I just got a call from a man by the name of "Daniel Carter".  "Dan" states that he is a process server and will be coming to serve me tomorrow between 12 - 3 PM at both my work and my home address. He states he can not leave me his personal phone number but instead provides me with 877-780-2949 to call for further information who/what/when/where the debt is owed to and summons info etc...  I called this number back and a guy named "John" answers the phone.  Simply answers "Hello, this is John", does not state a company name, no information in regards to this being a debt collector etc.  I hung up the phone, minutes later "John" calls me back and the number comes up as (716) 204-7541.  "John" states he is returning my call.  I stated I had the wrong phone number and he said "OK" and hangs up the phone.

Don't be suckered by extortion dressed as debt collection. Consumer debts in America, including payday loans, are a *CIVIL* matter, not criminal! Honest debt collectors do not typically send their claims straight to a judge, and they don't take your ransom money to broker quick deals with so-called "process servers". There are no secretive "arbitrators", "mediators", or "prelitigation specialists", only sweaty criminals with a script full of bullying remarks. Lawful debt collection is a process, not an ambush, and you are due a chance at each stage to raise a dispute. The agents' horrid threats are empty and their conduct is illegal. Do not reward lawbreakers with your money. Challenge them always, sue them if you can.

Is the man serving foie gras or a chicken parm grinder or vegetable lo mein? This is the part where you plead for mercy and pay anything the stranger asks .... not! Ask him to meet you at an easy landmark, like maybe the police station lobby, so there won't be any trouble. That should fluster the creep ....

Probably not legal. A real collector would contact you by mail - they are required by law to validate the debt IN WRITING. If they refuse then you're definitely dealing with a scam. Try asking for her name and the name *and* address of the business she works for. If she refuses it's because *she's* afraid of the law.

The hassling of relatives and employers is a tactic designed to shame or intimidate people into paying. The crooks sometimes get people who don't owe anything to pay up just to stop the calls. (Needless to say, if you do this the calls will *increase* because they'll know they've found a patsy.)

Just got a message too from a lady who says she will be at my home or biz tomorrow between 12-3 to serve me.  She also is calling relatives who are now worried.  This doesn't seem legal.

Just left a message on my phone saying he was going to serve me tomorrow. Pretty sure they can not say this over the phone.

This guy left me a message saying he was going to be serving me tomorrow at either my place of employment or my home between 12 and 4 pm. Was a very long message and my voice mail cut him off. Then he called my daughter and left the same message saying he was trying to reach me. A** HOLE!
