Had this person call me stating that i had made check fraud recently on my bofa account which i had close due to insufficient funds made which also lead me with a negative balance on my account. Had to switch banks cuz of the fact i learn that i was dealing with payday loans that were illegal in the state of cali. The person on the phone gave me the number to call, 855-790-0094. Even said that they will serve me papers for the fraud check I made. Its weird that they knew about the bofa bank account when I had it closed for almost a half a year. Please I want to know if they're legit or scammers. They didnt give me a name to the company or anything. Especially they called me from a unknown number. Thank you!

You can bet your sweet ASSets that it's a scam!  You will not see anyone showing up to serve you unless you ordered pizza.   In accordance with the FDCPA  (Fair Debt Collection Act)   a collector must provide you with written validation,  via usps mail,  and within 5 days of your request.  Tell them you need their name,  mailing address,  physicall address,  regular business phone number,  and web site name.   Tell them that you are disputing the debt and need to send them a certified letter.  Anytime a collector refuses to provide you with written documentation validating the alleged debt,  for any reason,  it means that they do not have it and are in fact trying to either scam you or collect on a legally uncollectable debt.   These people have already violated every part of the FDCPA laws and will not provide this validation because they must keep a low profile on the Radar.
Do not Pay these liars and do not let them intimidate you.   Demand that they provide you with this validation, in writing,  via usps,  and all pertinent information that they have in their possession validating the original debt and their right to claim and collect the alleged debt in your state.   If they say you don't need it or that you already know what your debt is,  just tell them that whether or not you owe the debt is not for you to prove,  however,  the law says that they must prove it.     Now,  put on the Boxing Gloves....and grow 1 eyebrow.

BullFrog!!!   I won't insult you by calling you a Shill.........You don't deserve to be rated that high!
I've read better and more believable confessionals in Penthouse Magazine.    So.....you were stricken down with that dreaded Shill disease called   "Loan Dementia"  and forgot that you took out a loan?    Well,  give me your phone number so I can call you and tell you about that loan you took out from me  2 years ago.
What a pity......... This scam and this same old shilling has gotten so old that's it's long in the tooth and growing belly hair!  At least get a new scam so that we can have something new to play with.

I received a call from this number yesterday (855-790-0094) saying the same thing about writing fraudulaent checks which I knew I hadn't. after doing a google search on the number, I called them just to see what they would say. They were very vague and said that they could not provide me with any documents. They said that someone would show up at my place of busines or my home to "serve" me papers. Someone called me this morning with an unknown number and said they would be serving me the papers today. They did not leave any information for me to contact them back. I called the 855# back and they would not give me the number for the "locating" service. They were actually rude today when I sopke with them. Sounds like a SCAM to me!! Can anyone shed any light on this matter? Thanks!!

Sorry, but it sounds like you paid scammers and not legitimate debt collectors.  Hope you don't get more calls saying you still owe on that "loan"!

Debt Collector
I was extremely scared when I got the call about fraud. I actually dodged these people for just over 2 months. When someone showed up at my door one day with a tan enveople, when I cried and explained my father had died and I didnt have time to return the calls. This woman told me she would come back in 30 minutes to give me time to figure it out. I finally gave in and it was for a pay day loan. The amount they gave me was outrageously high. Way higher than my original loan. They did give me their clients information to confirm. I called and gave them my customer number, turns out I did have a loan there in their office. Once I called the collector people back they let me settle for the original amount. Took the darn company a month and a half but finally got my letters clearing me and my receipt. But man are they harsh.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I got a call from a local number stating that I had written fraudulent checks to an organization that was not named, the message only left this number on my voice mail stating they were the plaintiff and to call them before further legal action was filed against me. I don't believe the legal system works this way on top of the fact that I have not written checks to anyone in years. It is more disturbing they know what bank I use though.
