I was getting several calls from WestPoint Associates.  Threatening me to come to my Job and everything.  I got tired of it so I did some research.  There are statues of limitations and Consumer Law Firm helped me. I received numerous calls from 1-888-506-7255 which is west point associates and they stated that they were going to serve me at my job and they wanted me to be present. I asked the representative who was he serving and he didn't even know my name but it was for a pay day loan. I told him that was impossible because the state of North Carolina has a law against pay day loans. He hung up the phone on me at that point.

I too got a call from # 888-506-7255 a couple days ago from a lady named Rebecca Gomez. She actually called me grandma's cell phone and also left my father a voicemail. She then gave me this # to call to find out what this was regarding al she could tell me is that she is going to be serving me paperwork at my residence and if i'm not there then my employer. I then called this # the following day and I spoke to a gentleman named Jonathan and he said he worked for Westpoint associates and said that I had owed Allied Cash Advance from 2007 and they they want there money back. I have gone to one of those place around that time but I paid it back. It was only for $500. Jonathan stated I owed them almost $2000. Well the following day I recieved a message from Rebecca Gomez saying that she will be paying me a visit at my job. She never showed up.

serve me papers I have to sign if I can't be reached they will come to my employment..what's funny is he
has other people to serve in my apartment building as well......n I think they called me again I haven't check
yet but I wont be surprised...It seems to me they call around tax season...

They left  messages on my husband phone  for me!  telling him to make sure I was at home  at a time they choose  an to have avalid Ide  an  for me to sign some legal paper they said.,  well, they never  showed up!  I called this number  they left  an at first it had been disconnected  then I called again an this lady on a machine  stated to leave my account number  an said, the business was something mayflower?  So by then I'm totally confussed.
   I call again an get this guy., I gave him my name an he asked me to spell it  so I did  an he stated He didn't  have anything by that name., then he asked if I used another name!  Thats when red flags went up! SCAM!  I told him  You People are scam artist!  I'm calling the State Police & the BBB &  the Fedural Creadit Buruer!     an I did!  They never showed up at my home nor my place of employement  an they never once told me   what this was about!
      If I hear or  if they do come around   I'm going to tell them to make me copy's of these so called legal papers., an  there business card  an I'll be happy to give it to my Atterney!    they want  your bank account number so they can withdraw funds out fast or your creadit cards.,  Scam!    an there  number was different but they stated with 888-755-4537    a David Parker  an some other guy answered!
      First of all.,  never give your ide  to any one that comes to your door  wanting you to sign something an you have  No Idea what they want!  plus   they want your Ide number twooo!   Fraud

They called my Husbands  cell   looking for me.,  asking for me in my previouse last name and in my present last name!  stateing  I needed to be at my residance between   3:00 an 3:30 p.m on Tuesday  to serve me papers to  appier in court!  an for me to have proper identification on me., an if I was there they'd go to my last known Employer!   they gave a case number., I called the #  back an  got  the name of the Company this WEST POINT ASSOCIATES  at  this 1-888-755-4537     this guys name was David Parker......    My husband said, he'll  be here sighting in one of his assualt riffles with his red bone c*** hound on the loose!    02/16/2013    They too  called from a restricted number  an the man identified himself  as a carrier...   I looked up The name of this Company on google  an found this page!  I guess, I've been scamed!

The company buys old payday loans and debt and attempts to collect by fraudently threatening people legal action. First, if you talk to someone do not confirm or give them any information.  Request that all information be forward to you via the mail.  Second, all phone calls need to cease and desist immediately.  Third, Westpoint Associates address is listed on line.  Write the company a validation letter and request verification of the debt that bears your signature.  Last, request verification of the company's license to collect in your state or just proof of license to collect.  Finall, if they threaten to go to court, go but make sure that you have mailed a letter requesting them to verify the debt and documentation the bears your signature, and your request of their license to collect. Hopes this helps.  Sign it's time to stop this company scam

This company has called me as well, and repeatedly stated they would be out to serve legal documents. They have never showed up. However if they are stating they are going to serve you at your place of employment, it is against the law for them to do so.

I received a call the other day from a Johnathan Harper (indepenant legal carrier) and was going to serve me something and needed a signature by a certain date needing some reciept,  if I had any questions to contact 888-506-8367.  First off, no server is going to tell you they are coming to serve you..... I then called spoke with a Paul Archer at ext 112 who was going to make payment arrangements to pay this loan off from Check n Go.  He referenced my last four of my social, gave me my balance and told me they bought the asset from them.  I already knew if was false, since the "independent" carrier violated the FDCPA Guidlelines with his message as well as the 1991 Telephone Act.....which then brought me to them calling from various numbers, these are all that I have for now.

If it was an online payday loan, almost none of them are certified, in fact less than 10% are.  They have no legal recourse.  That is why they sell off the debt to debt collectors that harass you for forever over it.  If you had 4 years in, you should wait the 3 till it rolls off your credit.

I did receive the call from a blocked number and they left me a message with my case number.
When I called the 800 # it was a company called westpoint associates they told me that I have to pay an online payday loan. I got that loan like 4 yrs ago and I never paid them back .
Now I'm going to have to do it, they are very helpul. I made payments arrangements plus they sent me all the docs to my email in case that this would be scam or fraud.

100% correct. NEVER argue with a debt collector. Once you have the company name & address - get off the phone! You are guaranteed to say something you will regret. They record all calls, so just follow the advice in above posting.

12X6 is right. Debts are civil and not criminal matters and they cannot sue you for a debt which is beyond the SOL (they are supposed to tell you this, but don't---just ask Asset Acceptance, who was sued by the FTC for this very issue).

Stay OFF the phone, send them a letter VIA certified mail with return receipt requested informing them you are aware that the SOL has expired on this debt, you do NOT owe it and they are to cease calling.

Michelle...sweetheart check the SOL law in your state most states is 6 years if the SOL has passed you dont have to pay him a dime and he cant sue you...VERY IMPORTANT dont send him any money or dont say you reconize the debt because the the SOL clock starts all over again...also there is 12 states where PDL is illegal  they will not take you to court because the judge will fine them thousands of dollars for not having a license to loan money..the collection company also needs a license to collect money from your state,so check that out to..YOU WILL NOT BE ARRESTED FOR A CIVIL MATTER its a scare tactic that these low lifes you use

I received a call yesterday from an Elliot Walker saying there were some papers he needed to deliver for my signature. He called from a blocked number but left me  this 888-583-6246 number to call. They also called my 16 year olds cell,, bizzare! I called the number and a William Wayneright answered, didnt answer with a business name, just with his name. Told me that a sheriff would be at my door tomorrow and I need to make payment arrangements with him right now to stop the process. If I settled now my debt would be $1478 if I went to court it would be $3520. He never gave me a case number, and said he was a rep for West Point Associates in New York. When I asked to have a direct number for West Point, instead of his 888 number he said that that is the only number he is aware of them having. I looked up the website and got a few more number 855-771-0350, 877-339-1119. The entire thing is weird, he, William, said he is my case worker, but didnt know my case #. I do know I had a payday loan from 2003 that I defaulted on, (running away and hiding from an abusive husband), but giving all my bank info to someone is kind of scary, but so is going to jail. I looked up West Point, the BBB gives them an F rating. What should I do, should I wait to be served and risk going to jail and take a  $3520 hit??? I am  a single mother of 4 working for $11 an hour, I cant afford to be scammed but I cant afford to go to jail or wage garnishment

Your story makes no sense because only a judge can order a judgement and you would have had to get a summons to appear in court.

Folks, this may be the you-owe-debt extortion scam. Obviously if you have no debt, you know this is a scam but if you do owe debt, this is how you can tell a legit collection call from a scam. The first thing that should happen is a legit collector/lawyer contacts you by phone or mail and this *INITIAL CONTACT* is considered a special event by the Fair Debt Collection Practices Act http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf . Section 809 of the FDCPA *REQUIRES* the collector to tell you at initial contact (first phone call, first letter, etc.), or send you paperwork within 5 days of initial contact, 5 items. If you don't get them orally or in writing at initial contact (you do not have to ask for them, collectors are legally obligated to provide them), treat the collector like you would a SCAMMER. The 5 items are:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days, (get a mailing address from your collector)
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it is illegal.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.

I got calls I didnt think they were legit so I looked them up with the bbb you know the better business people well the requested info from the company a while back and the company has not tryed once to validate anything multiple attempts to get simple back ground info from them and no response at alllike they dont exist at all and the bbb has the older number on file if anyone should know something its the federal run bbb so what does that tell u im starting my own letigation against that westpoint company harasment for false reason is a serious crime so pay me

I have recieved a few voicemails from this number saying they would be at my job or resident to serve papers pretty worried about ad for I work at a childcare center. But I didnt return there calls either. I informed my job that someone is expected to serve me papers . Guess I will see tomorrow cause they are suppose to serve them then. Not to worried about just thought it seemed silly
