It is a violation of the FDCPA to threaten you with arrest.  Debt is a civil matter, not criminal - so NO ONE is going to be arrested.  Bottom line - if a caller refuses to MAIL you (not email or fax) a debt validation letter (per the FDCPA) proving you owe them a debt and that they are licensed to collect in your state - they are scammers.

Report the callers to the FTC, the FBI and your state's Attorney General.  Every time they call you back, tell them you are recording all calls they make to you to forward to your attorney for multiple violations of the FDCPA.

Debt Collector
This past weekend, I received a phone call from a number that was blocked. I allowed the phone call to go to voicemail. Later that day, I listened to the voicemail, and it a man who identified himself as Jerry Moore and he said he was forwarding a complaint obtained by his office. He said he was he advising me in order stop a pending action I must call this number with a case number.  Out of curiosity, I was getting ready to call this number when Jerry Moore called me again. I asked him who he was. He claimed he was a processor and I was being sued. He asked me if I was going to be home at 4 pm the next day. I never knew a processor who gave you an exact time they will be serving you. LOL I did not answer him nor did I not completely identify myself with him. I was never served the following day.

After speaking with Jerry, I called this number. First, I spoke to a man who identified himself as "Gage." When I asked him for his last name, he refused. I asked for a validation of debt and explain to him I know my rights under the Fair Debt Collection Act. "Gage" soon became abusive and I immediately put him on speaker phone so others in my household may hear. He told me not paying a debt is a criminal defense and he threatened to garnish my wages, take my vehicle, and seize my bank account. Gage also called me a loser in so many words for not paying my bills. I asked him was that a threat. He said if I am recording the conversation without his knowledge, that is another legal matter I must held in account, but then he continues I should rewind the conversation to hear what he was saying. I told him the conversation was not be recorded but was being listened in by others. I advised him what he was doing was illegal and soon was I transferred to another person. That person identified himself as a Thomas Garcia.

As with Gage, I told Thomas I had no idea what debt he is speaking of. I asked for validation of the debt several times and the only answer I got out of him was I can get validation by checking my credit report at websites such as creditreport.com. Also, he told me my wages will be garnished effective the 3rd but would not give me any month or year. I found that odd because none of the days in which I get paid in the near future do not fall on the 3rd of the month. As I did with Gage, I told Thomas I know my rights and what they are doing is illegal.  I did my research prior to calling such as the Fair Debt Collection Act and rights I have in my own state such as the statue of limitation. At one time, Thomas even asked me was I an attorney. I said no. Thomas told me I needed to get educated. In fact, as I am drilling him, all he could say is I am uneducated. I mentioned the threats I received from "Gage." I advised Thomas their practices are illegal and I said to him I was going to file a complaint with the FTC and my state's attorney general's office, Thomas told me to "go ahead." Soon, he hung up.

Finally, as a last note, I researched court records in my county and a surrounding county, I found NO lawsuits against me.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

These scammers keep calling my cell and home phones telling me to call a person's office, Jerry Moore,  about a debt collection.  He leaves a file number, when I called I told them I was not related to the peron they were trying to contact. The man became very rude and abussive and threating stating that his records shows that I was the next of kin for the person that they were suing.  I Sam for my number to be removed form call list, was told they would not remove it and for me tell a person he was being sued and papers would be served on me and him.  After telling them jaws reporting this to state attorney general's office, the man yelled and told me to go for it.  So I reported them for violating  my rights for do not call list, and threating me when there are no pending actions against me.  I intend to pursue legal action against these scammers as my family does have  attorney's in it. Do not let these people scam you into believing you owe them anthing. They are thieves and will try convince you to pay money you don't owe.

I receieved a call at my employer yesterday from this wanting to know the policies on how to serve me at work.  I was baffled because I was not aware I was in any kind of danger of being sued or anything.  I spoke w/ a guy who acted like they have done all this investigation on me and told me they have already try to serve me once at my home. Stated he even knew I had a large property, he had my name last 4 of my social, who my car loan was with and a few other things.  This had me terrifed as he said they were suing and were going to freeze/levy my bank account.  After much research and a nights lost of sleep I have figured this out....  A collection agency can get all that information very easily, name social and who you have have loans with its all on your credit reort. As for him saying the server told them I had a large property, any body can look up my address and know that I live on 2 acres. They can not freeze your accounts or levy them without a court judgement.  I checked the courts here, there is nothing against me.  As for serving me papers they did not show.  I will admit I do have an old debt that written off by the cc company about 5 years ago.  This company bought the debt recently and is harrassing me for it apparently.  Funny thing is the debt was only a couple of hundred dollard and they were asking for a near 2700.00 but I could settle for 1200.00.  DO NOT GIVE YOUR MONEY RIGHT AWAY TO THESE PEOPLE. They are scammers for a large amount of money.  Do your research first and dont lose sleep like I did.

Yes these people keep calling and leaving messages of threat that their is a claim filed against me and it was urgent and so forth. It is apparently a scam as it is a collection agency that has no authority. Calling them back or responding to them would be a mistake.
Their has to be a Law against such harrassment.

So this number has been calling me and harassing my family to get me to call them and when I do supposedly I have a active summons against me which is funny since I work in the legal field and have no knowledge of any issue I am having. When they told me that I needed to pay this or face the consequences I began to laugh and then they told me my husband( I have never been married) is also going to hear about this. I told them well when you find him tell him I want a divorce. After he began yelling at me saying that I was stupid and immature and I told him that is unethical of any legal professional to do he yelled some more saying how would you know and then I told him that I was a paralegal and in fact if he wants to get nasty I will have one of the attorneys that I work for see them in court since my firm is a very large firm based out of California he had the nerve to hang up on me! RUDE!
