I got a threatening call from Sandra Williams representing Sanders Legal Associates at 818-851-7960 indicating that I had received a loan from InstaCash over a year ago and had not paid it back.  they stated that they had tried contacting me on 13 different occasions via email and I never responded.  The had a very heavy accent and where of indian decent.  They accused me of lying and told me i would be arrested in the morning and my work would be contacted if I did not pay $791.00.  I ask for information relating to the loan and they couldn't give me the information.  Please don't fall for this scam and contact the police immediately.  These payday loans give out our personal information so these con artist can take advantage of our situation.

Has anyone paid the callers from 877-302-2505? I really want to find out what company name shows up on your card statement when you pay them.  Even if they're calling from India or somewhere and giving you a fake company name on the phone, someone in the US must bill for them -- I really want to find out who it is.

I got every cent back from Sanders Legal Group, BUT I read above where one woman is having it taken back out of her account. However, I also filed a police report and the detective contacted Sanders Legal Group.

I'm still receiving calls from these jerks.

I had the same situation.  They called me at work on the busiest day of the month right at 12:00.  I happened to answer the phone and I was literally on the phone with them for a half an hour before I gave them my "authorization" to take money from my debit card.  I work at a bank and I know the red flags fro fraud and tell people this every day and they still got me.  I do have debt out there, so when they said I owed money and they needed payment that day, I listened.  After going through two females with very thick heavy foreign accents that I couldn't understand I was transferred to a male who claimed to be Attorney Chris Berry from Card Services and "the minute I get this call I need to have my attorney present."  I told him I was at work and I didn't have an attorney.  I asked him what the call was in reference to and he told me I owed them $8,889.00 and they needed payment that day, if I could not make the payment that day I would be arrested Monday morning, December 6, 2010 at my residence and if I was not there, they would arrest me at my place of employment."  I was immediately scared and panicing as at the time I was the only income coming in as my husband had been laid off and they also told me that I was a fraudster and that if I didn't make payment that day, they were going to call my employer and tell them I was a fraudster and I was going to lose my job.  I was almost in tears at this time and I told him he could not do that because I needed my job.  He kept repeating that I was going to be arrested and that if I could pay a portion of it that day they could make other arramgements.  I finally asked him how much I needed to give them to make it good.  He told me that "he needed to check with the payday loan company and let me know, but I needed to stay on the phone for 7 minutes, if I hung up I was going to need to pay the full amount of $8,889.00".  I agreed to stay on the phone because I didn't dare hang up.  He came back on the phone and told me that I could give them $861.00 and that would take care of it.  I told him I could do that.  He told me I needed to write a letter stating that I owe ACS $861.00 and that they could debit my debit card.  He then told me that I "needed to write down exactly what he tells me, exactly how he says it".  I did wrote and SIGNED it and then faxed it to the numbers, 2, that he gave me.  After I got out of work I had the time to actually think about what I did and realized it was a scam, went on line and saw the proof.  I immediatley called my bank and had my debit card captured and a stop put on the Sanders Legal Group Trust debit.  Because I work at a bank I knew that it might be harder to try to get my money back if I signed the paper.  The bank put in a claim for unauthorized debit card use.  I was told by the customer service rep to contact Homeland Security as they need to know this information.  I did.  I called and spoke to one of the agents who had me write a letter stating the above information and he was very helpful.  These people had already gotten my money, but then they kept calling my house and leaving the same message about being arrested and they called 2 of my family members and told them that I used my family member's personal information and committed fraud, but the kicker, they needed money from my family, sister and neice.  My neice contacted the local police and my sister hung up on them.  When they called my neice 12 times in a row they somehow used her phone number to call her.  Her number showed up on the caller id and she thought her husband was calling her from his cell phone.  They are tricky.  Homeland Security wanted me to call them and demand my money back and let them know that I had spoken with this particular agent as they are familiar with him and see if they will send me a check.  I asked him what if they sent me a fradulent check, I would rather wait and see if my bank will give me back my credit.  They did.  My account was credited 12/24, just in time for me to get some Christmas presents.  Homeland Security told me that in about 4 weeks they would start calling again and they have and left threatening messages; which I have avoided.  They have called my boss at work and tried telling her she was a fraudster and that she was going to be arrested.  They are amazing.  They would hold on the phone for me for 10 - 15 minutes at a time to see if I would pick up and talk to them.  Now for the best part of teh story:  My bank called me at my branch the other day as a courtesy call because I work for the company to let me know that the company Sanders Legal Group Trust is asking for a reversal of the chargeback on my account as they have proof that I authorized them to take the money from my account because they have a "SIGNED" letter from me.  My bank is debiting my account to give back to these FRAUDSTERS on the 16th of February.  I don't have that kind of money in my account.  I also received a copy of the letter that was sent to them from "BRETT FISHER" who by the way has very pretty hand writing for a guy, unless Brett is a girl...I called the bank today to make sure I was understanding her correctly, that my bank was debiting the money.  She said yes.  Because my first thought was they were doing it and they woudln't get any money from me because I closed that card, but my bank will debit the account it went into, doesn't matter what the debit card number is....So now I need help in what steps should I take next.  I asked the claim dept if I could close my account to avoid the money getting taken and she said no, they would just debit me anyway and I would end up with a charged-off account.    I still think that I will close my account as I don't feel the bank is protecting their customer, as they know this is a scam, the customer service rep, told me she knew it was a scam, she'd seen the epsiode on Dateline or something, but because I signed that paper they have to give that company back "MY" money.  Any suggestions on what to do next????

I was left 3 voicemails over a 3 day period and finally called the person back.  The number is (773)747-8829.  I talked to three people, all with Indian accents.  He said his name was Paul Johnson from The Law Office of George Sanders in Chicago, Illinois.  I also talked to his boss, Andrew.  They told me that I owe for a payday loan back in 2008 ( I had received a payday loan in 2006 and paid it right back the following week) and I needed to pay them $500 now otherwise it would go to court and I could easily pay over $1600.  I told him I never got a payday loan in 2008 and I wanted proof.  He was very hesitant but later agreed to e-mail me the contract I signed to the payday loan company.  It had all my information on it including my birthdate, last 4 of my social, my bank name, bank account number, and bank routing number.  It also had 2 of my references and my mailing address.  After arguing for an hour I told him I would call him back in 10 minutes.  I looked up The Law Office of George Sanders in Chicago and gave him a call.  George Sanders answered and said he has had a few calls from people verifying if it was his law firm.  He told me to call the FTC Bureau and file a complaint.  I called the FTC bureau and they took my info and complaint.  The lady said there have been many payday scams over the last 4-6 months when one of the payday loan companies computer server was infiltrated and the thief stole most of the files on people who had payday loans.
The guy, Andrew, called me back and I told him I talked to George Sanders and he said you are a scam and you have been reported to the FTC.  His response is that the guy I talked to was a fake (yet I looked up George Sanders law office online and only one in Chicago).  After he continued arguing for 20 seconds he said, "Forget it!  See you in court."

my turn....please don't fall for this scam don't pay them any monies if you owe a payday loan call  the original company up and make payments with them.first let me say this YOU CANNOT BE ARRSTED FOR A CIVIL MATTER...now i know these idiots threaten you with check fraud and it's a criminal offense,so lets explain that...if you go to a store and pay by check and the check bounces then the store will make payment arrangements with you,,if you don't pay then you can be arrested and today most stores don't even take checks because you use a debit card.....
now if you have a check bounce on a consumer charge you cannot be arrested for a civil matter and if you can be arrested then what about the times where a check bounce for the mortgage,, utility,,credit card you was never arrested you was charged late fees.
another thing that might help you and the payday loan companies don't want you to know this....
there is 15 states where a payday loan is illegal so what that means for you if you live in one of these states is that you don't have to pay any interest back on the loan just the original amount you borrowed and the law is on your side,,of course they will lie to you but don't fall for it at the end they will accept the principal balance of the loan and even they ask why did you borrow the money if you knew it was illegal all you have to say i didn't know that i just found out...the law protects the debtor 80%.
go to ask.com and write in what states are illegal for a payday loan and lets hope you live in one of these states you will save a lot on monies also if you already made some payments subtract that from the original balance

My turn.

I have used Payday loans and have had some financial problems. I have paid at least three different times now because I have not been keeping track of my records. They use the name of Federal Crimes Inforcement.  As soon as I pay off a collection, I get another call about another debt. I, like many others, was afraid of the "police visit". Do I call them back and tell them to go for it or, threaten them with my own legal action? I thought I knew better than to fall for this.

I almost got scammed today.  They called saying they are from Dept. of Law and Investigations and I owed 856.00.  I almost paid until I tried calling back and the phone number was temporaily out of service.  I blocked my card immediatley before they could get my money.  They then proceeded to call me at work non stop all day.  They threatened me and tried to get other employees involved.  They also took it so far as to say I had a family emergency so I would talk to them.  I told them I wasn't going to pay until I saw proof of the loan that I did not pay.  I spoke to a Ronnie Williams and a Jack Smith both having the India accent.  I saw that they tried to get my money off my blocked card and it was from Sanders Legal Group.  I immedatley googled and found all these scam alerts.  They were very convicing when I was talking to them, but I am glad I listened to my little voice.  I just tried to call them back to tell them I knew it was a scam and I was going to contact the proper authorties and no one would answer the phone.  I just hope these people get stopped before more innocent people lose their money.  The phone numbers they used with me were 562-252-0381 and 818-532-9217.  Please do not give out any of your information.

For at least the last four years, possibly longer, a group has been calling former payday loan applicants advising them that they have defrauded a bank and are now being sued for non-payment of a loan.  The callers will claim to be calling on behalf of an attorney's office (name varies), the Dept. of Law and Investigation, ACS, or other similar combinations below:

United Legal Processing Division
Midline Marketing
Crime Monitoring Services
Monetary Crime Division
U.S. National Bank
Attorney General?s Office (usually in California)
American Legal Services
Affidavit Consolidation Services (ACS)

You will be threatened with arrest, a costly trial and possibly worse.  In no shape, way or form can you be arrested for non-payment on a consumer debt.  Do not believe these threats, as they are without merit and cannot be carried out in the manner they allege.

Who are they?

In the past when pressed by law enforcement for an address, the callers have provided the following information:

David Morgan and Associates
Morgan & Associates
Morgan Associates
954-727-8481
1155 Northwest 85th Street
Wintergarden, Florida  33150
(Address is likely invalid)

The collector's MO matches a once legit collections agency called Ellis Crosby & Associates.  Here are some links on them:

http://www.budhibbs.com/collectorpages/ellis_crosby_and_associates.htm
http://www.budhibbs.com/collectorpages/EllisCrosbyJudgment.pdf

They have been previously fined over $1.3 million for various violations.  They have been known to use phone banks in India to make their calls, which more or less coincides with the difficult to understand accent many of us detect when we are contacted.

The last time this group went by any "official" name was back in 2008:

Ellis Crosby & Associates / Douglas & Morgan Associates
4494 Southside Boulevard Suite #200
Jacksonville Florida 32216
Phone:  800-928-3536 / (904) 928-3536
(Address is likely invalid)

There are NUMEROUS consumer alerts out against this group of individuals:

Missouri:
On July 15th, 2010 a Public Awareness Bulletin was sent out by Missouri Information Analysis Center.

"..received reports from individuals in Ohio and Illinois reference suspicious telephone calls they received. In both instances, the callers are reporting that a voicemail is received from a man, with a Middle Eastern accent, identifying himself as an officer working with the Financial Crimes Unit.  The message indicates that the reason for the call concerns a loan made by the receiver or someone in the receiver's family. The voicemail requests that a return call be made and a telephone number is provided. When a return call is made, the caller is asked to provide personal identifying information such as their date of birth and social security number.

Reports indicate that the calls are frequent and persistent and that they even threaten arrest or legal action if information or money is not provided. It appears that the individuals making these calls may have access to some records connecting individuals and their relatives.  Missouri does not have a Financial Crimes Unit and all indications are that this is a fictitious agency. If you receive a similar phone call, please be advised that it is a scam and please contact your local law enforcement agency or the Missouri Information Analysis Center at 866-362-6422."

Bottom line:

Do not supply the callers with any additional information.  Inform them you have reported them to law enforcement and hang up.  If you haven't already, go ahead and report the calls to local law enforcement, your state's Attorney General and beyond.  Look up the local Secret Service branch's information in your area and get in contact with an agent there.

If you ever applied for a cash advance online, your information is out there.
Possible sources for the breach of your privacy are:

* The scammers obtained your information from Teletrack - a reporting agency used by many cash advance lenders to determine their risk lending to you.  The service is able to tell cash advance lenders if you have existing loans with other companies, for example.  Many state laws prohibit borrowers from having more than two cash advances out at the same time.

* The scammers created their own fake payday loan application site.  People looking for a cash advance went to the site and applied, thus freely providing the scammers with their information for malicious use at a later time.

* The scammers were able to get into the database(s) of cash advance lenders - probable targets being Sonic Payday and Cashnet USA.

How to protect yourself:

* Inform your employer.  You are likely getting calls at home and/or at work, so make sure your employer is aware the calls are part of a scam and to not take them seriously.  Advise the callers that they are no longer allowed to call you at work.  If they continue to call, document the date and time of the calls you received.  Save voice mails left if at all possible.

* Change your number(s).  For some this may not be an option, for others a one-time number change can be done free of charge.

Be advised - any references you listed on your payday loan application will be contacted.  Let those people know that this is a scam, and they can disregard.

* Use Google Voice.  Google Voice is a great replacement voice mail system for just about any phone number you use.  Messages can be transcribed and voice mail recordings can be saved as mp3 files.

Pro Tip - call the scammers with a Google Voice number before turning off your old phone numbers.  Make sure when you call you identify yourself so they can start up their script.  At any point after they have your information pulled up just hang up.  They will then start religiously calling your Google Voice number.  At this point, you are free to change your regular phone number(s) and enjoy not having these people ever call you again.  (And laugh at the fact these people are basically talking to a brick wall several times a day)

The scammers change their numbers frequently.  Law enforcement used to think it was because the callers ran out of minutes on their prepaid wireless accounts or they were shuttered due to fraud, but now they understand it's simply to evade detection by savvy consumers online.  With the proliferation of VoIP, it's even easier for the crooks to stay a couple of steps ahead of law enforcement.  Below is just a sampling of the 30+ numbers that have been used in recent memory.

So can they really do anything to you?

It's not a simple yes or no answer.  Logic dictates that, if they really wanted to take you for a ride and drain your bank accounts, they already would have.

So, why haven't they?

Authorization.

Why do you think you are being called so much?  Perhaps it is because they like the sound of your voice?  No, they have to have your authorization to take any form of payment from you, period.  The callers know their audience, and that audience is typically a bunch of people that have applied for payday loans in the past.  Most of those people they call couldn't afford an attorney if they wanted one, and are so used to receiving collections calls that so long as they sound like a real collector, they will likely be perceived as one.

Furthermore, they don't even really want to talk to your attorney - that just sounds official and scary enough.  A real attorney would take the callers to task and write them off as two-bit con artists.  The callers need you, in writing, to authorize payment against the fictitious debt they claim you owe.  Go ahead, ask them for proof you owe the debt - more commonly known as verification of debt.  See what they say.  A phone authorization carries very little weight, so if they have something signed by you on file, you are done for - and the callers know that.  That authorization is the only thing these callers are doing by the book, and for good reason.  If they just went all willy nilly and made an ACH debit from your checking account, without your written approval, you could in turn report the transaction as fraudulent to your financial institution.  In about 7-10 business days, you would get the funds returned to your account.  Then the scammers would be up against a bank and their team of lawyers and investigators.

Bottom line:

If you haven't paid the callers a dime, don't.  If you planned on paying them to shut them up, just don't.  Remember - you are not being contacted by a legally licensed, ethically owned and operated collector.  Read up on the FDCPA - http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf - and know your rights.

Dear Anne:

Today I was contacted by this scheme operation and was told I would be imprisoned as there was a loan taken out under my name, which I had no knowlefge of, howvever, they claimed to be a government agency and so I gave them my debit card no. so that they collect the funds and to send me back up documents substaining this, and I would later appeal.  I JUST FOUND OUT IT WAS A SCAM!  I immediately called my bank and alerted them as to what occured and to stop payment.  Reading the steps you took to prevent this was comforting.  I only regret I read it after the fact!

Were you able to get your monies back?  What other steps can I take to prevent others from going through this horrible experience?

If you are targeted by these criminals, be sure to report them to all the following federal and state law enforcement agencies (most of which you can do online or over the phone):
1.    The U.S. Secret Service is responsible for protecting the country's financial infrastructure and payment systems from international and domestic threats. Call or write your local Secret Service field office to alert them to the details of this attempted extortion. The addresses and phone numbers for the local Secret Service field offices are listed at http://www.secretservice.gov/field_offices.shtml or in your phone book.
2.    Alert the FBI at https://tips.fbi.gov Be sure to tell the FBI that you are being targeted by extortionists over the phone. And if the crooks claim to be law enforcement or lawyers, officers of the court or bankers, be sure to include that information in your report.
3.    File a complaint with your local police. Most police departments will take a report over the phone.  Be sure to tell them that you're being targeted by an extortionist and give them all the details.
4.    File a complaint your state's attorney general, the contact information for whom is at www.wvago.gov
5.    File a complaint online with The Federal Trade Commission at https://www.ftccomplaintassistant.gov/FTC_Wizard.aspx?Lang=en
If these crooks call back, promise them nothing, pay them nothing and tell them nothing other than that you know they're a scam and that you've reported them to law enforcement. (And be sure to report them to all the agencies above each time they call you.)

By the way, here's just a small sample of numbers used by this particular group of scammers. Read the reports and you'll see the same pattern time and again -- phony organization names, thick foreign accents, and oddly worded threats that are so melodramatic and ridiculous that it's laughable:

Scam alert: Bogus debt collectors
By Leslie McFadden ? Bankrate.com
Monday, Aug. 3
Posted 2 p.m.
Bankrate reporter Leslie McFadden contributed this entry.
This scam isn't technically about credit cards, but it is scary enough to post a warning. The Better Business Bureau issued an alert today saying consumers across the country are getting phone calls from bogus debt collectors claiming default on a payday loan. Of course, the consumer needs to pay a large fee to avoid arrest -- as much as $1,000.
The caller poses as a lawyer, and may threaten extradition to face trial if the consumer doesn't pay up immediately.
What makes these calls alarming -- and perhaps convincing -- is that the perpetrators reference the consumer's personal information, such as the person's Social Security number, driver's license number, previous bank account numbers, home address -- even personal references.
"The amount of information they have is really troubling," says BBB spokeswoman Alison Southwick. She adds that the amount of data points to a possible security breach.
Spread the word to your friends and family: Don't give out personal or financial information to an unknown caller. Scammers can spoof Caller ID to display different numbers, so trust your instincts over technology.
The BBB offers these tips:
?    Ask the debt collector to provide official documentation which substantiates the debt.
?    Do not provide or confirm any bank account, credit card or other personal information over the phone until you have confirmed the legitimacy of the call.
?    File a complaint with the Federal Trade Commission online if the caller is abusive, uses threats or otherwise violates federal telemarketing laws or the Fair Debt Collection Practices Act.
?    File a complaint with the Better Business Bureau online if you believe a debt collector is trying to scam you.

Debt Collector
This  same company calls me stating I owe them 300  that was deposited into my acct. He had a thick indian accent,  barely speaking english and telling me im going to be brought up on fraud charges if I didn't give him my visa or mastercard credit card. That i now owed them $1200 for late fees and other fees. They demanded my credit card info, I was foolish enugh to give it to them because they threateded to hav esherrif at my place of employment the next day,and i wanted to avoaid any possible embarassement or getting fired due to such serious accusations.

They charged my account $400 as the first payment and asked me to notorize and fax my information to James Parker at (818-937-1916. On speaking to an attorney and researching online i realized that these are scam artists.

When I called and confronted them, they said they were going to refund my money back. they called from 530-452-6712. These are scammers please spread the word and beware. It can happen to the best of us, dont feel bad. I never thought it could happen to me.
