No, I do not work for 800 notes--and the INFORMATIONAL link was NOT intended to be legal advice. If you want legal advice, contact an attorney.
Have a nice day!

Sir that may be the case, but you do realize that if you are offering legal advice without the proper license- even if it's just third party its highly illegal. Do you work for 800 notes?

Let them sue me if I don't feel it's valid? You know how much that would cost me? Are you crazy?

Great advice posted by an attorney on:

"IF they do not provide you with the verification of the debt, the debt is invalid and not subject to collection. PAY NOTHING TO ANYBODY UNLESS THEY PROVIDE YOU WITH WRITTEN VERIFICATION OF THE DEBT, AND ONLY THEN IF YOU FEEL THE DEBT IS VALID - otherwise, let them sue you for the debt, as a real law firm will only bring a legal action on a truly valid debt".

Like yef says nope! you can't be served over the phone. Service requires actual papers be given to you with the Court, Case No., date and time of appearance, the reason for being summoned to court plus any instructions on pretrial motions you can make or how you should respond to the court summons. Definitely not something that can be done over the phone.

Serve you over the phone? Definitely not! What morons these scammers are! They count on people being just as dumb as they are. Good for you for making efforts to learn your rights!

so they cant serve me over the phone right? because before he hanged up he told me that ive been served. etc.

Nobody legitimate calls ahead to give advance warning of being served. That would be pretty counterproductive. They need to prove that you owe this money and that they are the owners of the debt. Do not let their illegal scare tactics get to you. If you owe a debt, contact the company you have the loan with and try to work something out with them. It is illegal under the FDCPA to threaten a lawsuit when they have no intention of filing one. If you speak to these scammers again, demand that they mail (not email) you a debt validation letter. No debt validation means you owe them nothing.
