First of all no respectable Law Firm would use an automated message to call you. 2nd, when asking for the name and ID of the person you are talking to they refuse to give it to you. This is not a law firm, this is the bottom of the barrel scum collection agency using everything they can that is against the law to get you to pay a debt that might or not be yours. PLEASE BEWARE and you have the right to for them to send you information in writing that the debt is yours. DO NOT PAY anything over the phone.

I didn't say she could be arrested - per the FDCPA it is illegal to threaten people with arrest for failure to pay a debt.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

No it is not a collection company. I have never had a PayDay loan, have had the same checking for ever. My aunty works at a collection agency, and they are not allowed to threaten you. They cannot say that if you do not call back they will make your personal and identifiable information public. Real collection agencies are required to tell you that they are calling about a personal business matter, and they must tell you that it is an attempt to collect a debt and any information they gather is to be used for that purpose. Nice try though (-.-)

My daughter received the same call, and she is sixteen and doesn't even have a checking account. I spoke with their legal department, and they stated they were calling for someone else. I told them they had the wrong number, and they said they would remove it from their records. I don't know if this will happen again or not, but it scared my daughter.

Read through all of these post, you will see that these people cannot arrest you, nor can they file charges against you.  the next time you speak with them ask them to send you something in writing.  They will avoid this because they know what they are doing is illegal.

I received a call from this number too.
I looked it up on the internet and the following was the page I got. Looks like a scam up to me. I have forwarded the number to the authorities to file a complaint. I am waiting to hear back from them.

I have gotten the same messages almost every other day for 2 months.  I'm tired of hearing his voice, same voice with different names.  The other day I returned his call, and found a fast talking man who did not want me to say anything, I finially said I didn't want to hear from him again, since he knew who I told him to contact and hung up. Needless to say he continues to call from the same number using a different name everyday.

I have received several calls from this Daniel Slane or whatever, law office.  I must contact them or pay the consequences is how they word it.  They give me the number of 888-419-1426.  I have called back
several times and i get put on hold with music and then a lady comes on and says to leave a message.
Is this for real or why do they not return my calls when I left my number.   I don't want any legal trouble
here.  I don't know what to do???

Have received multiple, very aggressive calls from this number for months, stating the Law Office of Daniel Slane will be prosecuting a civil case against me.  They have my cell number but don't know or disclose my name, very unprofessional and their intimidation approach is not working.  I have no debt collection issues...  Will now proceed with a BBB complaint (check out Daniel Slane in the BBB web site they have multiple complaints)...

I'm sure their intentions are worthy but their approach is crude and annoying.  I have called back and asked them to remove my cell number from their call list and they agreed to do so but the calls continue.

Regards, Harassed

When calling back there are two choices - recorded or not recorded.  If you select you do not agree to be recorded, you are to disconnect.

Got the call this am for a John Kreugal. This has been going on for 2 years with this KJ - this is just the newest one. Same threatening to be prosecuted in criminal or civil court. When I called back, hitting 0 got me eventually after 2-3 minutes of music a chance to leave a voice mail. Wrong - I'm sick and tired of this junk - I called back and hit 1 for the legal dept. Woman answered after 2-3 minutes asking for my phone number. I asked her if she had caller ID - she said yes, but couldn't tell who the name was. Well, there ya go! I then asked who she was trying to contact. Guess what? JOHN KREUGAL!!!. I really told her off, I'm afraid, didn't cuss at her, but I didn't get hung up on like before by  a very snotty collections guy who told me I didn't have any reason to be upset. SERIOUSLY? About every six months, I get this same old thing and I'm tired of it. Change my number? Why should I have to? I understand falling on hard times, but don't fraudulently use someone else's number to get loans, credit cards, etc. and leave us with your MESS!

Issued a warrant?  A warrant for what?  There is no debtor's prison, so she cannot be arrested.

I just got a message from Daniel Slane who said the same thing about civil and criminal persecution. Said to call him right back and rather than include his name and phone number and a good bye it just ended.   Smells fishy to me.!! He talked so fast that I don't know if the name of the law office was right.  But close enough to what is said above.

It's not dumb; most people when receiving such a call will get upset - and that makes it difficult to think clearly.  If someone was going to sue you, they'd have sent dunning letters first (and calls), before proceeding to legal action.  You'd then actually receive a court summons (if you didn't respond to any of the dunning letters) and the court process server does NOT call ahead of time - he just shows up unannounced.  While I'm at it, please remember to NEVER pay any caller unless they mail a debt validation letter showing you owe a debt and that they have the legal right to collect said debt - this is your right under the FDCPA (Fair Debt Collection Practices Act).

It's not a bad idea to call.your local courts if you're still worried you may have a lawsuit against you.  The clerk of courts can tell you if your name is listed on the schedule anywhere.
