I kept getting calls every other day till I told the last lady that called that I already set up payments to pay for my mental mother's fee and they didn't call till the day that I said I would make the payment. If you explain to the people you don't want to give them your card number until you have the money in there they do have enough respect to call you back on a day you schedule to pay them. I do find it messed up that they are making my sick mother pay the 250. but I guess I can't really complain, after all it was my fault for not watching her good enough. It still bull crap how they are gonna cetch her but not look on the cameras for whatever worker took our cart after we loaded up our food and had to have seen my huge wallet and not told me hey you forgot this but instead stold my 750. that was for rent and my son's diapers. Now that is screwed up. All they had to say is the carts are checked before other people get them. Anyways if you are firm but yet kind and do keep your word and pay them on the day you are supposed to they don't keep calling. Plus if you don't pay what you owe a police report will be made and you will have charges pressed against you as if you were just in the store that second and was stealing. Anyways next call you get be sure to tell them you aren't gonna give your card number until money is in fact in there and tell them the day your money is placed into your account and they will wait to call that day, plus they also do payments. They are kind if you are kind to them.

The money your grandson is paying the court is the court fee for having to go to court, I know it's stupid but they have a seperate plan to pay your court fines and pay the walmart fines. Next time they call just tell them what day you get paid and let them know that you would like to start a payment plan on the day you get paid. They will wait to call you till that day and you won't have to worry about all them annoying calls that you keep getting. I know them calls get veyr annoying. They did it to my mom till I got the phone one day and handled it.

I don't have to pay anything in criminal fees. I just have to do a diversion class which costs $30, so I am incredibly blessed. I have to go back in October with proof and it'll be expunged.

I called them back, its an attorney. In my case i got caught stealing from walmart when i was younger. So the attorneys were calling to tell me that i owe them over 200 dollors for stealing a 10 dollar product.

I was caught in February 2011 for attempting to steal about $34 worth of stuff from Target(a pair of $8 leggings and two pairs of $13 sunglasses). YES! It was stupid, I admit this. I totally regret it. I'm 19, so that just made it worse. My friend, who is 18, stole over $120 worth of stuff, and she's been caught before. A police officer came and "arrested" us and wrote citations, and issued a court date and all that good stuff (sarcasm). The security people told us we'd receive a letter in the mail with an amount we'd have to pay, anywhere from $50-$500. Considering I stole such a small amount, and they obviously got their items back, I figured it would be small. But hell no! During the first few days of March, I got my letter for the full amount! Shortly after, I started getting 800 calls. I didn't answer, but then I decided to call the different number on the letter. I talked to a surprisingly nice man, and asked about payments of anywhere from $20-$50/month. He said that'd be fine, and he'd put a hold on my file until March 25th (tomorrow D:). Well, reading all I have read about this firm, I'm not sure if I want to give them my debit card info! I haven't gotten any calls since, but I'm really afraid if I don't call and pay they're going to sue me! It was $34! And they got the items back, with tags so all they had to do was put them back out on the racks! We have our court date at the end of April, and I'm sure we'll have to pay some kind of fine. But should I really pay that $500 to these so-called scammers and con-men? I feel like $500 stretched over a year would be better than several thousand for an attorney! ):
Could someone please tell me what I should do!? This is stressing me out enough as it is. I'm just a dumb kid who had never shoplifted before and I just wanted to see what it was like. I regret it more than anything, ever, and now it's going to be on my record forever! Any advice please.

It is not a scam. She must have received a Civil Citation. Store Owners have a legal right for restitution, the dollar amount depending on State Law and the value of the item stolen. My guess is that the City does not need to press charges, a Court Order is not usually issued, and you/she legally owe the money (check your State Laws just in case). Hope that helps!

I was wondering if you paid the Bennett Law Firm...My daughter recently received a letter from them stating she owed for shoplifting restetution after an incident that happened in Aug. 2010. She never received a court order and got lucky. The city never pressed charges on her. Is this a scam?! I don't know if I should pay or not.

That is not true they gave me the number to Wal-mart and they confirmed they were hired to represent them in reference to shoplifting. Shoplifters think it is no big deal but there are millions of dollars in losses due to the idiots that dont pay for their merchandise. My son shoplifted they were really nice and let me pay for his stupidity in payments.

This phone number started out calling a few times a week, but it has now escalated to four times a day. When you answer the phone and press 1 for a representative, it hangs up on you. I have no bad debts whatsoever. Certainly not a shoplifter. Ridiculous!! Stop these people from harrassing us!!

They started robocalling my work Blackberry number a month ago. They call every day. Once I called the 888-832-0241 number and got a human. He asked if I knew John Edwards. I sarcastically answered, "what, the ex-presidential candidate?" He didn't get it. I told him this was a company phone and to stop calling it.
That led to maybe 2 days of peace, then the robocalls resumed from 888-832-0241, this time with a female voice leaving the message. I called back to the number they gave 877-749-2590. The lady who answered asked if I knew John (something else). I said no and asked them "to take me off their damned list". She said, "Lady, there's no reason to be rude." That's pretty funny, coming from them.
That was today. We'll see what happens next...

This number is a SCAM!!! It's obviously a computer calling and if you want to speak to a representative and it hangs up. I have REPORTED this number and hope everyone else does the same. I found a gift card in the parking lot of my place of work.
I picked it up with the same enthusiasm I would have expressed for a found penny, turns out there was 100 dollars on it.
well I'm a single mom and the holidays were near. my supervisor had already told me that if I wouldn't stay 2 hours later for him on xmas eve to set up "endcaps" for the after xmas sale, then I would get NO holiday pay.
I NEEDED that money, I was faced with 3 choices, listen to my manager and not get to spend xmas eve with my kids, or screw him off and have to chose to pay bills or buy xmas gifts for my little ones.
well when I checked that card and saw that I could spend christmas eve with my kids and have enough money to make it I felt like crying tears if joy.
Yes I knew it was wrong not to turn it in to walmart but it was found IN THE PARKING LOT!
not only are they charging me 200 dollars to keep this matter out of court (I have no time or money to go)
but they also FIRED me.
all for a freaking found gift card.
It turned out to be the greatest thing though, I now work for hertz. they treat me right and I make almost double what I did at walmart.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.
What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.
Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.
How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.
Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.
What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.
Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.
What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.
False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.
Debt collectors also are prohibited from saying that:
you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.
Debt collectors may not:
give false credit information about you to anyone, including a credit reporting company;
send you anything that looks like an official document from a court or government agency if it isn?t; or
use a false company name.
Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.
Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.
Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.
Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
Social Security Benefits
Supplemental Security Income (SSI) Benefits
Veterans? Benefits
Civil Service and Federal Retirement and Disability Benefits
Service Members? Pay
Military Annuities and Survivors? Benefits
Student Assistance
Railroad Retirement Benefits
Merchant Seamen Wages
Longshoremen?s and Harbor Workers? Death and Disability Benefits
Foreign Service Retirement and Disability Benefits
Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.
Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.
What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.
Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

Anyone interested in filing a formal complaint with the Utah Bar Association and the Attorney Generals office? I am. These guys are harassing me and I refuse to tolerate this crap. They are not lawyers. They are a collection agency who engages in misrepresentation of who they really are. I am going to call a Utah lawyer and start a class action similar to the one against a Florida firm engaging in the same activities.
