Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Goldwyn & Associates, Vermont, keeps calling and leaving messages on my home phone which is a new number.
It says they have two cases of FDIC Bank fraud against someone I know and that they are letting us know before they proceed to court.  They give a case number.  They want that person to call them back and discuss it with them.

Really?  Looks the BBB has a different opinion....Keep in mind that just because a company responds to a complaint does not mean they intend to rectify the situation nor does it mean they give a crap.  It only means they are smart enough not to be accused of doing nothing.  Then - afterwards - its right back to their old illegal practices.

To distinguish itself from the older company, Fitzgerald Goldman and Associates has a new email domain, and will be launching a website in the near future. The new company employs a newly updated online database for account management, which is separate from the proprietary system that was used by GHW, as well as utilizing a third party payment processing system, which was an in house process at Goldstein. We also have a dedicated department which handles complaints, disputes and other types of consumer correspondence, along with a Legal Dept, Human Resources and several office managers that work on the collection floor with our representatives."

However, these positive actions did not stem allegations of threats of law suits, rude and argumentative company employees when debt validation letters are requested, calls to consumers' employers, and collection personnel giving the impression they are representing a law firm. In June 2012, BBB contacted Fitzgerald Goldman & Associates to respond to these allegations and inform BBB how they might further reduce or eliminate these types of complaints.

Mr. Bilal informed BBB that "in order to further reinforce the efforts to reduce complaints, the management staff is also conducting bi-weekly reviews with floor collectors, in which individual phone calls are reviewed with the collectors and used for training purposes, as well as performance reviews." Mr. Bilal also informed BBB that they are "in close, regular communication with our client ... to keep them abreast of our methods and any issues that may arise regarding the consumers we contact while performing collections activities on their accounts." Fitzgerald Goldman & Associates has stated they "will continually strive to make improvements in areas that are identified to be opportunities to lift the business reputation and credibility." BBB will continue to monitor the marketplace conduct of the company for the results of these efforts.

These fools called a place I worked at 8 years ago threatening to have me served at my job unless I pay some erroneous debt.  Guy I still know from there called me all freaked out.  This is nothing more than blatant extortion which is still illegal in the US last time I checked.  Funny part is I have no bad debts and a credit score in the high 700's.  These people are nothing more than scamming, bottom feeding filth who dont have the intelligence or wherewithall to obtain real jobs like most hard working Americans.  Instead, they prefer to make their living harrassing and preying on innocent, naive people.  Hey guys at 802-448-5953...you can shove your case # up your a$$e$.  Better yet - just try me.  My attorney will have a field day with you in court.

Complete scam.  They call 2 to 3 times a day for the wrong person stating they are with the courts - I've called back 3 times asking politely that they remove my phone number.  First lady called me a B**ch - hung up on me.  I called back and the guy was completely rude and told me to F* off - ya legit company.  Jerks.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

This company contacted me trying to collect on an already paid off loan. I sent them all my paperwork and they kept calling. This morning one of their "representatives" said that they were not the ones calling me and that it was their process server. She also said they were coming to my work or house with a summons and sheriff. Please turn this company in to the FTC and your state attorney general. I will also be turning them in to the Internet Crimes Division.

These people keep calling me for an Alicia Monteith. Since I got this Cricket Phone, I constantly keep getting harrassing calls about this woman having some cases against her. I told these people to stop calling me many times. She even said you are rude so I think you are Alicia, I am not removing you from our calling list. I'm calling to notify you that there will be two charges filed against you in your county looks like for Karen activity has been attached to your name and your social security number. Albert e(?) Marino. I do need to make you aware of your legal rights to which Rusher charges prior to them being filed against you. You would need to do so before you receive your summons at your place of employment or at your home address. Once you're served your rights will be forfeited. Just got the same robo call as mentioned by others in this post. Call came from 802-448-5953.  Caller did not identify themselves but stated that charges were about to be filed against me because there appeared to be an incident of fraud linked to my name and social security number.  Did not say the name of company bringing the charges but that I could stop the legal process by calling them back and speaking to someone in their legal department.

The only way to resolve it is to get their business name and address and send them a cease and desist letter (by certified mail with return receipt).

If they refuse to give you either their business name or address (and it wouldn't surprise me if that were the case) then your only recourse is to file reports with your local law enforcement and state attorney general.

I've received a call from this number and they left a message stating that I'm being summoned for fraud and they need to let me know my rights before I'm served and once im served my summons my rights will be for fitted.
