I have been dealing with these asshats for over a year now. Same time everyday I get a call. I had a lawyer that is a close personal friend get involved and was with them on one of the days that they called, I let my lawyer answer the phone. They attempted to threaten him that I would be arrested and he would be to sine he was helping me. He laughed and began to tell the woman that if they continued to harass me that he would be filing charges against them. They refused to give a name phone number or an address which proved even more that it was a scam. So he recored the number down as well as the call and asked me to make recording of every time that they call the the different business names that they use. One day they will slip up and they will be caught until then just going to have to deal with it. There is no sweat on my brow because I know that I have nothing wrong and my only debt is my mortgage.

i keep getting calls for a person named david gibson.  i have been receiving these calls for 4 years now!  each time it is from a different law firm or investigations firm.  this number is just the latest, however i told them not to call me again and i rec'd another call the next day! i called and demanded they not call me anymore.  had to leave it on a voice mail. i wish there was some way to stop these folks.  it stops for a while, then 3 or 4 months later i get another call for david gibson.  the caller always says they will not contact me again but i get a different caller about 3 - 6 months later.

Illegal scam.  I love these calls.  Typical "we are calling to let you know a process server will be by tomorrow and if I will be home or at my place of employment".  PROCESS SERVERS DO NOT CALL AHEAD OF TIME, They JUST SHOW UP!  I have fun with these bottom feeder scum bags. I ask him who is calling, he mumbles something to the effect of national process servers. I say "that is not a real company" he then mumbles bruce williams and associates or something to that effect.  I say "so which is it". He doesnt answer.  I then ask him to confirm they have my correct mailing address so I can be home or at my place of employment, he says "we cant give out that information".  I say to him "let me get this wrong, you can't give it, or you don't have it?" He is getting mad now.  I then say "you call to "inform" me that I will be served and you want to make sure I am home, but then you actually dont have MY ADDRESS and that is why you can not confirm it correct?  He says "no I have it" I say, "ok what is it?" he says a bunch of numbers like 1611.  (my address does not have a 16 in it nor an 11)  I say 1611 what- just 1611, he says thats all I have.  I say "good luck finding the address 1611, the United States is a pretty large country with no street address, city, state or zip code! He is getting really mad now. I said I just want to ensure that I am here  when you arrive and then I asked him how he takes his coffee so I can have a fresh pot ready.   I laughed and the moron got even more mad!  I said, simply CONFIRM my address for me, and while he was at it, please tell me the EXACT name of the company he is working for, the REAL address, the REAL phone number and the correct spelling of HIS name.  He hung up. Not a very professional scam, but I had my fun for the day.

Introduction
Even if you have never taken out a payday loan, simply by providing your personal information in an online application on a payday loan website will subject you to this scam. What happens is that your personal information - ALL OF IT - gets sold to third parties who may or may not have malicious intentions to make use of it. That is why these callers can be very convincing. Often the calls start with the caller asking if this is John Doe, DOB xx/xx/xxx and SS# xxx-xx-xxxx. If they have all this personal information, they must be legitimate, right? WRONG! Many of these third parties are overseas companies from whom you will never recover your money if you pay them. While there are legitimate debt collectors out there attempting to collect legitimate debts stemming from payday loans, I hope this guide can at least help you weed out potential scammers that want to do nothing more than separate you from your money. With that in mind here are the tips to spot a potential scam.

The caller threatens you with arrest if you don't pay.
One potential victim recounted that the caller told her a sheriff was ready to come to her house that same evening. Of course, that never happened. This may also be a false and/or misleading representation under the FDCPA. Specifically, 1692e(4) states the following to be a false and/or misleading representation: "The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action."

The caller fails to identify the name of his collection agency.
There is no legitimate reason for the caller to withhold the name of the collection agency he/she works for. Furthermore, even if he/she does name the collection agency, it may often be a fake name, or nothing more than letters. Ask what the letters in the agency's name stand for. Often you will not get an answer. If the caller does give the name of his collection agency, put the name in google and see what comes up. You will often see reports of others who have been victimized by the same company.

Did the caller state he was attempting to collect a debt?
Often these callers will violate so many provisions of the FDCPA that it becomes clear that you are being scammed. Sections 1692e(11) states the following to be a false and/or misleading representation: "The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector."

Did you get a validation notice in the mail?
Typically, this collection agency will fail to send a validation letter within 5 days of the initial phone call. The FDCPA requires that, within 5 days of the initial phone call, a debt collector must send a letter to the alleged debtor containing the amount of the debt, the creditor to whom it is owed, that you have a right to dispute the validity of this debt within 30 days of the notice or it will be presumed to be valid by the collector, and that if you do dispute it in writing, the debt collector will obtain verification of the debt. I have yet to see any victim of this scam receive this required letter.

Google the phone number
If you have caller ID, enter the phone number of the caller into google and see what comes up. Again, you will often find reports of other people who have received similar phone calls. If you don't find any useful information, don't worry. The other tips in this guide may provide you with enough information to assess whether you are being scammed by the caller. If you still have concerns, consult a local consumer attorney in your area or go to www.naca.net to see a list of attorneys in your area.

Caller refuses to provide you an agreement in writing for any payment arrangement, prior to payment.
Do not ever agree to any payment arrangement without getting it in writing. I cannot stress this enough. Payday loan scams involve getting your payment information as fast as possible and putting it to use as fast as possible. NEVER EVER GIVE OUT YOUR CREDIT CARD OR CHECKING ACCOUNT INFORMATION OVER THE PHONE TO THESE CALLERS. If you believe it could be a legitimate attempt to collect money from you, you should still consult with a qualified consumer attorney in your area or go to www.naca.net and search its directory.

Caller won't provide address to mail payment. Only accepts payment over the phone.
This is a huge red flag. Don't fall for it. The caller may even offer you a reduced amount if you pay right away over the phone. While many legitimate debt collectors will press you to make payments over the phone, they will also accept payments by mail. Do not trust any caller that tells you that payments can only be made over the phone. I cannot say this enough: NEVER EVER GIVE OUT YOUR CREDIT CARD OR CHECKING ACCOUNT INFORMATION OVER THE PHONE TO THESE CALLERS. You will never see this money again.

Is this debt collector registered in your state?
Many states require consumer debt collection agencies to register prior to engaging in debt collection within those states. Check to see if this company is registered in your state. For example, in Florida, consumer collection agencies are required to register with the Florida Office of Financial Regulation. You can search that office's website for information on any specific collection agency that has registered, when it has registered, and whether the registration is still active or has expired.

Did you receive what appears to be an official summons and/or complaint?
Some payday loan collectors use fake legal documents to coerce their victims into paying. It might show up as a civil lawsuit or it may be a criminal complaint. But it may be very, very fake. As someone who has represented clients who received such fake legal documents, I can tell you it really does happen. Don't ignore them. Consult with a consumer lawyer in your area to see if the summons and/or complaint are real. If they are fake, you may be entitled to damages under the Fair Debt Collection Practices Act.

If anyone has the physical address for Federal Assets, please post it. I have asked them a hundred times for their address and they claim they don't do business through the mail. They will not validate the debt they claim I owe. I am recording them the next time they call and will post it on YOU-TUBE so everyone can hear how rude and bogus they are. If I owed money I would pay, I am not going to send someone $2500 because they call and say I owe. I pay my bills.

Check out their fabulous website, http://federalassettsolutions.com/ .  One really has to wonder at the educational level these geniuses have achieved...the last time I checked, "Asset" only has one "t".  

But it gets better, folks...look at the opening paragraph of this fine, one-page website..."FAS files Litigation Claims, only if debtors fail to voluntarily  arrange a reasonable consolidation of their outstanding debt."  What, exactly, is a "Litigation Claim"?  I know what a small claims action is, which is the category any payday loan would fall into, and I know what litigation means, but a "Litigation Claim"?

But the worst part is the 2nd paragraph, where they tell you what FNA is..."FNA is an arm of Federal Assett Solutions.  FNA is responsible for defending the claim for the accused...."

Wait a minute...you mean that this guy that calls and pretends to be "Investigator Whoever" is going to defend the alleged debtor?  Everyone should breathe a huge sigh of relief now...Whew...we feel better already.  But wait, there's more..."However, if  a settlement is not reached, FNA is also the Dept. that will facilitate court orders, subpoenas, summons, and all other legal actions."  Now I'm really confused...how does one facilitate court orders, subpoenas, and summons?  Aren't they issued by the court, and served by either a deputy or constable, depending on your jurisdiction?  Exactly how do they "facilitate" any of this?

This type of organization is nothing but a scam.

He best not show his face at my front door with out the law with him. All the phone calls he has made to my home has made me a vary upset and mad person. I will go to court but it won't be for bad checks.

I received a recorded call at 6:23 pm,Dec 17, telling me if I was not the person they were trying reach to hang up.  Did not work the recording kept going, telling me there would be problems about an account, which I know nothing about.  Basic ,court etc.  I am so sick of these calls and I am on a NO CALL list.  Why sign up for NO CALLS when it does no good?

These people starting again. They stopped about 3 months ago and now they are calling again. I've blocked a couple of their numbers so that it will go straight to my vm and it won't ring but they used so many different numbers it gets tiring blocking them. I hope these people get caught and go to jail. It's bad enough our economy is getting bad and we have these kind of people to mess with us.

I called them to let them know they were dialing my fax number for somebody I'd never heard of and I've had the same fax number for three years.  Trying to save them a call, save my fax line from being tied up.  The woman got rude with me.  I screamed at her to take my number off their damn list.  Then they called back on my home phone which I dialed from.  I'm sure hell has a special section for these morons.

I received a call from 678-359-3577 leaving a message that they were going to start litigation, file papers, against me and left a long number. I called number back and left message. They called about 7:30 pm 8/16/12. Are these people scam artist taking from us. I will not admit to any info they have. They scare you, I will keep the debt collection law by me so when they I can recite. How do they get this info and get away talking to people like they do. Some one has to put a stop to this.

AGAIN with the calls from these scammers. After several unanswered calls from these people, they left a message saying it was my final chance to cooperate, etc and left their number and a file number.  I called back, spoke with a Mr Andrews who was very nice in the beginning.  Went on to say that I was in default of a payday loan, didn't have a date, just kept saying online, wasn't sure who from, guessed at MTE Financial (never heard of them) wasn't sure how much, said it's now over $510.00, guessed it might have been a loan for $400.00, he didn't know.  SERIOUSLY????  This is when I asked for the Debt Valid Letter, have it include the original loaner, date, amount, contract I agreed to, his company full name and address, license number to practice in the state of Caliofornia and I would research and get back to him.  HE BECAME SO FRUSTRATED... said he didn't know if he couls supply that, said I was trying to hide behind the law at which point, I interrupted and nicely said HE was trying to use scare tactics and no further communication by phone was necessary, just kindly forward the written information.  More frustated now, he just said goodbye an hung up.  The scammers don't like it when you push back.

They just called me and got upset because I told them they were not investigater! I told them that I had an attorney and one person hung up in my face.  The next person started yellig adn screaming and hung up too.  Finally I got someone who took the info I was trying to give them, but kept referring to me as a sir and I am a female.  STupidity doesnt ever stop!

I have done this (and I have a folder a few inches thick) with copies of email, letters, certified letters asking them to stop contacting me (or for the debt to be validated) and get the certified letter kicked back to me.  They are calling my cell, my work, and my family.  A payday loan company unbenounced to me, put money in my account and I allowed them to take out what they initially put in.  Then I put stop payment on anymore funds being withdrawn.  They sent me an application that I "filled out" and my name was spelled incorrectly on the signature line....SCAM.  I'm on the verge of getting a lawyer, but don't want to have to pay for a lawyer!

Just had a great idea....how about each one of us call THEM several times a day and hang up. Make sure you dial *67 before you dial the number so they cannot trace your call. I just did it about 20 times. I is childish but what else can we do?

I have been getting these calls for over a year. The number, the names, and the company names change from time to time but the story is all the same. They don't even have my correct name and I have never taken out any kind of pay day loan. I have been yelled at, called all kinds of names, and have had several threats of jail. Most of the time I don't answer but sometimes they catch me in a bad mood and I let them have it. I told this one guy he should be ashamed of himself for not having a respectable job. I even asked if his mother knew he was a crook and taking advantage of people and if she was proud of him. I went on for several minutes not letting him get in a word and he finally hung up on me. I felt very satisfied and the calls stopped for a few weeks but have started again with a new number and company name. I have no idea what to do or how to make them stop. At least my family no longer panics when they receive calls saying I am about to be arrested.

Got a call today from this number from a woman who said her name is Arbitraitor Moore. This is a scam, she told me that they own my account now and they are willing to settle. Lesson one, an Arbitraitor is not going to buy a debt and then try to collect it! She must think I was born yesterday. There is not much you can really do about the phone calls except change your number, but as soon as you do that they will start calling and harrasing family members. I just keep toying with them, because Im not giving them s***. I didn't do it, not paying it.

I hope they start calling police officers...maybe that will get it stopped.  I am sick of them asking for someone I don't know...and I've asked that they stop calling, but they won't.  I don't know the person they want...it is crazy!
