Telephone Collection Scam Related to Delinquent Payday Loans

12/01/2010?The IC3 receives a high volume of complaints from victims of payday loan telephone collection scams. In these scams, a caller claims that the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check cashing services.

One of the most insidious aspects of this scam is that the callers have accurate information about the victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and names and telephone numbers of relatives and friends. The method by which the fraudsters obtained the personal information is unclear, but victims often relay that they had completed online applications for other loans or credit cards before the calls began.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide to the victims any details of the alleged payday loans and become abusive when questioned. The callers threaten victims with legal actions, arrests, and in some cases physical violence if they refuse to pay. In many cases, the callers even resort to harassment of the victim?s relatives, friends, and employers.

Some fraudsters instruct victims to fax a statement agreeing to pay a certain dollar amount, on a specific date, via prepaid visa card. The statement further declares that the victim would never dispute the debt.

These telephone calls are an attempt to obtain payment by instilling fear in the victims. Do not follow the instructions of the caller.

If you receive telephone calls such as these, you should:

§                                         Contact your banking institutions;

§                                         Contact the three major credit bureaus and request an alert be put on your file;

§                                         Contact your local law enforcement agencies if you feel you are in immediate danger;

§                                         File a complaint at www.IC3.gov.

My husband received a very stupid disturbing message from a Mark Hamilton (seriously) that bothered him about his wife being investigated for fraud and some other stuff. First of all, the Federal Agency won't waste their time calling me if you are under investigation. They will send you a  letter and will be advised to respond to it. No one ends up in jail for debt. And please do not be alarmed or scared because the company they represent is not listed with the Better Business Bureau nor they represent the Federal Agency. Ignore their calls or better yet change your number. It's about time these scum bags be exposed. They are con artist, posting us federal agents...out to take you to the cleaners.Beware!!!!!

Received a call from a Mr. Peter Richardson on 1-3-12 stating that he works for this company. I immediately asked him to send me some paper work on the account, but he responded by saying that he will send it once I make the proper arrangements. I told Mr. Richardson that I need to see it in writing first, and he said that he was sending it over now but I never received anything. I spoke with someone at the Federal Trade Commission and they told me that this company has broken into the database system and stolen information. I Don't Think So!!!

Exactly what happened to me...investigator Dan Adams at this number called re "bad check" that I wrote.  in reality was a payday loan that someone obtained with my information as I was a victim of ID theft...they try to sound like a federal agency and their facade quickly deteriorates when you challenge them.  they are in violation of many federal collection laws.  also, non payment of a payday loan is not considered fraud as it is known that there are no funds in your account at the time that the transaction occurs.  it is a civil action at best and can't be taken by these clowns as they aren't the wronged party, only a collection agency that has purchased bad debt.

This company called my ex husband and left a voice mail saying I was wanted for check fraud and I listed him as a son.  They called his cell phone, which I don't even know the number or even where he lives now.  I happened to be at my parents visiting and talked to him and he was all smug about it.  So I got online and researched this number....I WAS worried but now I doubt it is even legit.

I got a unkown call today and the man left me a message stating that me or my lawyer needs to call him back cause I owe a payday loan of 917.21. I paid back that original loan amount and I have never recieved anything from that payday loan co about owing them anything!!!  So today I get threatened by Peter Reynolds saying they are gonna supena me to appear in court, that I need to get a debit card today and call him back with it and they can stop the court process. Everytime I would ask a question he would talk over me like I was some idot. This is awful for them to do such a thing as to tell you are going to court over this crap.

I have received multiple calls from an Investigator Hodge stating that I am being pursued for check fraud. She is saying that I took out a payday loan for 900.00 a few years back and that I never paid it back. I did take out an online payday loan 3 years ago, and I paid it back. SO her claim is false. My aunt received a phone call from this same person a few days ago. SHe told my aunt that I was wanted for forgery and that if I did not take care of this matter that files would be charged against me in the county I reside in. I already figured that this was a scam, but I started researching anyway, and have found that it is in fact a scam. Do not believe what these people tell you. Threaten them with a lawyer.

Called my sister again today...said they were sending over a warrant for my arrest this morning...but thought they said that a few days ago? He proceeded to give my sister information on the case they had against me...asked her if I am known for doing this sort of thing, check fraud. Then he asked her where I was and when was the last time she saw me. She asked what county this warrant was being issued and through what court, he told her a county I don't live in and then put her on hold to see if the warrant was already issued. He got back on the line and said it wasn't sent out yet, and told her to have me call by end of business day to avoid a warrant being issued. Like I mentioned before, he told her this a few days ago?????????
