i have been at work all day and my cell has rang 4 times in less then 4 hours from this number. give me a break. and they didnt leave a message on any of the calls. i dont answer my cell when im working or i would of told them to stop calling.

I received a call from this number...rang 3 times and hung up. Obviously, I called back to hear this man literally screaming about "F*****g customer service and what B******t it is.

He was asking about someone I don't even know!

He then hung up.
I called back a second time...the phone was "open", yet he waited for me to respond.

I explained he had the wrong party and he hung up again.

I called back a third time, he mumbled the name of his "company," it was difficult to hear as his TV was on and he is obviously working from home.

He addressed me again as this "other person."

My phone has the capability to record - and I utilized it.

He half heartedly apologized, stated that he would not call back - then...click.

The problem with this (as with almost all issues that people raise in these forums) is that the answer can depend upon particular facts and circumstances that we never know, and also on the jurisdictions involved.  While you may be correct in general, in some jurisdictions merely acknowledging an old debt may be enough.

I realize this is not a primary legal source, but it can be taken for what it's worth:

"WARNING! You can unintentionally reactivate the statute of limitations on an old debt by telling a debt collector that you agree to pay some money on the debt, even a very small amount like $5. When the statute of limitations is reactivated, it starts running all over again as though you just defaulted on the debt. Also, in some legal jurisdictions you can restart the statute of limitations on a very old debt simply by acknowledging that the debt is yours."

And while there is nothing in the poster's statement that indicated that they admitted they owed a debt that the caller was trying to collect, there is enough in there to make someone concerned that there might have been.  At least enough to make me think that erring on the side of caution is called for here.

Nevertheless, you are probably right, of course.  Let's hope so.

Not very likely Anonie. First, in most states you need to actually make a payment on a debt to restart the clock for SoL. Simply talking to a debt collector does nothing. Second, there was nothing in the poster's statement that indicated they had admitted they owed a debt that the caller was trying to collect. In fact, no debt was mentioned although it would be logical to assume that most people with poor credit have at least some old, unpaid debt that has been reported.  Of course, shady debt collectors may use the subterfuge of helping repair credit when they are really trying to collect on a zombie debt.

This is a lawyers office soliciting for cleaning up your credit. He said he was going to refer me to an attorney so they can work to get my score cleaned up. I asked how much, he said "good question". I told him I had no money, he said, "if it was free would you do it?"  I said yes. He said, "if I said it was $59.95 would you do it?" I said I don't have any money right now, he said "oh, anyone can come up with $60 if they wanted to. If someone was going to cut off your feet unless you came up with the money, you would come up with it." I said, "are you going to cut off my feet?" He said "I don't do that." I said, "do not be rude to me, if I had extra money I would do it, but I don't!" I told him to stop calling me, do not email me, or refer me to anyone!" He said I called him a name, and he hung up.
