This company is located on Grand Island Blvd in Grand Island, NY 14072. They are calling our house for someone who use to have our phone number many years ago. I am so sick of these calls for something I have nothing to do with.

I have been a victim of ID theft over 25+ years ago and it really is hard getting your credit corrected. To this day I still have to check my credit for bogus information. Even when you do ... these kinds of companies still come out of the woodwork to try to scare people into paying for fraudulent debts. They will use every illegal tactic in the book. Just know what your rights are. If you request it, they have to send you a letter stating what they state you own and the original debt holder. You have the right to dispute the debt in writing. I would send a certified letter disputing the debt within 30 days. You can also request that they cease any and all calls and contact. If they attempt to make any contact after they have been sent the certified letter they are in violation of the FCC credit collection policies. Also keep tract of when they call and the time of day. There are set time they are allowed to call. They are never allowed to threaten you in any matter. What this company is doing is illegal and violates the fair lending and credit act.
Report these guys. There are attorney's that will go after these guys at no cost to you. You must document everything.

You can file suit for their actions if you feel they are in violation of your states credit laws. There is a statute of limitation on debts and for putting negative information on your credit. Each state is different. Just know if you pay them one cent it will re-validates the debt and and they can go after you legally. Always check your credit report annually. You may be a victim of ID theft and do not even know it.

Steps to help stop the harassment

Send letter via certified mail a dispute & cease all contact.
Keep copies of all letters sent and postal slip showing letter was certified
Keep tract of the times and dates they call off of caller ID.
keep a small recorder by your phone. When they call..Clearly let them know you are recording the conversation and it may be used in future legal action against them. They will usually hang up before you are done talking.
Call debt harassment attorney if they do not stop calling or cease contact.

Just know these companies will sell these debts off to other companies and you may have to do this process again. I  know it is frustrating, but don't give up. Stand  up for your rights!

I hope this helps anyone who has to deal with these type of debt collectors.

A Mr. Joe Matt called our home # today, demanding to my friend to call him back ASAP, due to a legal action of a summons. And they needed my address, where I could be served. Gave my friend a case #, and the phone # 877-369-6484 ext. 1021. I have never heard of this scam before, but after I Googled the company name and phone #, I read everyone's complaints about this company. A big Thank you, to all of you who have left messages about these people. I will be reporting them to the BBB and The Attorney General's Office in Las Vegas at 555 East Washington Ave. 702-486-3420. And with The Federal Communications Commission. What I don't understand, is "WHY " they been shut down from operating.

"Hello, this is Mr. Sebastian contacting you in regards to a transaction issued to this office through your, uh, current checking or savings account.  Uh, this concerns an issue, uh, an insufficient draft issued, uh through your bank account for funds you have received.  Uh, at this point we are making a final recommendation on how to proceed pursuant to state laws in your local county.  Uh, your immediate response and cooperation certainly will benefit you.  You can contact the office at 877-369-6484.  Uh, though, though, if no one is available please press zero for the next available agent and someone will be with you to handle the situation to your advantage.  Thank you."

I received a computer generated phone call on my cell phone from a Mr. Sebastian who stated that my account was overdrawn and to press #1.  This is certainly not true and is some kind of scam to retrieve personal information from people.  Please let your family and friends know that this type of illegal operation is going on and not to answer the 800, 866, 0r 877 numbers,  It's not worth it.

some guy called me twice yesterday and left messages on my voice mail saying that they received 2 complaints about me passing bad checks in their office. i haven't written a check in over 6 years that didn't clear the first go round, and btw that check that came back the second time cleared my bank. so not real sure if the deep raspy voiced man that called me is legit. uh odds are that being that many Americans are feeling the pinch of working harder with bills rising and at the end of the month you may not have what you think you should- i be damn if i just give my hard earned money to some yahoo because he said i should.
if its on check systems then deal with check systems not some group who figures that were all to dumb to know how to google the # and read. nice try bud, but they are no better than the guys who send you emails saying they won 500million dollars and need your account to clear the money and will give you half of their winnings out of Africa somewhere. do people still fall for that one?

By bad check they mean payday loan, any loan you took out in person or online. Payday loans are done with your checking account, if the loan goes unpaid then it is the exact same thing as writing a bad check. Your e signiture and acceptance of terms of service is what grains you in. So yes, they are calling about a bad check and they do take people to court often, my brother just paid over 4000 for a 600 dollar loan, he avoided the calls and was served with documentation at his job. The attorney and court fees is what increases the balance.

Marshall Cooper left a voice mail with this number 877-369-6484, and said it was regarding a returned check, and threatened to send sealed documents to my work and home if I did not return the call today. I have been receiving calls like this for over a month now, some with heavy India accents too.

I got a call from this number in which they said I was being served a notice for bad checks.  If I called them they would refer me to a good lawyer.   I don't pay with checks, cash only.  So, I know it's a scam.  Be warned.

I get calls from this number constantly, they leave messages with my co-workers things like, if I don't call they will serve me papers at work, this is an important legal matter and leave a case number. I don't have a clue who this is or why they keep calling me even though they have been asked many times to stop calling me at work.

LOL, I know this is not a funny situation but your words are SOOOOO TRUE!!!!  I have had a couple different people call me from this number and every time I ask them to send me a copy of the debt I supposedly owe them I get threatened with legal action if I don't pay over the phone right then.  I finally told them I could give them the number to my local sherriff's office if they would like it.  They didn't find that too amusing.

Said that I have a civil complaint against me. When I asked for details she gave me an ext to call back. I strongly believe its a scam because I didnt receive and legal documentaion regarding this matter. It sounds so serious but where's all the documents to support it. There is none because its a scam.

I too have been victimized by the calls from a Mr. Mark Senear and his colleagues.  They seem to have all my personal information and are accusing me of a bad check on an account that has long ago been terminated due to fraudulent use on my accounts. I have been a victim of identity theft and no one that I talk to at this company seems to want to hear that or help with this situation at all. They are very rude and continue to make vicious threats. Really all I want to do is say this; whether these calls to collect a debt or justifiable or not, the employees of this company need to realize that some of the people they call may very well be victims of identity theft and have been through enough. The last thing they need is someone on the other end of the line telling them they are being sued or legal charges or being brought against them. I had one employee coming from the offices of Mark Senear tell me "either I am going to pay it or I am not." I mean seriously lady I just told you I was a victim of identity theft and that is all you have to say to me.  When I called this company back I did speak to one lady who was very nice when I asked her to please remove my number from the call list.  I would suggest that other people that have had calls from this company and been spoken to in the same manner as they have spoken to me; file complaints with the BBB and contact the Attorney General.

I received a phone call from this lady named Ms. Hoffman who pretended to be a courier for a court summance. She threatened me with criminal charges and said if i didnt comply with the attorneys and pay a fictitious amount that was actually inflated from what i actually owed i would go to court? This is just an illegal collection agency and if you get any calls from a lady named Ms. Hoffman dont be intimated to pay. you dont have too. they are an illegal collection agency! i also researched the agency and its just a LLC belonging TO THE OFFICES OF MARK SENEAR

The credibility of your comments is hard to gauge considering your inability to type in a normal demeanor. If you were serious about your claims in this, then I would expect you to be a little more civilized in the way you present your argument. The overuse of capital letters and insults simply downplays your character.

You are correct in saying that you're bank would have notified you of a check that had been returned due to insufficient funds in the account the draft was coming from. However, if they are unable to contact you the first time they will not keep attempting to contact you.

Most limited liability companies that deal with debt collection own their debt, meaning they can pursue the balance in a civil suit as they do hold the rights to the original contract of the debt. Stating they will take the course of legal action in order to secure their investment of the debt is perfectly legal, so long as they are willing to back those words up.

Now, as far as the bad check claim goes. Whether this was a paper check you had issued to the original creditor or the combination of your bank's routing number and account number, it is still viewed as a bad check. Recent laws passed have included electronic ACH drafts in bad check claims. Also, depending on  your state laws after a certain amount of time passes since the bad draft your state will set forth...the...consequences we'll call them of doing so. Three times the amount of th bad check is a minimum in some states.

A little research into practices goes a long way.
