I applied for a loan but never went completely thru with the process and they wont stop calling my phone. They left me three voice mail messages so far. Its getting to the point where I want to change my number.

Report to ftc.gov, your local district attorney, californias distric attorney, and to the better business bureau. Here is the better business website. If you look up the phone number is comes back from fallbrook california. He said his name was Adam Spencer. https://www.bbb.org/consumer-complaints/file-a-complaint/nature-of-complaint/. The law firm they state they are from is from wisconsin, and they are not affiliated with "Adam" and his personnel.

They did the same thing to my husband and disclosed information that without making sure it was the right person first which is illegal for a debt collector to do, I know I did collections for a very long time. Then I got on the phone and he got pissed at me and I said well I will go to a legal lawyer he told me, " you "f**king b**ch" don't ever call my office again," hung up without saying he was ending the call, which again is illegal in collections. So I will be taking this to a real lawyer with the number and the payday loan because they didn't put the money in but they took money out and then we got the call. So I would advise any one else who is getting the calls to turn them in and shut these people down. After we got our money back then we got the call.

I've just received 4 calls from this number.   The first time I picked up the phone, hit "flash", then left the call on hold for a few seconds before it disconnected.

I was in a mood to fight when the second call followed less than 30 seconds later.   A male with an accent I couldn't identify asked for what sounded like "Davia Brown".   It wasn't an Indian, Hispanic or Caribbean accent, which are the usual ones who have called to harrass me.

I was ready to argue with him at that point, so I asked from what company he was calling.  He mumbleld something again and I responded that I couldn't understand a word he said.    He immdiately became very hostile and belligerent and demanded to speak to "Davia Brown".   I said, "well you can't, F/U" and hung up.   The phone immediately rang again two more times and I disconnected it without answering.

Over the past few weeks I have received calls from men with foreign accents asking for "Davia Brown".   These calls have shown on caller ID as toll free calls, Rhode Island and California calls.

The fact that the calls were made in such rapid succession today suggests to me that they're probably not robo calls, but as Alfalfa wrote, they're made with VOIP to appear as if they originated in the US.

I am listing the number on the FTC's Do Not Call website and thanks to Alfalfa's alert am also contacting the attorney general of my state and the states from which the calls allegedly originated.

As to the threats this character has made of having filed a suit, if you want to fight with this jerk, ask him in what jurisdiction the suit was filed and when it was filed, how service was made, when it was made and by whom.   Ask him for the court's website so you can see a copy of the summons and complaint.   Ask him the civil action number and the judge to whom it was assigned.

You probably won't get any answers because this is probably just a threat tactic.  

But don't provide any answers including your attorney name or any other information.   Turn the tables on him and repeatedly fire off questions to him.   You won't learn anything, but maybe this jerk will stop harrassing you if he realizes he can't scam you.   Remember that you don't have to tell an unsolicited caller ANYTHING.


Alfalfa gives good advice.    You can also contact your state attorney general to alert that office of a potential scam; it may be they already have a file on this character and/or this operation.  

The Transunion number to call to file a 90 day fraud alert is 800.680.7289.   It's free; TU will share the alert with Experian and Equifax.   I have placed fraud alerts every 90 days for the last several years.

You'll have an opportunity to get a free copy of your credit report from each of the three credit bureaus.  Get them and be sure to correct any erroneous information.

If it is a collection firm, under the Fair Debt Collections Practice Act, a debt collector is obligated to send you written notice with information on the alleged debt.   They're also restricted from certain harrassment techniques.   If they tell you you owe a debt, ask them WHEN they complied with 15 U.S.C. 1601 (it's the Fair Debt Collections Practice Act).   They probably won't have any idea what you're talking about, but you can keep them off balance by firing off questions to them until you just hang up on them.

If any of you are over 50, you might also want to alert AARP, which periodically issues alerts to older folks of scams against the elderly.

Called and left message which I could not understand a word.  I called back and was told there is a lawsuit against me and do I have an attorney.  I said I don't understand what he is saying and don't know of a lawsuit and he kept saying, oh my god, like I am some idiot. I told him I do actually have an attorney and will give him the name.  I told him this is a scam and I am reporting him.  Have not received a call back.

This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information from unscrupulous websites like the one you may have filled out an application with, and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

ABC News released an investigative report on this scam in June. The FTC has indicted one of its ringleaders for criminal fraud:

Left a message with my employer. Tried to call number back but it just makes a beeping noise. I filled out a request to find out information about loans and I am assuming this is where this is coming from by reading other peoples information.  I did not utilize any of the loans or companies that was sent to me.  This is a hoax and I do not want them to contact me again!

This is a collection agency for a PayDay loan company. In New York State, it's legal to get a payday loan, but it's illegal to collect on a payday loan in New York State. There are several other states that either don't allow payday loans at all or like New York, cannot be collected on. The problem with payday loans are that they are not federally regulated...so their collections standards are basically "Anything Goes" !!!

I, too, received a nicely threatening message saying there was a lawsuit against my name and SS#. When I called back, he said that I needed to have my lawyer call him, or the police would come arrest me. When I asked to speak to a native English speaker, he got upset and started being very rude, saying "If you don't understand me, then you can understand the officer that comes to your house!"

He said the suit was filed because a payday loan company tried to collect a payment from my account and the transfer was denied because of nonsufficient funds. My bank notifies me of any direct debits to or from my account, as well as problems, like a bounced transfer, and I received NO notifications from my bank. So, that's a lie.

He also said they would be adding a new charge: harassing the attorney because I asked for someone who spoke without an accent. When I asked where his office was located, he hung up on me.
