This man kept calling repeatedly asking for a Ava -something.  Barely understood what he was saying, asked for my social and name - which I obviously did not give.  I am not this person he's looking for, he's either a pushy debt collector or someone running a scam.  Left very threatening voicemails as well.  I just told him off this morning, let's see if it worked...

I just received a call on my cell phone from this number..the foreigner's voice could not be understood, a few words were half way understandable, like if i didn't return the call he could only wish me good luck as the situation unfolds, the phone kept cutting out on his end so i couldn't hear all that was said, but i know i was being threatened because this was the same person i got calls from before, and they won't tell you who they represent, just says legal action has been filed against my name and social security number.

Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are ?spoofed? numbers, so that the number appearing on a consumer?s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer?s social security number, home address, e-mail address, names of family members and the consumer?s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as ?We?re filing an affidavit against you? or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General?s Office was repeatedly called both on her cell phone and at work.  Despite the employee?s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an ?officer?.

?I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ?If that?s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming?,? stated the employee.

?It is important for consumers to know their rights under the law,? Attorney General Six said. ?If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.?

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer?s arrest, or using the threat of violence.

Ya same story.  They called saying they were a law firm and I owed money for a pay day loan. Alarms went off right away; first the guy claiming to be the company's lead attorney said I was being taken to Federal Court...when I asked what court the complaint was being filed in he said U.S. Federal Court...so I asked what district....he balked and said agian Federal...when I tried to inquire further, he explained Los Angles distritct...in responce I expliained oh your filing in the 9th circuit (knowing it is the fed court of appeals for the western states) and he said yes...at that point I said for an attorney you don't know much about the federal system...he quickly said I'd find out in the mail and not to contact him any further.

I was alarmed, however, at the amount of information they had on me before contacting me..SCARY.  I will be contacting the state Attorney General first thing on Monday.

Received a voicemail from this number today on my work phone.  They did not call for me, they were asking for someone else that I seem to get calls for all the time.

I don't think the guy who called me was Indian - he sounded Asian, with very broken English and a very thick accent.  All I could tell was that he was asking for a lawyer to call back soon as this was a time-sensitive matter.

It was the end that made me laugh, though.

"If I do not hear from your attorney, I can only wish you good luck as the situation unfolds on you."

I JUST got this call, I told him I thought he was scamming me bc no attorney would call asking for my attorney and that if he was indeed trying to sue me then he needed to contact me through the court system. At this point he started yelling at me and hung up in which my dad called back and they didnt even answer the phone with a saying representing their company, they just answered with "hey". My dad asked what the name of his attorneys office was and the guy hung up.......

I receIved a call at work today and was given a number to call after I got off, so I did and they said I owed money on an online cash advance loant hat I never paid back and when I told him I didnt have any loans he said the court documents were filed and would be sent to me. Then he said I could either paid $625 or see him in court in California. I told him he was crazy and he told me not to call him anymore. He spoke with a foreign accent. The scary part about the whole situation is how much of my information he had!

Ignore them.

You will need tocall your phone or cell company.  Get new phone numbers...  These scammers will not stop.  Besides might be out of the country...  Here is a little tid bit on this scam...

Just got a threating call from this number stating their legal attorney needed to speak with me and I was told to dial another number.  I refused and told the guy with a foreign accent that I know who I owe and whom I've done business with and their company is not one of them.  At that point the guy said well you are in a lot of trouble and I hung up.
