - no one gives you a heads up that you're going to be served papers - the court process server just shows up!  The scammers say this to frighten people into paying bogus debts, debts that have already been paid or even debts that are now outwith the statute of limitation for collection.  

NEVER pay someone without receiving via MAIL (not email or fax) a debt validation letter showing original creditor, date of loan, amount owed, date of last payment, and if the agency is licensed to collect said debt in your state.  Read about the FDCPA and learn your rights as a consumer.
