Jean,  Thanks for your input and expertise in dealing with these scam companies.  I almost called them back before I decided to research the number online and found this website.  Thank you for exposing them.  However, are there any legitimate companies out there that can help us with trying to refinance and get mortagage payments down?  My wife has been out of work for 2 years and we are struggling to scrape by.  We have reduced as much as we can on bills and cut back tremendously.  I want to try and reduce the mortgage, but we are upside down and our bank (Chase) won't help us or work with us.  And we refuse to get behind on our mortagage to get people to help us.  We have drained our retirement to make sure we have kept up on bills and continue to make our mortgage payments.  Any help would be appreciated.

These buffoons continue to call me about a loan modification when I haven't had any type of loan in almost 20 years. I have reported them to the DO Not Call Registry twice in the past, but that apparently is as useless as most government programs. Now I just route their calls to other 800-xxx-xxxx type numbers that have annoyed me in the past.  I let them pester each other.

First of all....Let me say, "I  love James's idea!!!!     I  did call back and talked to Nicole.  I gave her an ear full.  She then hung up.  So, I called back and left another message.  I called several times and left several messages. The last time I called, the message said, "You can no longer reach 888-557-2903 from your area (Saint Augustine, Florida).  If you have the time, PLEASE give them a call from your area, and tell them the MAN in Saint Augustine said to give her a call!
THANKS!  .... Do you think she got the message?????

received a call from this number at 7:21PM this evening with a female automated voice (AMY) stating I contacted them about my loan modification (I DIDN'T) so to press "1" to speak to her but of course I didn't press one and wasn't given the option to be removed from their calling list which annoys me as I am on the Do Not Call Registry (which isn't working obviously)

Can anyone tell these scammers really irk me?  They called me today, again.    I hit "2" because I wanted to know if it was the same scammer (it is and was).  The first person I talked to at this phone number said "yes" when I asked her if the company was based out of Newport Beach, CA.   Then her "supervisor" "Ashley" (or whatever her name is) said it wasn't.  Guarantee you it is, and "Ashley" knows full well what she is doing.  "Ashey", Amy, or whatever name they use - stay away!!  Newport Beach, CA seems to be a popular location for these scams and I'm not sure why, but ...

THIS IS WHAT THE CA AG'S OFFICE SAYS.   IT IS GREAT!
               5 Tips to Avoid Being Scammed
1.   DON'T pay up-front fees. Foreclosure consultants are prohibited by law from collecting money before services are performed.  (I can tell you that this is true in Florida too - it is illegal for mortgage modification "experts" to charge up front fees.)

2.  DON'T ignore letters from your lender or loan servicer.  (I just would add to make sure the letter is really from your lender or loan servicer.)  Responding to those letters is your best bet for saving your house.

3.  DON'T transfer title or sell your house to a "foreclosure rescuer." Beware! This is a scam to convince homeowners they can stay in the home as renters and buy their home back later. It might also be part of a fraudulent bankruptcy filing. Either way, a scammer can then evict the victim and take the home.

4.  DON'T pay your mortgage payments to anyone other than your lender or loan servicer. Mortgage consultants often keep the money for themselves.

5.  NEVER sign any documents without reading them first. Many homeowners think that they are signing documents for a loan modification or for a new loan to pay off the mortgage they are behind on. Later, they discover that they actually transferred ownership of their home to someone who is now trying to evict them.

Most of these companies seem to be out of Newport Beach, CA.   The names change, because the CA AG's office shuts them down, and they only reopen under a different name.

It is illegal in both CA and FL for loan modification companies to charge up front fees.  Period.  These companies try to circumvent that by claiming they only are "loan mod document providers" or some such bull.   You can obtain information on HAMP (the government loan mod) for FREE.  

It is important to know that some people do qualify for HAMP and have obtained loan mods.   Some attorneys who are representing homeowners in a mortgage foreclosure lawsuit will help guide homeowner in mortgage mod.  I have only extremely rarely, and only as a courtesy.  

The important thing to remember is that (1) all online information is NOT accurate and (2) you should not have to pay for help with a loan mod.   Some people DO qualify for HAMP and some loans are modified - unfortunately, it is not often enough.  If you are in a trial mod period (3 month period) if you quit paying the trial payment, you most certainly will not get the loan mod,.  Also, after the 3 month period, the servicers (usually) will then re-evaluate to see if your finances have changed and review the net present value of your home to further determine eligibility.  But once the 3 month trial period is over, you need to continue paying the agreed on monthly payment or you will be kicked out.   I can't say that the banks are always straightforward about this, but don't assume that you won't get a mod.  

And don't take any of this as legal advice - it is not intended to be.  It is intended to be cautionary and general only.  Tampa Realtor was right, and everyone who has posted here -- these "loan mod companies" who call are out to exploit and NOT to help.

Tampa Realtor is RIGHT.    Not only would I suggest running from these companies but if you have the time and inclination ask their names, and report them to the California Attorney General's office (most are out of CA), please do so.   These companies exploit the vulnerable.  How sleazy is that?

Even if you are using a foreclosure defense attorney, be very careful who you choose.  This has become big business in itself, even where it is legitimate, and we have seen personal injury attorneys become "foreclosure experts" overnight.  Ask the attorney's experience in real property and foreclosure law.
Check with the bar to see if they are in fact licensed.

It isn't laughable, unfortunately, because these companies waste taxpayer money because AGs have to chase and shut them down, and they scam vulnerable people.  They are elusive because they keep popping up by different names, same scam.  Interestingly, same base location.  

This is about as sleazy as it gets.

This company has called us repeatedly - because, I suspect, we refinanced to shorten our loan period and pay down our mortgage.  My spouse and I are both attorneys, who ironically do property and foreclosure law.   Loan modification companies that charge up front fees violate CA law.   They also are violating Florida law, if they are charging up front fees for loan modification.  I am a Florida attorney and my spouse is both a Florida and California attorney.

I didn't even bother looking up the name of this particular company - it is a different name, same location and same scam.  These types of companies think they circumvent the law prohibiting loan mod companies from charging up front fees (the law in both CA and FL).  They claim they provide "loan mod documents" --  which are readily available for free.    The last time I got a call from Newport Beach (which is where these companies are located), I discovered they were charging up front fees and advertising attorney's referral service - I reported it to the CA Bar and CA AG's office.   As soon as these companies are shut down, they open up with a different name.

Today I got a call from this number.  "Ashley" is a "supervisor" there, and I am pretty sure she was someone I had spoken with before, when the staff there claimed the company's name was something different.  I think she knew me from before, as well, since I had called her on it before. Sadly, I suspect some of the many new low wage workers they probably retain do not know they are working for a company that scams people.  

My guess is that as soon as these scammers are shut down by the CA AG's office they sprout up again with a different name.   These companies exploit people  and are bad bad news.  Some of the flyers I have seen (also from Newport Beach companies) advertise themselves as legal services!   Every one that has called here has been based in Newport Beach, California.

AVOID THESE COMPANIES.   THEY ARE BAD NEWS.

We got the same mortgage modification call  from "Amy" today. She alleged we had called her in the past. There has never been a mortgage on this house or property. I too contacted filed a complaint with the Do Not Call Registry. Everyone who gets one of these call and is on the do not call registry should call. It is only when they receive a sufficient volume of call they will take action against this company.

James and Just (page 1 comments) have great ideas for dealing with annoyance callers.  I just wish I'd've been able to check here before dealing with the answering machine message from "Amy" touting her loan modification "call back".

Regardless, my suggestion is to find out if you have the call block feature on your phones, since being in the DNC Registry clearly doesn't matter to this scam company.

AT&T's call block feature (*60) won't allow you to manually enter a toll free number, but if it was the last number that called you, hitting #01# will add it to your list.  Be sure to enable the blocking, since it doesn't automatically turn on just by adding numbers.

Just as with Nork, "Amy" is busy.  She just called and speed-babbled her loan modification blather into my answering machine.

Apparently whoever they are, they must think the DNC part of the Registry means you "Do Not Care" if telemarketers and scam artist companies call.

At least I found I have a call blocking feature available on my phone line, and can stop recalls from any last number that called (even though AT&T doesn't support entering toll free numbers manually into the feature).  Unfortunately AT&T only supports blocking up to 6 numbers, and my list's almost full so soon after discovering it.

So, folks, try *60 for call blocking (at least that's how to access it with AT&T phone service).  #01# then blocks the last number that called.  If star 60 doesn't get you into it, call your local carrier to see if / how to access call block service.  

And be sure to turn it on (it's off by default, even if you've entered numbers into the list).

Received call from "Amy" regarding my alleged contact with them about loan modification.  I never called them.  This is the second time I have received a call from this individual.  I called back and left a message to remove me from all lists, and that they are in violation of the National DNC Registry.  A lot of good that does!

For 800 pests I generate sticky labels with my computer that read "Safe Sex for Pay, Call 1-800-XXXX for details.  Then I stick a label on every payphone I encounter.  When I call that number 3 weeks to a month later I typically find that the number has been disconnected.  I'll bet they get whopping 800 charges that force them to abandon their number.  I have donbe this in downtown Brooklyn, Penn Station, Grand Central Station and other areas that have big concentrations of phone booths. I don't get mad, I get even!

I received a similar call but was home to answer it live.  I pressed "1" to "learn more".  When "Nicole" answered and asked if I had any mortgages, I asked "what is this business name?".  She replied "Help You Save" and said it had to do with government program to lower my mortgage.  I asked "is this a non-profit organization".  There was a long pause while I heard room noise.  I repeatedly asked "is anyone there, hello?"  Then the call ended.  So, I called her back and got the same "Nicole".  I asked "why did you hang up on me?".  I asked again if this was a non-profit, and she said "no".  I asked "then why can you call me - I'm on the do-not-call list".  She replied "it was a misdial" and hung up on me again.  So ... I hit redial again ;-)  Same girl answered and with no intro I said "you know it is very easy to report do-not-call violations" and she replied with annoyance at me and with sarcasm "oh really, well that's good to know.  I'm hanging up now ...".  I tried to interrupt her to say one more thing, but she hung up.  So ... I waited a few minutes ... then redial ;-).  Same girl.  I continued "... and since this is a toll-free call, I can keep calling you and it isn't costing me anything."  I intend to call her many more times ... ;-)
