Stop all your transactions to them, and tell your bank to reverse the charges that they made, and let the bank know that they lied to you about being a law firm, and change your account number.  Also you need to contact the Attorney General in Buffalo NY.  They will help you.  Try calling 1-888-239-9586, they still answer Bryant and Benjamin there.  They are illegally withdrawing from your bank, if they are not really a law firm.  It sounds like they threatened you for some kind of legal action, right?  Sue the crap out of them, and reverse all the charges.  They have changed their name six times in two years, and typically disconnect their numbers after they scam enough money.  Your bank must reverse transactions that were fraudulently processed.  Call a local attorney and file a complaint with the FTC.  They are illegal, and bigtime JERKS!!!

This isn't the number that comes up, in fact, they block the number because they know they are shady.  I have been dealing with this group of thugs for awhile now, and have actually obtained an attorney and I am in the process of filing a suit against them, specifically a "Mr. Rice". This is nothing but a bunch of scam artists that have purchased names of people who have gotten payday loans online, and they are now trying to strong arm money out of those people!  This "company" is so shady that when my Attorney tried to contact them, the first time he called and asked to speak to "mr.Rice", his call was "disconnected".  the 2nd, 3rd, and 4th times he tried to call back, they wouldn't even pick up.  the 5th time, they "accidentally" picked up and we could hear them talking, but they wouldn't respond to him.  the 6th and last time he called, they answered, and when my attorney said he had some money to pay "Mr. Rice", funny, he was connected, but as soon as "Mr. Rice" was told he was speaking to an attorney...click!  Word of advice: NEVER give OR confirm your SSN to ANYBODY over the phone.  NEVER give your Credit Card/ATM Card or ANY banking information out over the phone.  ALWAYS ask for verification of the debt in writing before you decide you actually should pay anything!

your money is lost forever.  The chances of them actually paying the real creditor is slim.  They either purchased the debt, or stole your name from a database using a debt collector that stole the information when it was with a legitimate collection agency.  Call the  attorney general, make a complaint, and call the ftc and file a complaint as well.  They may be able to trace the payment.  Call your bank and cancel the payment, and tell them that you found out that this Law firm is phony, and you were ripped off.  They wont give you an address, or make the usual debt collection statements, like: "this is an attempt to collect a debt'" and so on.  Try to cancel your payment with your bank, and change your account number if you have to so they wont try to do a ACH transaction again.  It is not illegal to reverse a payment that you feel was improperly represented, especially if they are NOT a law firm.  I hope this helps you.

They are calling me back to back ststing I owe a pay day loan form a few years ago. Her name was Diane that I had spoke with she had statedyou have a  case against you and that I was going to be serve papers to door by the sheriff. I told here ok! Then she said they will send paper to my job and take me to court ,So I then stated to here do they have a payment plain she said ok! How much can you pay a month and when can I started making my payment Dec 23 I replied then she had connected me to another person stating my social security number. Then I asked her what then she replieds I need a debit or prepaid master I told her I did'nt have neither then she had me on hold which I could hear what she was saying it didnt sound right.So she connected me back to Diane she said please call back wiht your routing number. So I then call my sister which is a lawyer and she said no that is a scam. People are so crook it you don't know what to believe. I then got a cal from the same number and they guy stated on the phone message please call us back in 24 hrs an if not good luck also it knew my lat 4 of my social security number how did he get that I wonder .The number was 716-803-8818 How can we put a stop to these bogus people?

They are not real.  They will threaten you to call police if you ask their address.  Bryant and Benjamin is not a registered law practice in any state of this country.  They will be raided soon at their physical address, as I have had a connection traced to the actual physical address.  I have worked with the FTC, and the AG's office to secretly record them.  They were caught on tape admitting to changing their name, and that denied their actual address.  They will be shut down soon. Also caught them on tape threatening to send police to my physical address, and falsely charge me with harassing them.  The tables have been turned!!!  Good luck Bryant and Benjamin, or whatever you change your name to next.

they've been leaving me messages for my son and neither of us know what this is about.  Mrs Marano said she was from the legal offices of Prescott and idiots.  When I ask what's this about I'm told that they will only discuss it with my son.  I felt something was just not right.  Subsequent calls from them claimed they are "liquadators".  Let me know how your case turns out

I just recd a phone call from these people and the conduct was "outrageous" to say the least.  I too had an old payday loan and they gave me the lines about sending a warrant out for my arrest and also that they would not accept any more payments from me, but that I had to get the money from a family member of a friend.  What kind of practice would that be from a legitimate law firm.....smells fishy to me.  I am now in the process of contacting my own attorney to have these harrassing phone calls stopped on my workplace....

What idiots they are! Here is the letter I sent - also filed with the Attorney General of NY and State of Florida online - sorry the letter is so long. Also, good advice from earlier blog..know the laws!
TO PRESCOTT, etc. - sent Registered Return Requested

 This letter is in response to several telephone calls you made to my employer and my subsequent call to both women listed above. (Dolores Benderson & Mrs. Manaro)
   I first became aware of the alias of Prescott, Burns and Stewart when I received a letter from my employer that the above firm had called and left three (3) messages on his voice mail advising him I had ?an item returned to my account? and he should ?tell? me to call you.  Now you know this is illegal.  Then I called today and first spoke to a Mrs. Marano. I asked if she was a law firm, she stated she was a pre-litigation firm. I again asked if she was calling from a law firm: she again circumvented my question. She then told me I had an outstanding loan to a payday company going back ?many years.? She said her record showed they did try and contact me twice in 2009. I asked her for the name, address and telephone number of this company and she informed me it would be impossible to speak to anyone; her company handled the debt. When I again stated it wasn?t mine and wanted her address she put me on hold. After two minutes, (yes, I timed it) she tells me she is transferring me to her supervisor who handles my ?case?.  I was then transferred to Deloras Benderson. I advised Mrs. Benderson that I wanted the address of her company and she wanted to know why. I told her that I wanted to reply to the claim made by Mrs. Marano and to file a claim with the FTC. I also advised her I had a copy of the tape where PBS called my supervisor three times and left the above message on his voice mail.  She kept saying it had to be the automatic recorder (?) and I assured her anyone listening to this tape would know it was a human.
   So therefore, I have filed a complaint with the FTC, reference #27812521 and will file with my state?s Attorney General on Friday, October 1, 2010.  I am also filing with the Attorney General?s office in New York. Pursuant to my rights under federal debt collection laws, I am requesting that you cease and desist communication with me, as well as my family, friends and employer, in relation to this and all other alleged debts you claim I owe. Civil and criminal claims will be pursued should you continue.

   Let this letter, again, serve as notification that I do not wish to be contacted about this debt any further except to be notified that future collection efforts are terminated and my credit report has been cleared. Any other communication regarding this debt will be taken as a violation of the Fair Debt Collection Practices Act.

received message on my landline from Margaret Rydell saying that my mother needed to give her call regarding a case number.  i called the number back and told them that the person they asked for did not reside at this number.  They asked me if I was a relative and could I give her a message.  I said no I'm not giving any messages and that I'm not doing their dirty work.  I obviously gave my mother the message who promptly called my sister (an attorney) and gave her power of attorney.  I just drafted a letter tell them not to contact me anymore (will send it certified) and I filed a complaint with the FTC and my state's attorney general.

I have this company known as Prescott Barnes and Stewart calling me wanting a rediculous amount from me or they will summons me to court.  When I asked for a mailing address, I was told that they do not except payment by mail and that payment could only be by credit card.  No information can be found on the computer but I was given a hot mail e-mail address.  HOTMAIL!?!  And when I asked them to send me information on thier company, they told me that they can not reach my e-mail account which is funny because everyone else can.  I am not going to send payment unless they can come up with hard edvidence that there company does actually exist.  Just because they know I have a bill doesn't cut it.  Even the garbage man knows that.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

This same firm has been calling me for the last past couple of weeks. I asked them to provide me with written proof of the debt that I owe. They emailed me something on their letter head. I still did not recognize the nam of the company nor the amount owed. They called me at work and the connection was lost. They sent me a threatening email. I responded by disputing the amount owed. They called my supervisor and told him that I been calling them and harassing them. I couldn't believe it. There must be some law that protects the consumer. Anyway here's the address listed in the email they sent to me.
