These people are pathetic! They called me today and the recorded message states that I need to provide my statement regarding an investigation pertaining to me. The number that showed on the caller ID is 210-319-4919. When I called the number back, some girl answered and when she asked the number that was called, she asked me was I someone with a completely different name from mine. Then, she transferred me to Ms. Sims. (I've dealt with her in the past). She said they were coming to arrest me today and she just want to see if I can do make a payment to her in order to stop the process. I told her not to make threats. She said it's not a threat and that is what's going to happen. I told her she said this same stuff months ago and they didn't come. She said she was never the one that worked on my file before and they got rid of the lady that worked on my file because she did not do what she was supposed to do with me. I told her no, it was you Ms. Sims because I remember the name, the voice and you got into a long personal conversation with me. She still denied it. She said the people are on there way to my house. I told her that I've been told by law enforcement that they don't give you a warning, they just come to your house. She hung up on me. I called back and when she answered, I said Ms. Sims? She hung up again. Lol. You can't even find info on this bogus Bryant & Bryant Associates. The worst part is these people will call anyone they think is connected with you. My family really believe these people when they say there are charges against me.

Just received a phone call from this number and they left a message saying they had a claim against me with my social security number attached to it. I have never taken out a payday loan or anything like that and after reading others issues with this number I know it's a scam.

I see they have changed the number again!  Just got one of these recorded messages saying they have a charge against my social security number and they are mailing something out to me today and need to speak to me.  I've received calls from several different states, all claiming to be attorneys to collect on some pay day loan from 2008.  It is a total scam.  They called my mother in law looking for me too so they will try to call your family or your work number so beware.  Don't give them any money and don't call them back.  If you talk to them, they will say mean things to get you all worked up and scared.  Real attorney's don't work this way!  You can also hear that it is a call center because there are people laughing, yelling, etc. in the background.  Again, real attorney's don't work this way.  I also requested they send me something in mail, but they won't.  The one lady that called me from Chicago called me "hon" and "baby" and said she would come visit me in jail.  Really?  Ok.  I've had these calls on and off for months now and while they are very annoying, I am not in jail and no one has come to get me.  Not sure how to make them stop but they aren't getting a penny for some pay day loan I never took out.

I've gotten several of these calls in the past 2 months. It is a scam. I contacted my local police department and filed several complaints. The agent calling will say it's in reference to a payday advance loan and they are filing charges against you for a bad check. The amounts are always for only a couple hundred dollars. They sometimes will give you a supposed docket number that they say will be submitted to your local courthouse, however in most states, a charge cannot be filed by phone or mail, it must be filed in person. The calls I have gotten are from CO & FL. They will say they have mailed a packet out, however no packet is ever received. The scariest part is they will call from several phone numbers, and some of them are jammed, meaning they will jam a phone number to show up on caller ID to make it look like your local police dept is calling. Do not give these people money. Contact your local authorities and let them handle it.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

A lady named Ms Sims called my cell claiming Ace was looking for me to collect on a payday loan. Also claimed i owed $2500 in attorneys fee and court costs...after i thought about it I realized I only got this cell phone number a year ago....Will definitely let them know the gig is up....

Lady called my home number, saying that she was a P.I. from Bryant and Bryant Associates, In the Anderson County.. Never said what state.. Wanted to speak to my husband about a relative that was being investigated.. Thank goodness we dont have a relative by that name.. I told her I wasn't interested and hung up. She had the nerve to call my cell phone with the same message.. Someone needs to stop these people
