This man calls my family and friends non stop, for the last 3 years. He only calls around Oct, thru the end of November. He tells them that he needs to serve me papers, I even called this Allen last year and he said he had papers to serve me, but would not tell me what he was up too and I never got any papers.

For some reason these bozo's call our number leaving messages for multiple people.  The same fake Allan Shaw nonsense.  I put them under my "Junk" contact along with all the other spammers so the call goes straight to voicemail.  Anytime a voice mail from junk appears on my voice mail I push the little garbage can symbol.

I too have gotten calls from this same number, using the same bame ( Allan Shaw), which is pretty silly, Allan Shaw was the character attorney on the TV show "Boston Legal", I don't think it is an accident they chose this name.

  I got the exact same message, only I got a l'il sumthin' for 'em; I have a mini-cassette recorder attached to my phone and RI is a one-party consent state, meaning I don't need their consent to tape my conversation with them. I will ask if they are representing themselves as a law firm, seeing as how they threaten to "serve summons" etc; this is a direct violation of FDCPA; representing a collection agency as having any legal wherewithal to take you to court etc is a gross violation of law. Additionally, as other posters have warned, NEVER discuss any alleged debt with these b****oles, NEVER EVER EVER !!! Please learn what the Zombie Debt statute is for your state, you can Google it; Zombie debt is one that has expired the limitations, so you have no further LEGAL obligation to pay it nor can it continue to be reported on your credit, but collection agencies will still attempt to pursue you for it unless you know your rights. Just TALKING to them about it can allow them to "re-age" your debt, in other words, start the clock all over again in their favor ! So, DEMAND a written debt validation notice; if they don't have your address, HANG UP, do NOT provide your address; if they refuse to send you a written debt validation notice and also don't have your address, it's almost certainly a scam. Demand the validation notice to be mailed to you and HANG UP, don't let them goad you into saying anything more.
 As for the prior poster who retained an atty to sue the debt collector, will you PLEASE provide the name/number of that atty ??? I'm sure there are many here who would retain them also. I'm happy to find this board, we all need to help each other with these vultures. The more of us who take action instead of just complaining, the better off we all will be. I fully intend to sue these guys, I could use the money~ :)

I get these calls all the time too and they are prefaced by a recorded call telling me to call the scammers.  I am an actual debt collector and there are several things you should know.  There is a post further up that talks about the FTC and that info is very very good.  There's something else you should know about and that's FDCPA (Fair Debt Collection Practices Act) which states that, by law, any debt collection firm must provide proof of debt and proof that they legally have the account placed with them.  Failure to do so is a lawsuit.  In this week alone I have gotten calls from four different companies threatening to serve me with papers for these pending court cases.  I've told the last three companies that they are in violation of FDCPA not only because they are threatening to serve me with papers (any debt collector MUST do what they threaten to do - whether it be serve you with papers or put a lien on property - they have to be able to do so or it's another lawsuit) BUT in violation because they obviously do not own the debt AND because there are no pending court cases for me in the county I live in because I can go into the counties court website and see that information.  Generally they stop calling.

I have also received MANY calls from these people; sometimes with a 000-000-0000 number and other times with the 888-323-5291 number.  I also have received the same messages as the rest of you, threatening to serve papers to my home or place of employment.  I recently retained an attorney who works exclusively for the Fair Debt Collection Practices Act (FDCPA).  If this is truly a 3rd party debt collector, you have a right to sue and the collector has to pay all legal fees, court costs, and up to $1,000 in statutory damages.  I actually retained this attorney for another debt collector (Mediation Litigation Group/ Omega Recovery Specialists Inc.) also attempting to collect on a 4 year old online payday loan, but they refused to disclose the original account number or charge off date.  There is no way to verify these debts unless you are sure that you actually incurred them.  My attorney advised me to ignore ALL of these calls and to treat them as if they were not a debt at all, because these companies have the burden of proof in court and oftentimes do not have the means to pursue legal action.  Also note that in most states, even if the debt is legitimate, it is a civil matter and they CANNOT and DO NOT have the authority to file criminal charges against you.  So please, do not give these people the time of day and certainly do not give them any money.

I have gotten calls two weeks in a row.  I have called them back.  They threaten to call my supervisor(which I called there bluff on), they are telling me someone is coming to serve me paper, and they have told me that they are filing for check fraud.  They say it is for a payday loan from 2008.  I have told them that if they send me the information that I would be happy to settle this.  They will not give me any information.  There is no way that I am paying these people without the documents.  I talked to Mrs. Roberts.

I have found information online from others that have the same problem.

Hello,

I have been getting the same calls and the same exact numbers 1-000-000-000. Yes, they even called my family member and told them that they were going to serve me papers.  The left me a message on my cell stating they were going to serve me at my home or place of work.

I spoke to a lady this morning, and she was very rude and tried to threaten me by saying I will just go with the officers when they come and when I told her she was not threatening me she said that I didn't know who I was dealing with.

When I called her back to tell her about herself,  I was placed on hold.  I called back and got a guy, and told him how rude she was and how she tried to threaten me. He said I owed $800.00.  I told him this was not true and the merchant was lying. I told him I had paid off this debt and had paperwork as well to back this up.

I am not sure if this lady heard that I had phoned back and complained, about 1 hour later she called my place  of employment about 5 times and just kept hanging up.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Ive recieved a call from 000-000-0000 several times in the last few months. When i dont answer they leave a message saying that they are Alan shaw, and that they need to serve me papers at my home or work place, and that i can call the plantiff at 888-323-5921. This is a scam!!!! My husband answered one time and was connected to a women who said we owe a couple of debts that we already paid off years ago! When my husband told her he has the paperwork to prove it and that she should no longer call here anymore, she told him he doesnt have to right to tell them not to call and then she hung up. He then called back and said he has every right to tell a scammer to stop calling and that if it continues he will contact the FBI. So we got no more calls for about 3 weeks, until today, with the same message from Alan Shaw saying he needs to serve us papers! Im sick of this! This is the 4th time someone has tried to scam us over the phone! ONe time at 4 in the morning a man that said he was from the FBI and sounded middle eastern told us we owed $800 and my husband was so tired he almost agreed, but luckily he asked them to send him proof that he owes the money, and asked the guy who he owed it to and the guy said it was confidential! wtf? So my husband refused every time they called us until we got a letter saying that these people were scammers! Be careful what you believe when someone calls you and says you owe money, ask for their name, address of company, company name, and name of the company they say you owe money to. If they cant provide any proof that u actually owe money and they are legitamatley collecting it for another company you owe, than hang up and report them to the FBI or local police.

Got a call from 1-000-000-0000 from an Alan Shaw saying he had papers to serve at home or business office and to call888-323-5921.     If this is the same Alan Shaw from California then he owes a lot of money for bad business dealings out there and fled to the New York area.  Be aware of doing anything or saying anything to him if you should call him back.  He owes over $30,000 in California.

Be careful, don't give him the time of day on Mars if he should ask for it.
