Not in trouble you say????  Hmmmm, the Illinois State Attorney General disagrees:  MADIGAN FILES SUIT AGAINST CHICAGO DEBT COLLECTION AGENCY

Chicago?Illinois Attorney General Lisa Madigan today filed a lawsuit against a Chicago debt collection agency for allegedly using unfair tactics, intimidation and misrepresentations to convince consumers to make payments when, in some instances, the consumers never owed the money.

The lawsuit names Leading Edge Recovery Solutions, L.L.C., as the defendant.  Leading Edge Recovery Solutions, an Illinois limited liability corporation based in Chicago, collects debts on behalf of various entities, including credit card and installment debts.

Madigan?s Consumer Protection Division has received 53 complaints against Leading Edge Recovery Solutions.  According to these complaints, consumers made payments ranging from $300.00 up to $2,900.00 and, in some instances, Leading Edge Recovery Solutions deducted payments directly from consumers? bank accounts without the consumers? authorization.

?Based on the numerous consumer complaints that we have received, Leading Edge Recovery Solutions and its representatives have harassed and intimidated consumers in Illinois and throughout the United States to obtain payments on alleged debts,? Madigan said.

The lawsuit, filed in Cook County Circuit Court, alleges that Leading Edge Recovery Solutions has attempted to collect on debts that are as much as 20 years old and, in some cases, are not even owed by consumers.  When consumers have responded to contacts from Leading Edge Recovery Solutions by requesting proof that they actually owe the debt, the company has failed to provide such proof.

Madigan alleges that as part of its collection efforts, Leading Edge Recovery Solutions sent collection letters and contacted consumers by telephone, often using abusive language or improperly contacting consumers at their places of employment.

The complaint specifically alleges that representatives of Leading Edge Recovery Solutions made numerous misrepresentations during their collection efforts, including:

That they are attorneys and that the company would file a lawsuit if the debt is not paid;

That the company would file a lien against the consumer?s property if the debt is not paid;

That the consumer could be arrested or imprisoned for failing to pay the debt;

That the consumer?s wages would be garnished if the debt was not paid; and

That the company would take other actions that would have an adverse impact on the consumer?s credit report if the debt is not paid.

Madigan?s lawsuit asks the court to prohibit Leading Edge Recovery Solutions from engaging in the business of collecting or attempting to collect on debts, and from further violating Illinois? consumer protection laws. The lawsuit seeks civil penalties and requests that the court order Leading Edge Recovery Solutions to pay restitution to consumers.

Assistant Attorney General Janice Parker is handling the case for Madigan?s Consumer Protection Division.

They just called and left a message that it is a debt collection agency and when I called them back after couple of days to the same number, they said that they are from Leading Edge Recovery Solutions and verified my name, address and last 4 digits of my SSN and told me that its not me and they are looking for some one else with the same name. I learned from my colleague that's it was a scam and don't know what to do next. I tried to google the number and got this posting, does anybody know anything about this? Should I make an official police complain that people are harrassing by giving an anonymous call and collecting personal information?

This number which is some kind of collection agentcy keeps calling late at night and at 4:00am in the morning. Just called my work, and asked for a co-worker. I called back and confirmed that it is them.

Called yesterday and today at 3:30. No message.

Collections, they call with a "private" number then leave the message to call back at this number. I have them blocked and I'm not sure why "Mr. Black' would think I would call them back. I am doing the best I can and with all the harassing calls I cannot even make a call without getting hung up on, so much for doing any business to make money, to pay the slobs.

Just received call from "Paul Black" and gave this #, no other info. My phone shows that he has called me 30 times, not identified, just says unknown

I have had a call a day from this number, every day at the same time of day, and no message left on voice mail.  When I call back the number simply disconnects the call.  I have no idea why anyone would be calling me from such a number, and with no message left, I am none the wiser.

So I get a call from the 877 865 9750 number, and it keeps calling and hanging up. I go to the website to send them a message to stop contacting me, and I took a screenshot for my personal records.

I call, and ask why the hell do they have my number and why are they calling me when I never asked for their services, then she goes on to tell me that I have ALREADY removed my number from their list! And that they haven't contacted me since may 10th, and then keeps saying she removed my number when I tell her that isn't the case and that the company is STILL contacting me without my permission, and just hung up on me.

So then I call the 877 865 9750 number back, and what do you know, its the same f****ng recording message for each line. I removed my number from there too, but don't be so sure. These a***oles are really shady, and I'm ready to take legal action if they continue.

The problem of runaway skip tracing is hardly news to me, being arguably the most common source of complaints about debt collectors. While the FDCPA does limit its coverage of those who are not alleged to owe toward some account, it does say that "any person" is not to be harassed or abused.

We cannot speak for all the "Ethels", but they do have things to lose, like their sanity, their peace and quiet, and their right to not be pestered or shamed through their neighbors and relatives. Should an "Ethel" try to bark louder than the collector, it is not unheard of that she might find herself threatened with a harassment charge, or even visited by local police. The impulse to "block / ignore / insult" will not solve or prevent the problems created by skip trace misfires.

Now that I've seen your other comments in this thread, you may understandably have missed my advice to "Screener" in Nov 2011, which applies to non-debtors plagued with collection calls. The general idea is to put hostile collectors on notice and you calmly in the driver's seat for a change:

A good many "Ethels" have gladly *made* time "for such nonsense" as a civil suit, in part because their own rights were denied and their lives disrupted, and in part because the abuses will only be heaped upon more people in the future unless someone slaps a leash and muzzle on these debt industry attack dogs. Sometimes the cases change the landscape forever, such as Foti-v-NCO, which has had every collector in North America chewing its nails every time a phone message is made, and the more recent $10 mil damage award handed to Diana Mey against the suddenly out-to-lunch Global AG. Once in a great while the offending collection office is bolted shut for good and its hired thugs are escorted away in handcuffs. Those things don't happen when you shrug off the abuse and call it Someone Else's Problem.

If this is a debt collector calling your cell phone with any type of autodailer or robocall without expressed written consent to do so they are violation of the TCPA and can be fined between a  $500 up to $1500 per call.  So to all you people getting calls find out if this person is a debt collector and then how and if they  they have consent to call you.  If you gave consent in say a CC agreement rt other customer agreement you can revoke it and then after your revoke it if they keep calling they will be fined $1500 per call for purposely violating TCPA.  This happened to me with another collection company and I got a lawyer.  Now they are trying to settle b/c the know they are in violation and the  fines would be 50K+...

Hint if you plan to sue play stupid, don't tell them and let them keep calling racking up the violations and then get a lawyer.  Most who specialize in this consumer stuff will take it on contingency after you explain the case, facts, etc...

This was Humana Medical calling about a health check reminder.

I called back 877-865-9750 and a recording said that this company was Leading Edge Recovery Solutions, probably a collection agency.  They undoubtedly were trying to collect from the scumbags who had our cell phone number before us.  I had them correct their records.
