You are wrong, this is not a legitimate company.  They say I have a debt but can't tell me how I incurred it, what company it was with or what my address or middle mane are..  My car was paid in full 4 years ago, I have NO credit cards and haven't for decades

You are 100% right. They buy up defaulted loans and hope to make money off peoples sorrows. They double and tripled the amount of the original loan which a person could not pay in the first place. Dont try to work anything out with them because it is impossible. They want the hugh amount of money. They threaten and intimidate and try to extort money out of people. They can all go to hell as far as Im concerned. If something should be government banned its collection agencies. Let people work the debt out with the person it is owed too.

Just like in Biblical times the money collector was hated and for good reason. Everyone wants to pay their bills but life happens in between. What is so sad is the collection agency wants to double or triple the amount that the person already cant pay. They want to use strong arm tactics and extortion. I would say God help them but they dont deserve it.

Just about like my experience. They were harassing and intimidating my 84 year old father over disconnect fee from a sorry security company (ADT). It takes a real man to try to harash and extort money out of an 84 year old honest man, veteran of foreign war, never been on welfare, always paid his bills, and lives on retirement now. Way to Lockhart, Morris, and Montgomery. Your are real big men arent you. The only thing you get an A in is rudness and extortion.

Just because the man tells you it is a valid debt does not mean it is.  Collectors lie about everything, as they receive a piece of every dollar they collect.  Attempting to collect a debt that does not exist or that was paid in full are both violations of the Fair Debt Collrction Practices Act (tit 11 U.S. Code Section 1692a et seq.  The collection agency is not necessarily calling because you owe money; sometimes you are thought to be too stupid to know that you do not owe money, and are therefore the ideal victim for a collection agency.

I got a call from these people asking for someone I know. I said I didn't know them and they claim they took my phone number off their list. We'll see. I blocked their phone number through my phone company.

This call was from Lockhart, Morris and Montgomery, debt collectors.
    [They've also called from 214-522-6424]
They've been calling (as have others) for someone who used to have
my phone number.  I emailed them to take me off their list, and I got
this reply:

Not trying to be flippant, but you can sue anyone for anything.  The questions you should ask are:

(1) Is the amount of money involved enough to justify a lawsuit?

(2) Do I have a winnable case? Am I LIKELY to prevail?

(3) Am I prepared to go through a lengthy, expensive and stressful process?

I'm not trying to discourage you, but I have been involved in litigation on more than one occasion, and you need to know what you are getting into.  The last situation I was a party too never got to court, had a largely meaningless outcome, and the check I wrote was for $8,000.00.

I would suggest that you speak with an attorney, and ask for an opinion about the merits of the case.  This initial consultation should be free, or at least for no more than a nominal fee.  Make sure you are speaking with an attorney practicing in these areas - your local real estate closing attorney is not the guy you want, at least for this.

If you want to have a meaningful consultation, come loaded for bear.  Organize your records and documentation.  Scour the Internet for information which speaks to any improper or fraudulent conduct by this firm or its principals.  I am hoping you have kept notes along, as there is no substitute for CONTEMPORANEOUS records.  But if you haven't, sit down and compose a summary of events now, and do not mislead the attorney about when the summary was created.

Once you have all of this in hand, neatly ordered and organized, compose a cover document which summarizes each document in the package (like a table of contents, but with one line summaries of the documents as appropriate).

If you show up at an attorney's office with this in hand, you will have the best shot at garnering his interest.  It will convey that you are not just some clueless soul who will be difficult to represent.

I will tell you that the devil is in the details.  I will also share a saying from a family member of mine who was a judge.  "He who has the gold makes the rules."  In your case, they have the gold.  The question will arise as to why you continued to pay a "scam" for so long, why you are just now seeking relief.  And winning a judgement is not the same as getting the judgement satisfied (paid).

It is entirely possible that you have a good case, that there are grounds for generous compensatory damages, and that litigation is well worth your time.  But determining this requires that you lay the facts out in front of a professional litigator - possibly more than one if you feel like the first one gives you short shrift.

Take your time, and make sure you have the right person to help you.  You don't want to compound one mistake with another.

I had the same threats about my nursing license. Being a single mom of 3, I HAD to keep my license to work. I too signed up with the College Network and decided after reading the material that this was not a good idea and tried to cancel with them. They told me, like the other folks on here, that I couldn't cancel.

My question to all of you is, can we sue them for being a fraudulent company with unfair practices? I have paid them about $6000.00 I only owe $690.00 more. If they are as bad as I am reading on here and as fraudulent as I am reading, I want my money back!!!

People will be more inclined to pay their bills off, in a timely manner, if you can provide the legal (original) documents stating that they are held responsible for the acts therein. If the party agreed to pay with a specific company, that their debt is owed to that company, and if sold (numerous times) to other companies due to a lack of financial obligations to that institution, that you purchased without the original documentation.. well s*** tits to you. It is not because they are deadbeats who take out loans that they had no intention to pay back.. Its because it is common, legal, professional practice to provide us the true/real documentation stating that WE OWE YOU THE MONEY. Nice try. Maybe with the claim number you leave on the people's voice mail, you should attach the legal, court number of which you filed a civil action in that county. After doing so, bring your appropriate legal documentation to court so that we all can fight you fairly.

I have requested proof of my debt by email, USPS and over phone and have never received anything from Lockhart & Morris Montgomery proving this debt. After them bringing me to tears and demanding I borrow the money from friends, or family or my parents and having to tell them my parents are low income and I would never put this stress on my parents who are in there 80's. They went on to tell me  that...I'm to prideful and I had to make the payment that same day. I finally agreed after being treated like dirt to pay 300 a month which they deducted from my account for 6 months. One month they deducted two payments and then when it was paid in full they waited  almost 2 months and deducted 247 from my account without my consent. This company by there fraudulent removing money from my account have caused stress, my husband missing a day of work to cancel our acct and have to open a new account. I'm going to be requesting all lawyer fees, missed work pay and any insuffient funds fee I get over this matter. I was at least smart enough to tape the conversation I had with this company when they made it clear they were recording our convo.

But a choice between putting food on the table, and the car payment thats owed, I would choose food on the table. Now if I remmber right if its after 7 years they cant legaly make you pay the old dept. Just dont agree to anything they say, dont say yes to anything. get your self a progrm for your smart phone as I have and just block their calls. they are calling me for a dept my son owes and I didnt co sign or agree to pay if he didnt. They are trying to collect for a trucking company that rips off there drivers anyway they can. Yes Im talking about you Stevens

Nick Forsh left a very demanding threatening message on my machine three times for Angie Legro (far from my name).  I called back and demanded him to stop leaving threats on my voicemail and to stop calling me as   I am not the requested.  We will see what happens.

These people continue to call my kids number and after telling them they have the wrong number they still call!!! They don't even ask for a person that sounds remotely like any name that comes close to our family name AND they only recently started calling us so someone gave my kids number.

Calling for  a referenced individual per comment ( I cannot disclose the person's name) in response to a complaint which I have no idea. This company states for me to put this individual on the phone and would not disclose any information to me. This company called me from 1(877) 214-3355 Ext. 116, and I spoke to someone by the name of  John Hughes requesting to speak to this individual.
