This is the voice mail they left me. I called them back and they said they were collecting for BMG payday loans, a company here in Utah. I informed them I filed for bankruptcy and have them my lawyers info. This same company "BMG" had tried to collect before and it turned out to be a scam. It would not surprise me if this is also.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With Third Parties

Jeffrey Abate is a total and complete scam. How they get you is by leaving you a voice message stated that they are going to serve you with papers from their client, they don?t even state who they are in the voice mail. Anyway you call back and they tell you that you owe their client money (In this case Ez money). So at first when I called and spoke to a Michelle, I told her that I paid the loan off like 6 months ago. I let her know that I would call her back with documents showing so. So I hung up because she wouldn't listen, she kept trying to get my email address. After I got off the phone with her I googled the name of the lawyer (Jeffrey abate) and all this stuff came up that is was a scam. People were saying that I needed to get SURETY BOND from them and for me not to give them my email address or any information over the phone. I called back today and asked to speak with Mr. Jeffrey abate himself. One guy said he was transferring me to him and transfer me to a guy name John Peters, Now John Peters told me he wasn't in the office at that time. So I called back spoke with someone named Mark, now mark told me that Mr. Abate wasn?t in San Antonio.... HMMMMM fishy. I asked for the SURETY BOND number, no one there seemed to know what I was talking about said I was making it up..... WOWWWWW. John Peters basically insinuated that I was dumb. He told me that I'm not as smart as I?m trying to seem. Went through some spill about my criminal record, which are just arrest for minor things... like driving without a license from years ago and an assault ARRESTED not a charge. If you?re fighting and the cops see you no matter who hit who first.... YOURE GOING TO JAIL. Now if I had a criminal record I wouldn't be able to be in the nursing program. All of that stuff was from when I was young. Anyway I?m guessing Mr. Peters was upset that I knew too much information and told me to stop calling there. I?ll call the office again and let them know if they call me phone one more time from any number I?m filing harassment charges.

We have recently found out that another group is illegally using my name to hide behind illegal collection practices.  I have filed a report with the Attorney General and will update later as the charges are filed.
These people were NEVER given permission to use my name.  This is identity theft and impersonation of a lawyer.  Do NOT ever send a check or money order to a P.O. Box and if there is any threats of this nature they are NOT from my office.  I don't know what more I can say right now other than I will personally update when I can determine the response from the police and A.G.'s Office.

This company, who answers the phone as "Civil Claims" instead of telling you the name of their company, thinks I owe them $500 for a payday loan I supposedly got over the internet.  When I contacted the Plain Green Lending Corporation, the place I was supposed to get the loan in September, 2011, they said they have NEVER given me a loan.  I had applied back in September of 2010, but was rejected.  So how do I stop this idiot company from ruining my credit?

Company harassing not only me but my co-worker.  Some how they got a hold of her extension number.  Tried to call and talk to them but will not get any real information.  Just that they will serve me a subpeona, take me to court, etc.  Wouldn't say why, for whom, etc.  Told them to go ahead and submit their paper work through the local legal authorities, but have not seen anything so far.  This has been going on for about a year now.  Interfering with my job as well as my co-workers.

I just read your reply, and although this doesn't apply to me, I pay my bills because I have a job, There are some, or better said alot of people who had jobs and don't have them anymore. They are not dead beats on purpose. I am sure there are some of those dead beats though who do what you say.
Try to have some compassion on your fellow Americans who are getting totally screwed by this government that is in place now. This is the biggest wealth transfer taking place in the history of the nation. The money is flowing away from the middle class and into the pockets of the big banks and the government. I have been looking into the fine details of how our economy truly works for the past 12 years. It doesn't matter which party gets into office, because both parties are screwing the American people big time.

This "law firm" is spoofing the name of a real attorney who has no affiliation with them.  They CANNOT sue you, they CANNOT press any charges against you, they CANNOT serve you anything...these are false claims. Anyone being threatened by them in any manner should report it to the New York State Attorney General's office by calling 716-853-8404.    Anyone who has paid them under these circumstances should report that as well. You can be sued over a debt...Just not locked up over one. The general rule of thumb is that if the debt is less than $1000 they won't bother suing. It's not worth it to them. If the debt is over $1000 then although slim, your likelihood of being sued increases.

I just received a text message from Law Office of Jeffery Abate saying that my payment will be drawn from my checking account on July 3rd for just over $200. I have no idea what they are talking about! They said it was for some company called Checkmate...whoever that is! I just know it has nothing to do with me. Ignore these scammers and especially these fake posters pretending that these scammers helped them.

Pay day Loans are illegal in New York state so if someone claims they got a summons and had to go to court and you live in New York you are lying. A thrid party debt collector trying to collect on payday loans cannot collect if they never sent you a notice, and are not register or licensed.

So for all of the responses that seem to try t scare you into apying Jefferey Abate who sent me a text by the way. when do debt collectors send "TEXT MESSAGES" dont fall for the crap. Call amke complaints save all for your calls and emails. Call the police and file harrassment charges. I did and they backed off because aI settled all of my payday loans and paid everything back per the law in NYS and they still call. Illegal and Jefferey Abate a true SCAM

The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.

Callers pose as representatives of the FBI, ?Federal Legislative Department,? various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim?s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.

The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim?s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it?s the latter, the caller tells the victim that he or she is wanted for hacking into a business? computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.

The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim?s job. In another instance, a phony process server came to a victim?s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.

If you are contacted by someone who is trying to collect a debt that you do not owe, you should:

   Contact your local law enforcement agencies if you feel you are in immediate danger;
   Contact your bank(s) and credit card companies;
   Contact the three major credit bureaus and request an alert be put on your file;
   If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
   File a complaint at www.IC3.gov.

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Some fraudsters have instructed victims to fax a statement agreeing to pay a certain amount, on a specific date, via a pre-paid Visa card. The statement further declares the victim will never dispute the debt.

If you receive these calls, do not follow the caller?s instructions. Rather, you should:

   Notify your banking institutions.
   Contact the three major credit bureaus and request an alert be put on your file.
   Contact your local law enforcement agencies if you feel you are in immediate danger.
   File a complaint at www.IC3.gov.

Tips to avoid becoming a victim of this scam:

   Never give your Social Security number?or personal information of any kind?over the telephone or online unless you initiate the contact.
   Be suspicious of any e-mail with urgent requests for personal financial information. The e-mail may include upsetting or exciting but false statements to get you to react immediately.
   Avoid filling out forms in e-mail messages that request personal information.
   Ensure that your browser is up-to-date and security patches have been applied.
   Check your bank, credit, and debit card statements regularly to make sure that there are no unauthorized transactions. If anything looks suspicious, contact your bank and all card issuers.
   When you contact companies, use numbers provided on the back of cards or statements.

I dialed "1" and talked to someone who answered "Law Office of Jeffrey Abate". I explained that I was calling (said I was the Security Manager for the company) regarding threatening calls coming into the company's phone system, and I wanted to know the origin of the calls. Transferred to voice mail oblivion.

So, they don't want to talk to someone with a little bit of authority. Screams SCAM with big red flags waving wildly. Note: There is an attorney named Jeffrey Abate in Orchard Park, NY, near Buffalo. Several shady collection agencies operate in that area. There have been numerous criminal convictions of people connected to those operations.

Demand written verification of the debt. Not just a letter claiming you owe the debt, but PROOF you owe the debt. If they will not give you info on their name, location, and mailing address, do not agree to anything or give them your information. Make them obey the law. If they won't, don't give them anything.
