Your lawyer should have also told you that debt is civil, not criminal, so even if you had defaulted on a loan, they *can't* arrest you.

For at least the last year, an illegal group of debt collectors have been terrorizing consumers, their family, friends, and employees threatening to arrest the individual of an unpaid loan or other debt (their generally don't even owe). Be aware debt is a civil matter, not a criminal matter, and you can't be arrested. The threaten a warrant if the victim does not pay a sum of money by the credit card over the phone.

Although when pressed the callers give the victim an address in Columbia South Carolina (usually a vacant lot). They are actually out of the Charlotte North Carolina area. The scammers are using the following business names

Reynolds, Hill, and Associates
Berkley and Associates
Kaufmann and Associates
Sanderson Blaine & Associates
McKenzie Reid Associates
Kennedy, Kline, & Associates

Here is a set of links to a variety of threads on this forum that document this group and its behavior. They include the experiences of victims as well as a former employee or two that quit within a week of finding out exactly what was going on. They also include responses from consumer advocates and people who are really criminal justice professionals advising victims of what to do

Message left stating they were trying to contact a defendant regarding a case number. When I called back to state they were calling the wrong number (person's name is an unknown), got a voice mail. Left them my # and ordered them to stop calling me or I'd pursue legal action. (In my state it's illegal to robot-call, or call after you've been told not to call. Naturally, I recorded the call and stated I was recording the call.)

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I told her I'm not paying a dam thing and she said she would not waste her time emailing if I don't pay and that she would out it down as a refusal to pay and I f*** me ! She hung up and I called her back 10times and would hang up on me. How is this legit???

I got a nasty call this morning from "an investigator". I replied asking what agency he worked for, to which he answered, "state agency".  LOL!  I figured it was a scam so told him to take me off the calling log and hung up.  The man had the nerve to call me right back and yell at me saying if I didn't cooperate he would be at my door in the next few minutes.  Of course, I lol and said, "really? That's awesome, why don't you do that" and then hung up.  I was so mad that he dared to call me back that I started calling the 888 number.  First woman who answered said the name of the company so fast I didn't understand.  When I asked her to repeat it, she wouldn't.  I called the number over 15 times.  No one would tell me the name of the company.  I then told the last person, that they messed with the wrong lady on the wrong day! Hahaha.  I called so many times, they were pissed! Then I googled the number and all of your comments confirmed they were some lame company using scare tactics.  So, I called the number one last time, and the same woman answered...I said, "Hahaha, you work for a stupid collection agency, sucks for you!" That made my day! lol

This number called me today. I answered and got a recording asking if I knew the name to stay on the line to talk to and investigator. I hung up, called back and a rude woman with an older sounding southern accent answered and I asked what this was. She says a company that deals with check fraud, bail, and warrants. I said ok not fore then. She then ask if I know a certain name. I did. Then she says is this you? I said no and she hung up on me. I then called the person she was asking for and gave them the number so they could check it out. They called the number back and was told that it was for an unpaid payday loan. My friend told them that they never have ever had a payday loan and the person on the other end hung up on them. Clearly after reading all these post and other on other sites is all a shady scam! Do they really think we are all stupid enough to believe them when they call!

I too received a phone call from these people today. I called them back and this woman answers the phone "investigations" then puts me on hold, finally gets back on the phone and tells me I committed some sort of bank fraud. I say oh yeah - she says we are going to arrest you Los I tell her what she is doing is illegal and according to the law any debt collector needs to send a letter first -- she is yelling some gibberish at me so I say give me ur name and address and I will have my attorney call you -- of course she hung up. What is going on with all theses scumbag scammers are they coming out now that it is spring??!! They can all go back under the rock they were hibernating under
