Hey these people use a system called too...they put in the person's social security number and it pulls up anyone affiliated with the person or anyone that has lived at an address that person used to live at or maybe you worked with that person or were a neighbor whatever they can get all kind of info...that's how they got your name and number trust me these people think they are slick

If you're an attorney than you know that 1. Writing bad checks maliciously is a felony. 2. PayDay Loan companies, if collected in house (1st party) doesn't abide by the FDCPA. 3. PayDay Loan companies do in fact file class action suits against debtors to recoup funds lost. FDCPA is only for 3rd party agencies. And legally, if a debt portfolio is bought and you happen to be a name in that pile of debt in that portfolio, the individual who bought it can legally sue you as if he was 1st party.

A guy named Craig Lombardo called me today using a 940-312-7334 number, claiming my husband owed a debt to a cash loan place. He claimed that if my husband did not come up with $1200 by 11:30 a felony warrant would be issued for his arrest. I just want to say jokes on you a**hole

I am an attorney in Grand Rapids, Michigan.  This guy called one of my clients trying to collect a bogus debt.  THIS IS A SCAM.  He is not an attorney.  He may work for a debt collection firm although I doubt it.  Do not give him any information.  Do not pay him any money.

In general, do not believe legal advice given by creditors or collection agencies, even if they call themselves lawyers. The information is usually wrong or incomplete, and is always self-serving.

First, I will answer your question assuming the person who contacted you works for a collection agency or law firm. Second, I will answer your question assuming the person who contacted you works for the original creditor -- the payday loan company.

Payday Loan Collected by a Collection Agency
The person you spoke to on the telephone said they were not covered by the Fair Debt Collection Practices Act (FDCPA). Let us take a look at who is covered by the FDCPA. Section 802(e) of the FDCPA reads, "It is the purpose of this title to eliminate abusive debt collection practices by debt collectors, to insure that those debt collectors who refrain from using abusive debt collection practices are not competitively disadvantaged, and to promote consistent State action to protect consumers against debt collection abuses."

As we see, the FDCPA covers the behavior of debt collectors, as the name of the act would imply.

Section 803(1) defines a debt collector. "The term 'debt collector' means any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which is the collection of any debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another."

Later in this section, Congress excluded employees of the creditor, which we will discuss later. But getting back to 803(1) the definition of a debt collector is broad and inclusive. If the person who called you was attempting to collect debt owed to another, then that person is a debt collector. There is no exclusion for law firms or payday loan organizations.

Therefore, if the person who called you works for someone other than the original creditor, they are subject to the FDCPA. If the caller harasses you or continues to misrepresent themselves or the law, you may have a cause of action against the creditor. ("Cause of action" is lawyer-speak meaning you have a darned good basis for a lawsuit.) Consult with an attorney in your state to discuss this possibility. To learn more about the FDCPA and your rights as a consumer, visit the FTC Fair Debt Collection Practices Act Web page.

Let us go a step further and assume you were speaking to an employee of a law firm. If the person you spoke to was calling on an attorney's behalf, then that person creates liability for that attorney if he or she violates any laws or rules of conduct. If the attorney told his or her employee to lie to you, then that attorney may be in violation of his or her state's professional responsibility rules.

If the attorney's state follows the ABA Model Rules of Professional Conduct, he or she may have violated Rule 8.4(c), which prohibits engaging in conduct involving dishonesty, fraud, deceit or misrepresentation. I would argue an attorney violates ABA Rule 8.4(c) when the caller stated that FDCPA does not apply to them.

Violating professional responsibility rules do not create a cause of action for you, but giving a detailed and factual report of a rules violation to an attorney's state bar usually creates an investigation, which may cause that attorney to modify his or her behavior.

The next time the person who is says he or she is calling from a law office, ask for the caller's full name, the name of the law firm, the state where he or she is licensed to practice law, and his or her bar number. You are free to report the attorney to his or her state bar association with the facts you gather.

Payday Loan Collected by the Original Creditor
Under the FDCPA section 803(6)(A) and (B), employees of the original creditor are exempt from its provisions unless they collect the debt under a different name. For example, if the original creditor is ABC, and ABC's collection division uses the name XYZ when attempting to collect ABC's debts, then XYZ must comply with the FDCPA.

Here, if the person who called you is an employee of the payday loan company, then if they said they were calling from some organization other than the payday loan company, then they are subject to the FDCPA.

However, if the caller was an employee of the payday loan company, and in the name of the payday loan company was collecting the debt, then they are not subject to the rules in the FDCPA.

I hope this clears up some of the misconceptions and lets everyone know exactly where they stand

People who bounce checks to payday loan companies can be prosecuted for bad checks. It is a criminal charge to knowingly bounce a check to any person or company. People think you can't get sued for payday loans, but they are mistaken. Companies take action all the time in the form of massive suits against debtors to recoup funds. Regardless of if you can't pay the balance or the interest rates are unreasonable. You signed the contract (and hopefully read it) therefore, you are legally bound to abide by it.

same thing happend to me but I had untill 2PM today and I live in Washington not Texas.... and I know that anyone who is trying to collect debt from you will take you to court first not call and say pay us or your goin to jail..... I told him to take me to jail and he said he would get everything set up for me to turn myself in then hung up the phone I called the company he said I owed money to and they dont have record of me ever bein with them and then i called my court house and nothing with them as well I then called craig back and asked him why is he goin to court for my case when i live in washington and he said this is were the payday loan took place and I said i have never been in texas in my life he then got upset and said that you think your so smart....... I told him I had spoke to my sherif dep and they ran a check on me and guess what I was all clear imagine that....... after that well Mr craig hung up the phone.........Well you know what craig F*** You looks like you didnt get paid today............ I hope someone gets your sorry a**!

this guy said he was an attorney and that felony charges were being filed by 3pm today that i would be arrested before days end, that i had check over 1k out standing that i had defrauded the bank in question, i asked him why if he represented the bank why was he calling me because that would be a breach of contract with the ones he worked for he became threatening and called me names, i hung up an called the bank he said i owed money to and they have no records of anything of the sort, DO NOT GIVE YOUR PERSONAL INFORMATION OUT OVER THE PHONE HANG UP AND LOOK UP THE PHONE NUMBER FOR THE OFFICIAL INSTITUTION  OR BUSINESS. i had similar call regarding an unpaid check, over $1000.00 i was called names after asking the man why if he was the attorney for the company suing me why he called me because that would fall under breach of contract for the company he was representing an he became intimidating. i hung up an called the bank he said i supposedly owed money to for a bad check, they say they had no record of any thing like that ... DON'T GIVE CALLERS PERSONAL INFORMATION HANG UP AN CALL THE COMPANY PERSONALLY DO NOT GIVE PERSONAL INFORMATION OUT IT'S EXTREMELY IMPORTANT .

I received a call from this group today saying I was listed as an emergency contact for someone by the name of Aaron Welton.  I do not know nor have ever known someone going by that name.  When I went to ask what this was about the caller just hung up.  The caller knew my first and last name and had my private cell phone number. I wondered if they were just going down some list trying to get someone to admit they knew someone going by that name.

This guy or group is just a bunch of scammers trying to find some schill don't fall for it!!

creg limbardo called me also but i did forget about a payday loan check from 2 years ago that i was gonna be prosicuted on as well this was valid and i found out he's a real attorney so dont be so quick to pass judgement. He got my bench warrant dismissed and allowed me to pay 1/2 now and gave me 2 weeks for the rest i was so thankful.

this man craig lombardo called me about a worthless check that i would be prosicuted on so i called states attorney office and they did have a claim against me .i called him back and he helped me get my case dismissed, so this is no scam people dont take it for granted this attorney helped me so much and im so thankful to him.

A person who identified himself as attorney Craig limardo or Lombardo from either Capitol or kapplan law firm, stated a warrent was being issued for me that day unless I paid a debt of approx 1100 dollars for a defaulted payday loan. Caller stated it is a felony and I would be charged with check fraud and would have a bond of 5500 in order to get out if jail. This person appears to be a debt collector that is tricking ppl into making payments but is lying about jail time and name of company he works for.

I received a call from this man, Gregg who was very threatening to me and my family.  He yelled and told whoever answered the phone that I was going to jail..  I have never even done a payday loan, nor did I have a bank account with the bank he was yelling at me about.  I called the police and they advised me not to pay him and to call the state attorneys office.  Definately a scam so be aware!!
