i just got off the phone with my attorney who stated if these guys are collecting or collected from you in  the state of texas call the attorney general in the state of texas and inform them they have done so without a bond on file

Triple check your credit! Also check to see whom this debt that they say they have is actually with them by calling OC. They r legit, although the methods they use are questionable as you may be able to report them for it!

They r based in Ny. They are legit although they use some highly questionable methods of luring you in to pay your debt. Just stay on top of what you owe! Triple check whom the debt got sold too and your credit reports!!

A gentle man called me from Hewitt capital and they said I had papers for me sign so they were very rude and told me I had to pay 487.00 so just to see if they would pull the money I put 40.OK on my card and the money stayed there then I called the bank and stopped the account.  So who are these people.

Received the same type of call. Hewitt Capital is going to summons me between 12-2pm with a valid form of ID with my signature. Never called them back, just doing research on the company. Thanks for letting me know they are scammers trying to get money from me.

Debts are civil and not criminal matters. Follow this advice given by the FTC:

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.

If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Contact attorney general in buffalo  716-853-8404 they have a file on these guys advise them how your contacted what was said to you .. Do not pay them unauthorized agency addresse for all the people you talked to is 1116 kenmore ave buffalo ny. Btw frank is not a real person no attorneys work in that office

I recieved this same called in April 2012 and again in august 2013 and jus today.  They say the exact same thing and are very very rude and keep telling me im now served.  You cant serve someone on the phone   He gave me an old address like 4 years old    Today some guy said he was from international courier service and if i will b home tomorrow from 12-4. So he transfer to a guy nsme Marshall from Hewitt services.

I recieved the same call they knew i had a loan with cashnet usa knew my account was closed i ended up sending them 150.00 but when i googled their name this came up and it seems the same thing has happened to people on here cashnet sold my loan to them smh i filed a complaint with consumer finanace they wll not get no more money from me im angry.

Agreed!   However,  my personal favorite  is  a   "Restraining Order".    Every time I read that they have a "Restraining order"  against someone for not paying a debt,   I shake my head in disgust at their ignorance of our laws.

These idiots can't even get the legal terms right - a subpoena is used to compel a witness to testify or to produce evidence.  If you're being sued for a debt, a court process server (who, BTW, wouldn't announce his impending visit beforehand) would just show up and hand you a court summons.  

Per the FDCPA, you should never pay any caller who refuses to mail a debt validation letter showing original creditor, amount of loan, amount still owed, date of loan, date of last payment and if they have the legal right to collect said debt.  Refusal to mail proof of debt is a violation of the FDCPA.  Debt is civil, not criminal, so threatening your son with arrest is yet another violation of the FDCPA.

Report these jokers to the FTC, FCC, FBI, Dept of Justice and your state's Attorney General.

These idiots called and threatened my son with arrest about 2 months ago and yesterday left a voice mail on his fathers cell phone (how they got that number we have no clue) stating they had a subpoena, needed to serve him between certain hours today and he needed to sign.  Needless to say this caused alot of stress between father and son.  I contacted the number, was transferred to MARSHALL at Hewitt and told he had no idea what it was about and the envelope only said HEWITT CAPITAL , no return address and it a subpoena (if you have no idea whats its about how do you know its a subpoena)  This is a total scam and you CANNOT be arrested or subpoenad for debt collection.  They have to file a court order to legally pursue this.  DO NOT FALL VICTIM TO THESE IDIOTS

Well I fell for the scam, I knew I didn't take out a stupid lone. They told me they had my IP address on file and that it had to be me. I knew I hit my head pretty hard in my accident, but i was sure i had not taken out a payday loan. Wow, well i don't know what to do now they took there money. And they never did send me my informational email. Wow. now I am really ticked off.

i want to know where they get my social security number from. and how they found my sisters cell phone number and mothers cell phone number. i never got anything in the mail and the debt is not legit. the callers are rude and are clearly doing illegal, harrasing calls to people they are hoping are stupid. 18 calls IN A ROW from these people on my personal cell phone and the message says "since you do not want to answer your phone and you do not want to coorperate with our office, we will see you in court" HAHAHAHAHA. i wish i could see these freaks in court! ugh

OMG!!!  This same exact thing happened to me THIS weekend!  They called me on Friday, late afternoon, and threatened me that I would be served legal papers by a "Pre-Legal" service for a $300 debt I had paid off to CashNetUSA over a year ago.  It scared me to death!  The caller threatened me that I would be sued for Breach of Contract and Fraud.  Same exact protocol that has been described here by each of you.  Wish I would've found this site over the weekend!  Long story short, after being harassed by these people, personally attacked when I tried to ask legitimate questions, I happened to be guided to this site while "Frank" put me on hold.  The scariest part is, they not only knew my phone # and address, they had my Social Security number, and even bragged about knowing my UT Driver's License number!  They were menacing, threatening, and down-right bullying me into giving them over $600 which would've made my original $300 loan become over $1,200.00!!!  Thank you for whomever started this site!  It is a Godsend!!!  And yep, its all the same people & companies.  I will be reporting then to every agency I can.  These people are committing fraud and have somehow acquired our personal information that they NEVER should have in the first place!  Please look out for the following:  CashNetUSA (surely they have to know who they are selling/giving our private information away?); Debt Management Partners; and YES - Hewitt Capital w/ a man named "Frank"!  The "Courier Service Company" was extremely hostile - watch out for the names:  "Miss Meyers" and Jeremy.  This whole SCAM is so FRAUDULENT its sick!!!  Also, b/c others may have caught on to them, the calls I have been getting are from:  
(214) 473-4318 ~ Plano, TX ~ where the so-called "we're going to serve you woman is  AND
(716) 923-7493 ~ Buffalo, NY ~ "Miss Meyers", "Jeremy" and "Hewit Capital's" own FRANK.
In addition to calling your state agencies, might I suggest that each of us sends out an email & make it go viral to fight back at these people.  Include a link to this website for reference & WARN everyone you know.  These people need to be held accountable for what they have done, and are doing.  My heart goes out to each of you who has experienced this.  It is scary, immoral, unethical, and absoutley criminal.  Get those emails out there!  Warmest regards ~ t in Utah

I too have been victimized the same as all of you and I will be joining forces with you to stop these creeps!  Because of those of you that have taken the time to report the bad experiences you've encountered by informing us of the degrading intentions of these scammers, it prevented me from paying them any money and falling into their trap. I have warned my boss of the matter and I am waiting and hoping that they do call back because I got something waiting for Mr. James Ryan @ 855-597-4553.  The carrier is said to be Aaron Burk.  So listen out for those names and that number as well.
Thank you for the much needed warnings and I would like to also thank those that responded by giving us the valuable information we needed to recognize a scam and what measures to take to take to stop them!  Thank you all!!

If you paid via your bank account - dispute the charge as fraudulent!  NEVER pay a caller money unless they have sent you via MAIL (not email or fax) a debt validation letter proving you owe this debt to them!  

Read about the FDCPA and learn your rights as a consumer.  Debt is a civil matter - not criminal, so no, you would NOT be charged with a felony and your driver's license would not be suspended.  Scammers say stuff like this to scare people into paying money they don't owe.

Report the calls to the FTC, the FBI and your state's Attorney General.  If they call back - and they will, because you paid them - tell them you've reported them and that the FBI is monitoring and recording all calls they make to you.  

Unfortunately, you may receive even more calls because once a scammer gets someone to pay for a bogus debt, they sell your information to other scammers who start calling saying you owe on another loan, or else you paid the wrong company for the last loan.  Again - never pay anyone unless they send you proof that you owe a debt to them.

Wow! I wish I would have read these comments prior to today. They called my job left a message then called my supervisor informing him of papers they needed to serve me with him as a witness, I called ASAP once I received the message. I was under the impression they were a law firm. They told me in the state of va I would receive a felony an also have my driving license suspended. I was so scared, she acted like she was doing e a favor once I asked about payment arrangements, placed me on hold. The total was 990 dollars. The next day I settled for 700 dollars paid in full, I just could not afford a crimal charge so I brorrowed the money from a family member in fear of going to jail,..

Hewitt Capital collects for debt management places. They buy defaulted loans from Internet Loan places. When a loan place sells your loan whoever buys it cant do crap. they try to scare you into paying them. A second party cant even garnish your wages. So when they tell you they got papers to serve you tell them to bring them on,cause they dont have any. Just a scare tactic.

anyone who receives a debt collection call in which you are told a process server is coming, legal action is pending, or criminal charges will be filed, should report this to the New York State Attorney General by calling 716-853-8404.  Process Servers DO NOT call you before they come,  it is a violation of law to imply a lawsuit has or can be filed if they cannot sue you (they can't), it is a violation of law to disclose the debt to a third party,  collection agencies are required by law to MAIL YOU (not email) a letter within 5 days of the initial communication that describes who they are and what the debt is, and give you your right to dispute it.  Please record all calls where legal, save all messages.   Also, check to see if they are registered to do business in your state with your own state department.  if they are not, they cannot call you in your state.

I just received a call from John winters with "ics".  He actually called my fathers house where we've been staying and asked to speak with my dad. I said he wasn't home and asked to take a message. He asked if I was his wife and I said no daughter. He said ok well I'm trying to reach a Jesse smith because I'm a process server and I've been trying to serve Jesse with papers for a court date he has. Jesse is my husband so I asked who the papers were from. He said he wasn't sure but the outside of the envelope said Hewitt capital.  He said he called my dads number because they've been trying to serve Jesse and haven't been able to find and gave me an old address we haven't lived at for about 7 years.  He said they ran a background check on him and my dads name came up as being related .  Then he gave me my brothers name and said he was going to call him next.  My brother and I don't get along so I told him I was his wife and would have him call him. That's when I googled his info. I now remember him callin our phone before and left very threatening messages but when I called the county court house in which we supposedly had bad checks they'd never heard of their supposed employee nick miller and had no case with my husbands name.
