Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

May 2013 I was taken by this fraudulent company !! I feel so stupid  I am going to file a claim with the FCC these people should do hard time!!!
Do not answer their calls or give any information to them they are criminals .  They pulled out all the legal jargon on me too. we are going to file a warrant a this a that OMG!!!! I was freaked out so stupidly I fell for it and gave them my bank information and now had to close it all out to prevent further fraud on my account.
It is so sad that things have come to this point in America .
What keyed me in to this fact was another company by the  name of the Winchester group called with the same BS and I said wait a minute this has been taken care of with another company and I will not pay for it again... so I then googled the companies and found they are crooks ...I feel so dumb! I called my bank and closed my account and changed my phone number now on to a fraud claim against them with my banking institution and a complaint to the FCC

Payment Processing is a scam....those were fake names and the whole company is a fraud. They have numerous buildings in downtown Cleveland as well as in Atlanta and California....everytime they are found out...they close down for awhile...then open back up with new names and numbers....please beware of these people. If they call u please contact Cleveland Police and Prosecutors office.

Pinnacle payments is a fake, all their offices are fake. There is an office off 9th and superior, 15th and lakeside as well as an office at 17th and rockwell. Everybody goes by fake names and everything is straight illegal. And the so called owner never comes to Cleveland to check on the company. He stays in New York and Atlanta. Please beware if they call ur house: Payment Processor, Central Assets Bureau, or any other name that may seem strange. The so called top manager that is in charge goes under a fake name as well Angela Triplett.

I received a call from number 803-369-3108 .I spoke with a person one named Matt they told me them were with Central Legal Network .They were saying I owed a payday loan from 2006 and they were suing me and that i had 24 hrs to cll them and pay.They also said that they would issue a warrant for my arrest.He also said things like your a sweet lady and we can offer you half off the debt and you dont want to go to court because you will loose.I tell you what I ll let you make two payment once a month of $149.29 to pay the $300.I didnt think anyone could scam you plus they knew all my information.He convinced me to make a payment.I gave them my cc number and they took both payments.It was not until i recieved another phone call from my job stating the same info and asking for more money did i become concerned.It was another call bac number 888-959-1534, with a different court number that i thought it might be a scam.I called my bank,ask for the wire used to get the money and they gave me 858-208-3120 for some Velocity Payments for accounting and bookeeping.I was shocked that such a scam does exsist.These low lifes should be ashamed of themselves for cheating hard working people out of there hard earned money. It is so sad. I have learned a valuable lesson and will not ever give anyone my cc number unless i check it out first.U can use 800 notes to look up numbers.DONT BELEIVE A WORD THEY SAY UNLESS YOU LOOKED IT UP FIRST.

More than onceI have recieved a phone call from these people ,but on January 4th I spoke with Christopher Dunn and then asked to speak with a manager her name was supposedly Carol Crews . She said that they got their information from another bureau 804-316-9075 and spoke to a Kevin Graham.  My daughter and a friend of hers researched this Pinnacle Payment Process Center and it is not a real business. When you GPS the address it shows a movie theater . I wanted to post and let you all know that they are stating that they recieve information from  Litigation Company : Judicial Support Bureau . I wanted to let you al lknow that this is real business .

I unfortunatly was a victim of this fraudulent company/companies and  paid them two payments of $130 before realizing that this was a fraud.

I represent a debt buyer, Marshall Recovery LLC.  It purchased a package of charged off debt and commenced to attempt to collect it.  Two people from Colorado claimed to  have paid the accounts owing, and received, settlement letters.  The company they were dealing with were using the names Pinnacle Payment Process Center, United Legal Alliance and Central Legal Network, ALL 3 were using the same address, 4758 Ridge Rd #173, Brooklyn OH 44144 (a suburb of Cleveland) and the same phone number, 858-208-3120.   I called, "We'll call you back."  They never did.  I then called, wrote, obtained a fax# (440-756-7419 (440 is a Cleveland area code)  and faxed them correspondence December 14, 2011 explaining who I represented, and that Marshall Recovery was the owner of the debt and who were these people working for?  Who did they remit the collected funds to? What was the true name of the companies' names they were using.  They were not listed with the Colorado Secretary of State or registered with the Coloado Collection Agency Board (in the Attorney General's office).  

Not getting any response (a legitimate company would have returned the call or answered the correspondence) I began to suspect nefarious activity.

I called the Ohio Attorney General.  They said they only represent consumers, not people like my cleint, a substitute creditor and refused to help.  They referred me to the Cuyahoga County prosecutor's office.  They too refused to help, referring me to the Brooklyn Ohio police department.  They felt it was a US Postal Inspector's job to ferret out the seeming fraud.  

So here we have "a" company (ies?) using various names, taking money from people (how they find out who these debtors are is beyond me) that does not belong to them, not responding to legitimate inquiries from the truy owner of the debt about what is going on and no governmental organization is willing to step up to the plate to help us and, moreover, not only us, but how many other debtors have been scammed by these people?  

I'll work with the Inspector General of the Post Office, and, now that I think about it, I'll go to the Federal Trade Commission and the Consumer Finance Protection Bureau and plead my case.  Someone has to stop these people!

I recieved a call from blocked call asking me to call 803 369 3108 because some filed a restraining order against me and there is a warrant out for my arrest and they are going to subpoena me! Just the so call Ray Miller uttered this all in one breath while claiming to be an investigator.  I was at work and when I called back was stupid to give my CC info to pay for something I had no idea what it was.  It said it was for a loan I took out but I dont recall taking out a loan in 2000. They said once I pay it they will provide a recipet. I waited a few hours and I did not get anything. I was scared to call back and so I spoke with an Attorny and he asked me to get the reciept from this company. I called back 803 369 3108 and this time I was heated.  It took me four tries and then 15 minutes later someone answered and he said that I need to call 858 208 3120 to get my confirmation. SAN DIEGO? I called 10 times an no one answered so I decided to google both numbers and i feel like a total idiot!!! I gave these people money because they said they had a warrent, supoena, and restraining order out on me!!!!!!!!!!! DONT ANSWER THEIR CALLS. I'm filing a complaint against them as you're reading this.

My coworker received a call from two companies related to this number. One was Nationwide Payment Solution. They told her she owed over $10k for an old B of A Visa card, but they would only give her the first 2 digits of the account number. They told her she could go to court over it, but it was in Texas two days later (we are in CA.) She was nervous, and unfortunately gave them her bank account number to settle the debt. When she told me, I told her to go to B of A to see if she had any outstanding debts to them, but she did not. I also had her go to her bank and they pulled her credit reports, which confirmed it was a bogus call. They closed her account for her and opened a new one.
Days later she got a lettter from Trancontinental Process Services in Ohio, stating how much they would take from her account. It listed the 858 number, which is a San Diego area code. DO NOT ANSWER CALLS FROM THIS NUMBER!! She is filing a report with the FCC.
