omg! i kept getting calls from this place and they told me that i owe money to US Bank, which was true and if i didnt pay a certain amout i would have to settle it in court. i was an idiot to believe it and sent them 1 of 4 payments which was over a hundred dollars.  i am such an idiot to believe this. i could have spent that money on other things. totally scammed.

My husband got a call from 214-810-3778 aslo from paul phelps claiming he was getting sued y state of utha saying they were gona send in to jail for 6 months for non payment of a bank account we only owed 700.00  so now this guy said  we have to pay two payments 450 so he wont get locked up and have to pay more in legal fees  when my husband asked if we can get a recipt or something in writing stating that was the agreement  he said he would give it to use when we made the first payment i feel like this is a scam if anyone knows anythingthat cold help me about this paul phelps law firm please let me know it would be greatly aprreciated

THey have been leaving the same messages for me on my home phone and then on my cell like a minute later, talking about owning property, dont own property and one of the properties then mention i have rented ofr the past 7 years.  I called them and left a message that the voicemail, phone number and message were being turned over to the police department (which i turned over tonight.) Rumor has it these guys are identity thives but cant confirm or deny it but better in this day and age to be better safe than sorry.  Oh and they regularly change their name on each voice mail

A lady called my job and left a message on my co workers office phone stating that I had 24 hours to call Paul Philips office or, she would be coming by my job and serving me papers.  I did hear a TV in the background of her message.  A few months ago it was a Micheal Stone I think.  But this is crazy and its a scam.  I do see that others have had the same stuiped crab.  So, what can we all do to put a stop to this scam.  Count me in.  I hope she does come by my job I would like to meet this stinky rat.

They can only sue if they can prove the debt (which most can't ) the proof of debt has been long lost in the sale from junk debt collector to another. The second factor in being able to sue a consumer is how long ago the original debt was charged off. Most states have a SOL on consumer debt accounts and litigation.
I'm surprised YOUR attorney did clarify those with you Mary??  That's pretty common knowledge for any attorney to pass along.
What these people can do is continue to pollute your credit. These junk debt collectors pass debt along to each other over & over. Everyone of them will tap into your credit to get info on contacting you and then report the debt as a new account. Your only recourse is to monitor your credit and each time a new debt is added you will have to dispute the old company if they don't show the account as closed & sold or you will have two accounts on your report for the same debt. Secondly, each time a new collector purchases your account you will have to dispute the acct opening date. The collector will have to verify the debt and the date will show the original charge off date. This might happen 10 years after its been charged off and shouldn't be reported after 7. So you can pay the debt off or be very vigilant in watching the accuracy of your credit and wait out the 7 years for it to drop off your credit.

I fear Mary has mislead many with her statements. Probably works for the company who's been calling you and wants to build that fear they make their living with. Always be smart and educate yourself on your rights as a consumer and start over by cleaning up your credit so you don't have to deal with junk scum debt collectors.

These people called my office 3 times in a short 1 minute period, my cell phone and another branch I work for. I have tried to contact them but only get voicemail and that was 3 hours ago. They left a message of course it was the same Mr. Phelps saying he wanted to speak to me regarding property and gave two address' in reference. I have never owned a home these were rentals so yes they are combing your credit reports. I haven't found enough info yet to determine if they are scammers but from what I have researched so far I think it's possilble. I've found information that they are using unfair credit acts and possibly using another attorney's name to represent themselves. My issue with these types of people are that I don't know if they are legal or scammers just trying to get my money. Unfortunatly I have old debt over 6 years old that I do owe a couple of creditors for but how do you know who you can trust? Here is my advice to anyone dealing with these types of collectors. Check the website for your State's attorney general. In Texas any debt that is 4 years old is beyond statue of limitations and no debt collector can file a law suit against you after that time period. Check your State and know your rights. If a law suit is filed it has to be in the county you live in. Don't ignore any papers served to you. Have an attorney or go to your courthouse and discuss them with your County Clerks office. Also read over the Federal Trade commissions website to learn more about your rights.

I just had my attorney follow up with this firm and he reviewed this website and here's what he says...
1.  a lot of the people on here are obviously disgruntled
2. as long as you know its your debt, you owe it.  doesn't matter who owns it, the original creditor or a debt buyer, they can both sue you equally and many times use the same law firms
3.  make sure they can verify your entire social security # and the original account #
4.  you can't go to jail for bad debt unless its regarding an over drafted checking account and most likely still won't go to jail
5. their tactics are not the best but as my attorney said to me, "you owe it, and they will sue you.  so if they are in the position to offer you a way out, take it"

Oh, and, if there is no money in your bank account, the bank will not allow an overdraft by levy because that would mean they paid your debt for you, banks aren't that nice ;) . So if you choose to keep your account opened leave a minimal balance to maintain it and conduct your affairs in cash, should they obtain a judgement it is very harmful to your credit and will be there for 7-10 years, thus the damage is done! don't let them take your $ too! After that you can probably swing a decent settlement if there is any danger of them attacking your tax return which can usually only take place by them sending you a 1099 and if you actually submit it as income...I wouldn't. Most attorneys for these matters will cost you less stress and $ in the long run, keep a file of the messages and FDCPA violations, they cannot disclose to anyone, even your answering machine your information... "this call is for ______, if you are not ______, please hang up or disconnect, there will now be a 3 second pause to allow you to do so, ...this is "collector", calling with "company", please call us back at184848...that is the LAW! if that is not the message you received, you need to sue them!

btw, I have yet to be issued my "summons" I think my dogs have scared them off, otherwise they picked the wrong old address off of my credit report. The collector I talked to was too busy stroking his ego to actually effectually conduct any business and reschedule delivery he started yelling at me for requesting information such as their address, and he hung up.

I got a call back from a testosterone raging jack*** collector, he said the debt was an over drafted bank account from two years ago. The thing is, I was overdrafted by $8.00 at the time and untill they racked up the $38 overdraft fee and charged me $8.00 a day, they didn't notify me till it was a $262.00 bill, now they want $1200+. The truth is it is over 4 years old, which is uncollectable in the state of California, yes these people will take you to court, hopefully you can be there! and best, get an attorney to handle it if you can, most of them are about $250 for this kind of case. These people are are violating many FDCPA laws such as 3rd party disclosure. They have called my husbands business and left very descriptive messages on what is clearly not a personal line as the message identifies the business and states the hours, each FDCPA violation is a thousand dollar fine. Make your complaints to the FTC, consumer affairs and BBB. These companies buy up old debt for pennies on the dollar and realistically would be making a profit if you offered them only 25% of the balance yet they will likely demand 50%. I worked in Mortgages and collections for 15 years, this company is way out of line but they are using the legal system to obtain their means, however illegally. For simple information on this sort of thing get the book "Debt cures they donT' want you to know about" it is a very good bit of solid information for people outside the collection industry.

I just got the same message. They referenced 2 old addresses and used my old name. Told me I had 4 hrs to call back.i called back and got a voicemail. I am curious as to if anybody else had been summoned and what the summons said. Was it for a valid debt you had? grrr I cannot afford to be a victim of this fraud if that is what it is. Evidently they made a few calls today!

@ CC did the summons say anything about what debt it was or how much?

To CC, thanks for that info cause I just received a summons to appear in court from these people and I was going to ignore it.  According to the court house as long as Brindle & Associates drops the law suite I don't have anything to worry about.  But I've heard of scams where these companies sue people and get judgements without the the consumer knowing until their money is zapped out of their account.  Hopefully I can call these guys and work something out other than going to court.

My husband was actually served similarly and his court date wasn't until 10/2013! yet they appeared in 2012 and had his bank account emptied, they hand delivered actual court documents but the date was was not the actual date of hearing and therefore they made sure he wouldn't be present and they could go ahead and scam him by abusing the legal system, I advise keeping your account empty till you resolve the issue or they will empty it for you!

These folks have clearly pulled information from my credit report as they have an old name, two associated addresses etc. They call leaving messages stating that I must call back within 4 hours which is amusing as I've been getting these calls for a couple of months now. they may actually take it to a court and seek a judgement, that's the scam, you won't know until your bank account is emptied via a judgement executed by the courts and these criminals will bleed you dry if you are not present in court, sad thing is they will make sure you aren't there to defend against it. Most often they call with an unidentified or restricted number and when you call back you are directed to voice mail.Brindle and Stone and Associates, Paul Phelps are the named attorneys, sadly they may actually be attorneys but they are still criminals.

I received a summons to appear in court at my job from these people regarding an old debt.  Is it legal to serve someone at their job?  They claim its because I never updated my address with the plaintiff.  Does that give them the right to embarrass me at work?

They just called me referencing some properties I used to own and a company I have no affiliation with and would not tell me what the call was regarding.  They mentioned a ref. no., but would not give me any further information.  They said they would file a lawsuit or something like that and I told them to do what they have to do and hung up on them.  They were very rude.  And did not answer my questions.

Just had the same call.  The girl talked so fast that I could barely understand her. Freaked me out, got the same voice mail as the others, said legal papers would be delivered tomorrow, said I had 4 hours to call back.  Asking for a name and an address that has been over 10 years!  How the hell do you get rid of these yahoos??  Of course got voice mail when I tried to call back

Funny my phone didn't even ring when they called, I just got a voicemail from them. No missed call or incoming call in my phone directory. So weird. It's like they have some kind of system that goes straight to people's voicemail and all they do is leave threatening legal messages on it. They told me the exact same thing as Akmumzy, looking for the legal residents or legal owners of my father's property. Kinda scary. Said, it was imperative that I or my attorney called them back. I called back and after about 6 rings, it went to their voicemail, I believe they said it was Brindle Associates or something like that. The office of Phelps & Someone else, can't remember. Idk, what to make of it. Some people on other threads said they're a scam or fraudulent company.

They left message looking for legal owner of two places that i have rented. Also asked for a name I havent used in over 8 yrs. stated had 24 hrs to respond. Went to voice mail when I called right back. Must be one of those firms that buy up old debt
