Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

Received called from these A*****les. Threatening me with a civil case because of stealing. First of all I DO NOT STEEL FROM ANYONE. I am a christian and that Me or My attorney needed to call them back regarding a restraining order and to call them back and referenced to file no.AB09-2589. These is a scam I called the phone and rung one time and then gave me a busy signal. The general attorneys office, the FBI, the CIA and the police need to get these terrorists and jerks. They are trying to scare so you give them your information so they can ripped you off. Please be very careful. Join me to contacting the better business bureau, FBI, The attorneys office, your senator, Our President, FCC and the Federal Trade Commission. These are collection agencies or terrorist trying to get your money. Help me!!!! Let finis this people NOW!!!!

I received the same call with the same message as everyone else that I was a respondent in a civil suit with a restraining order.   They have called me twice with the exact same message.  I am not returning any phone calls.  I am glad I found this site.

i had the same call today and i called it back out of morbid curiosity. when the guy answered i asked what is the name of the company and where they are located. he sad yo mamma then hung up. so i called them back a bunch of times and gave it right back to them. they turned off the phones and sent everything to a full voicemail LOL!!!!

I also received message from this number. Called back with case # they left on message, and they claim my wife took out Payday Loan in 2005 for $300. They will settle for $500, and if not, they will send police officer with subpoena to her work, and take to court and collect $900. First of all, my wife didn't even live in USA in 2005. 2nd, she never even had social security number until 2009. But, the scary part is that they did have her correct address and social number! Although I know is a scam, how do we protect ourselves from unscrupulous companies like this getting our information? What can we do about this current scamming company?

Received two calls from this number on my cell phone at 11:22 AM and 9:18 PM.  A voice mail (which was a different verision of a recorded message each time) was left stating I was a respondent in a civil suit with a restraining order and my attorney must contact them within 24 hours.  The call was from Plainfield, NJ and I'm in Indiana.  I work with several attorneys and know this is nothing but a big SCAM.  This needs to stop!

As with everyone else on here, I, too, have been called (at my 87 year old Dad's house) where they threatened me with legal action, throwing me in jail, etc. Left a number and spoke too fast for a case number or docket number. When I finally did reach them, a man answered, asked him why he was calling my Dad. He asked me for the telephone number that was being called, I gave it to him. He then TOLD me my name, the last four of my SS number and my date of birth and told me that I had a debt with Chase for a credit card of over 10 years ago. Told him the last credit card I owned was in the late 80's, so it could not be. He said "why would I lie?" (Trust me, it took all of my self-control to keep from answering). I asked him to please stop calling my Dad that obviously they knew how to contact me, that I'd never received a letter or anything on this. He then said "that's your responsibility!" Yes, puzzled look was on my face -- Called my local Sheriff's office (as I live out in the County) and had already done massive amounts of google searches on this. They informed me that unless there was a physical altercation at my residence, or that I had a bill in which to fall back on that I needed to file a complaint with the Federal Trade Commission. Which I had already done because I saw where there had been several complaints filed against them already. So just file a complaint with the Federal Trade Commission, they have a "helper" link on their website which will walk you through the complaint process. The more complaints the better chances something will be done about this. As someone already said, HAD I have had a Chase Credit Card, and the individual stated that it was from 10 years ago, the statute of limitation has run it's course on collecting this debt, no matter who the debt is sold to, or handled by.

I got the same call. Reverse look-up only gave the Plainfield, NJ location. I called  the BBB in my city. She called the number for me and got a very rude person who would not give the name of her company or any information. SCAMERS

You made a couple of inaccurate statements.  First, each state has it's own statute of limitations on debt, it can vary from 3 to 10 years depending on which state's law applies to the individual case.  Second, as long as the statute of limitations in the state with legal jurisdiction for the debt has not been exceeded, you can be sued to collect on the debt.  While the vast majority of these calls are indeed bogus in some manner or another, make sure you know both the applicable laws in your state and your rights under the FDCPA.  When in doubt consult an attorney that specializes in this area of law.

Called and left a voicemail about a civil lawsuit and someone going to serve me. I heard the same BS from other voicemails. No one goes to jail or court for debt. Let's be real and look at America, were in debt.... Anyways if the statute limitations are over 5 years tell them to leave you alone or claim identity theft. Either way just don't respond, nothing is going to happen. I find this truly appauling.

Just received the same call on my cell phone, which isn't even in my name.  In fact the name that they gave was my maiden name and I have been married 11 years now.  It was a pre-recorded message and when I selected the option to speak to someone there mailbox was full and I was unable to leave a message.  This is ridiculous!  Something needs to be done about these harassing calls.

Same thing here. My mother is going on 80 and first called my so upset. After researching online, the 561-288-6368 number was a scam. I called back too, got that rude chick. Didn't give her a case number but told her I was reported her to FTC and she screamed at me and hung up. Then mom gets a call from the 908-315-5061 number, same message, "complaint against you, Civil Investigations Unit, case number XXX, respond in court or a restraint order will be issued, and you need and attorney". I file with the FTC, (easy) so I will add to it or file another one, and try to block these numbers. Horrible People! Need some jail time!

Just like the rest of you all here I got 2 different calls today from 2 different numbers first being ( 561 288 6364 company name Legal Repossions Group ) well me being the PI that I think I am research the name and number on computer. Of course there is no such company and the number out of Boca Raton FL. So I call and get this RUDE chick she hangs up on me when I would not give her my middle name ( On my birth paprs I do not have one) Guess I should blame my parents for that. Call back and mail box full hummmm I wait and call back a 3 time and get a guy who tells me I owe a cell phone bill of $800.00 for a company I have never had so I will not pay it. He tells me the I will see you in court. Ok by me come serve me then. 20 Min. later I get yet another call from ( 908 315 5061 company name Intergrated Network ) Guess who I spoke to the same rude chick from the first call. She ask me if I would be rude this time and I say no but how did you get from Boca Raton Fl. to Plainfield NJ that fast are you magic, or just a witch trying to cash in on other peoples money well of course all I hear after that is CLICK.........

Don't reply or call back these numbers. I was harassed by these people for about a year. The last call before this one. I told him I know it's a scam and fraud and reported the multiple numbers to the FBI. He then told me he knows were I live and he was going to come and rape me while I slept. I called local sheriffs which concluded that these calls were actually placed from over seas. If you ever get a call and the message says to call a different area code back then which the call was received that should through up a red flag. For more info you can go to FBI web site search payday loan frauds. The story there match the messages you have been getting.

Best to call the New Jersey State Attorney Generals office.
Give them the number they call you on . This scam uses
words like civil action, restraining order which does not make
sense. If you were really being sought, you would have a knock at your door with a warrent. They will get you on the
phone telling you ,you have a pay day loan out not paid and
it's as bad as a bad check charge. Belive me if you do, it's
only a bad debt. If you get these calls , call back and tell them
to F**K oFF and you know thier scam and you're joining the
class action law suit that's out there against thier company!!!
These are the scams debt collectors are using today. I'll get
a call from someone once in a while from some scumbag
trying to collect on a 17 year old debt that the SOL RAN OUT.

I got a phone call stating im being sued and there is a civil complaint against me.  I tried several times calling back and all I get is the mailbox is full.   so then I go to a website only to find out that this might me a scam.   I do not want these people calling me again !

the call, say you have 48 hours.. bla blah blah... then days later call again saying the same thing.. what happened to the 48 hour deadline..? oops! i guess they logically proved they are liars. w00t!!! anywho, listen people- there are only two types of debt: secured and unsecured. secured debt means collateral was taken, so if you default, they take the collateral and thats that. Unsecured debt is issued with no collateral, and is dangerous to issue because if the lendee defaults, not much can be done. If someone asks you to pay a debt, just ask "where is the collateral" for this secured debt... THERE IS NONE IT IS BS!!! WAKE UP AMERICA UNCLE SAM IS THE BIGGEST DEBTOR IN HISTORY!

I keep getting these calls. They say that a civil complaint has been filed against me and that I or my attorney needs to call them within 24-48 hours. This is the 2nd call that I have received. Unless I am served papers in my state, they cannot do anything. I am thinking about contacting the attorney general about this. Gets old real quick and I am tired of being harassed when I have not done anything.

Statutory Limitations in most states are 5 years from begining of delinquency, they can't collect a debt after your state Limitations, you can tell  to stop calling and they will stop
