Cox Charges Five for Foreclosure Rescue Fraud

LANSING - Attorney General Mike Cox today announced that his office has filed 18 charges against four companies and one individual for committing foreclosure rescue fraud. Cox also issued warnings to 17 companies regarding complaints from residents about their practices. Michigan law prohibits "foreclosure rescue" companies, which provide foreclosure advice, from making misleading or false statements, or charging service fees before any service is completed.
   "Preying on residents in the process of losing their homes is not only shameful, it's illegal," said Cox. "Today we are sending a message that mortgage rescue fraud will not be tolerated."
   The charges resulted from the Attorney General's office conducting undercover operations based on complaints from homeowners and include one count of unauthorized use of the Great Seal of the State of Michigan and 17 counts of violating Michigan's Credit Services Act (CSA). The CSA prohibits charging fees before completing services when seeking to negotiate a loan on behalf of a homeowner. The Credit Services Act carries a maximum penalty of 90 days in jail and/or $1,000 fine, and allows the Attorney General's office to seek restitution for affected consumers.
   Misleading or false statements made by the companies included guarantees to prevent foreclosure and assertions consumers could avoid foreclosure regardless of their credit score, home appraisal, or debt to income ratio. Victims were charged between $595 and $3,000.
   Those charged include:

Save My Home USA of Madison Heights
   o Four counts of violating the CSA (43rd District Court, Oakland

      County)
   o Charged victims between $595 and $2,000 before completion of

      services and advised consumers not to communicate with their

      mortgage company.

Help4homeowners of Birmingham
   o Three counts of violating the CSA (48th District Court, Oakland

      County)
   o Falsely claimed a 97% success rate, charged before completion

      of services, and its employee admitted they had no loan training.
Payment Doctors of Livonia

   o Two counts of violating the CSA (48th District Court, Oakland

      County)
   o Made false claims and charged before completion of services.

Michigan Economic Reinstatement Program (MERP) of Livonia and

  owner Mark Alan Aloe of Farmington Hills
   o Four counts of violating the CSA and one count of unauthorized

      use of the Great Seal of the State of Michigan (47th District

      Court, Oakland County)
   o Charged victims between $360 and $3,000 before completion of

      services, made false claims, and used business cards with state

      seal but did not work for the State of Michigan. Aloe faces 90    

      days in jail and/or a $1,000 fine.

   Attorney General Cox also sent letters to 17 other companies warning that their practices may be in violation of state law and requested more information about their business:

   Cox urged consumers who may have been victims of any of these companies to contact the Attorney General's office. He reminds consumers of four quick tips in order to help avoid foreclosure rescue fraud:
   1. When seeking help with foreclosure, homeowners can find free

       help by calling the Michigan State Housing Development

       Authority at 866-946-7432.
   2. Homeowners are not required to pay to speak with their lender or

       servicer.
   3. Never pay up front for help with negotiating your loan or working

       with your servicer.
   4. If you believe you may be a victim or mortgage fraud or

      foreclosure rescue fraud, call the Attorney General's office toll-

      free at 877-765-8388.


   Attorney General Mike Cox has made prosecuting mortgage fraud a priority for his office. In 2008, Cox created a mortgage fraud unit and teamed up with the Michigan State Police and other law enforcement agencies to tackle the problem. In the last six months alone, Cox has charged one dozen people with mortgage fraud-related offenses. Cox's office has held seven mortgage foreclosure forums to help families stay in their homes during these difficult times.
   The defendants are being notified today and are expected to be arrested or turn themselves in shortly.

in a loan modification to BOA.  He said he got my letter.  Wanted $700 to help and said he was from Kirkland Young, LLC. Please stop predators like this

These people called me and told me that they do a lot of work with chase. They wanted $2500 to hold onto while they negociate a modifcation. They told me not to make any payments while they are in the process.

I called Chase and they said they never heard of them, do not call back.

Called from 978-570-2361 with a recorded message saying something about Satellite tv and then switched to saying they knew I was behind on a mortgage (I don't even own a mortgage) and they could lower my payments and gave me the number to call of 866-554-3890, another junk caller.  Strange that the caller ID said Mccain 2008! Those Republicans!

The only people who can actually modify any loan is the actual lender. And that's if you ask and if you can somehow qualify. But, your payments WILL NOT be less if you are in fact behind which is the only way you get a modification.

William Page called from Loan Modification Dept. claiming that my current loan and that I am behind, and he is helping try to avoid forclosure.  He states his name 3 times as well as the phone number 866-554-3890.

I called 3x and his voicemailbox is full when as of Sunday 4-6-08.  On Monday the number was disconnected, then tried again and got someone at the modification dept.

William Page called and left the 866 number; however, when I called the 866 number, it was out of order.  So I called the caller id number, which was 603-214-3537. A lady answered and asked me if I was in debt.  I told her I was (I really am not).  She asked what kind of debt?  I said I'd rather talk to Mr. Page about it, and she said good bye and hung up on me.  Who do we report these people to?  This is definitely a predatory scam

Same as other one.  Said I was behind in my loan and we could restructure.  His name was William Page and he left the same number but when you call mailbox ids full.  I don't have a home but my apt. address is often mistaken for one.  When I called back the number that shows up on my caller ID, it  was a recorded message that said I could be taken off their phone list by entering my number and pressing #, however when I tried to do that it said I had made an invalid entry and disconnected me.

"William Page" called and left a message about our payments falling behind and wanted to help us avoid foreclosure.  We don't even have a mortgage - we currently rent.  I tried the toll free number and the caller ID number and could not reach anyone.  Definitely sounds like some kind of scam.

Received a call on a saturday night from "William Page" who understood I was having problems with my mortgage and needed loan restructuring.  I have a 5% fixed rate and no late payments.  I wish I could nail this person for what they are doing.  I was upset after getting the call.

All the rules have changed in the last couple of months.  Lending banks are now being held accountable for the trap they set, borrowing money they didn't themselves have, while using loose and illegal practices in the process.  The massive lawsuit against Wells Fargo / Wachovia, Indymac / OneWest bank, Citibank, Bank of America, JP Morgan Chase, GMAC..............can actually, not only put a stop to your foreclosure, but also pause your house payments with no loss to you............
