Doug-

Prepaid debit cards work great for these types of situations. It reduces the risk to your primary bank account.

IF you believe this will help your credit you are a fool! First of all, pay day loans that are defaulted on almost never show up on your credit report. Secondly, most internet based pay day loan companies will not pursue court cases as they were not licensed in the state that they were loaning in AND it would cost too much to obtain counsel in the county/state where the debtor is located.

I have settled on a two loans that I defaulted on. Do it directly with the pay day loan lender and not collection agencies. I settled mine for around $100 each; keep in mind this was after I had paid hundreds more in interest payments than the original loan.

This guy is not a lawyer. He is a guy collecting on payday loans from his home. He leaves messages saying he has a legal department...but I wonder which bedroom they are in...

He says he works for a company that lets him work from home, but the company is listed at his address...how stupid does he think people are!!

The loans he collects are 99% not even going to be on your credit report, as to even report to agencies you have to meet certain criteria. If you ask him though he will say it is on there...

Don't be fooled, just send him illegal emails to a contingency collections attorney and enjoy making a few hundred bucks when he has to settle instead of being sued for violating the FDCPA.

My in-laws have been receiving calls from this number on my behalf.  I did take out payday loans two years ago, but paid them all in full.  I was so embarrassed to be called by my mother-in-law to be told that I had a court date and this lawyer, Larry Mitchell, had been calling her house and leaving messages for me on her answering machine. I had also been "officially served" in a previous message on her machine. I got the court date and case number called my local courts to ask what it was about.  I had every intention of going to the court date to discuss whatever the problem might be or to make arrangements to pay whatever debt needed to be paid.  They don't have me on the docket.  Also, I called Cashnetusa, as many of the complaints listed on this site have cited that company, and they have no record of me at all.  I will be calling Mr. Mitchell tomorrow as I'm not getting an answer at the number he left today.

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Be careful about putting your payment information on file with this guy...Larry told me I would going to be served at work if I didn't pay off an old payday loan. I agreed to certain payments but a few times I was short and needed to move my payments, and he ran them without my permission...

After reading the comments here I should have never gave him my info since he is obviously a scam artist using illegal collection tactics...

I had to go through the hassle of closing the bank account and getting a new one.

Juan, if you bothered to check you would know this was not on your credit report...
90% of debt agencies aren't posting payday loans on a credit report because they see who pays and then sell them again. And to keep an item on a report you have to retain ownership...

Mr. Mitchel at LIV Resolutions was able to help me clear up an old outstanding issue I had with my credit. I did take out a loan with CashNet USA a few years back, and I knew I still owed for it, so I was actually glad to resolve it now that i am working again. I was able to reach a settlement, and get a final judgment letter which will allow me to get my credit back on track. Unlike the other people reporting above, I actually want to pay my debts and get on with my life!!!!

Here is what I got...
Name:
Call or e-mail me regarding your defaulted loan. Our Legal dept is filing a Civil Judgment lawsuit against you in Harris County Court on Friday 3/23/2012  for a bad check issue to My Bank regarding your loan with Cash Net . We have  tried several times to contact you and all correspondence has been  ignored. A great offer was made to settle this with you for 75.00  a month until it was paid in full, and that too was ignored. It became very clear to this Firm that you had no intentions of ever repaying this loan. A summons will be issued to either your place of employment or your current residence. Name, If you would like to request a STAND DOWN order so you will not be served at work please contact our office, The offer is still on the table until the filing, if I can help you in any way please contact me and reference #,  Thank you.

Is this just a copy any paste to everyone??

Man named Larry told me the address of his business to send payment for a Cashnet USA account. When I typed in the address into google, it came up as a house...

Sounds like a SCAM! Larry told me he works from home for his office, however, when I went to the NYS Department of State, LIV Resolutions is registered to the address he says is just a satellite location...

SCAM ALERT!!! Anyone else dealt with "Larry"?

I got this same email and just sent a copy to a collections lawyer for review, He said it has at the very least 5  FDCPA violations which are $1,000.00 each in statutory fines. Also the lawyer said he works for free and charges the collection agency (can you call a guy in his house this?) for legal fees.

My email literally says the SAME THING LOL! The only difference is the county and the date, which is 3/9...which came and went by the way...

Same attorney names were used too, which you were right...don't exist, at least in my county...

I just ignored it and am letting this collections attorney get me some money!

I got the same message stating that i was having a Civil Judgement Lawsuit against me in the Bexar County Court on 3/16/2012 for a bad check reference a so called loan with a company called CASHNET, but i can settle this situation if i make a monthly payment of $75.00 a month untill it was paid off,(Yeah Right). It also stated that if i didn't make payment arrangements before 3/16/2012 that i will be served either at my residence or my place of employment. They mentioned the attorneys in Bexar county are Kenneth Morgan or Christopher House and they are supposedly based out of Bexar County.Natuarally there are no such indivduals that are attorneys with those names in Bexar County. Oh well, keep trying Mr. Mitchell because eventually you will be able to trick somebody into giving you some money.

I got the same type of email regarding a loan I took out from Cashnet USA a few years ago. He is one of those collectors you hear on the news who tries to tell you they are taking you to court yada yada yada...

I have had so many people call me and threaten this very same thing at this point I am waiting for someone to actually follow through so I know the true account holder.

Also not too keen on paying someone who uses a Magic Jack and works out of a house...

Debt collector, LIV Resolutions LLC. Sent me a bogus email telling me he had lawyers in my county filing charges for "FRAUD". Show it to my lawyer and he laughed. If you google his address, 5565 Thompson Road, Clarence NY 14031, it is a house!!

So it is a guy in a house yet he has a legal department?? Try again next time Mr. Mitchell....
