Caller claimed to be from the Government tax bureau.  I paid my taxes and I have never received a threat from the IRS or California tax board by phone, they send notices by mail.  So I knew he was calling to scam me saying I owe money and he would collect.  How can this be stopped.  I have filed complains.  But they need to be stopped.

I am a Police Officer and attempted to speak with them about tying up City phone lines. Person that I spoke with had an accent and stated that if I was a police officer to charge him. Person began to swear, stating that they would continue to call and there was nothing that could be done.   Refused to give a account number or case file for the person that they were calling about, stating that it was confidential and then hung up.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

This guy has been calling my job too.  Says his name is Bob Green.  All they do is call and hang up 5 times or more and then try to tell me about a payday loan.  They won't send you any thing in the mail and they try to call you rude when they are the one acting ridiculous. Wants me to send them a money gram for $105 to some place in Florida.  Why can't the FTC or somebody do anything?

I got a call from this number and they were asking for someone who use to have this number. I told this "Bob Green" that the person he was asking for no longer has this number. He then wanted my name and I told him no he could not have it and to stop calling me. This guy called my number five times back to back until I told him I wanted to talk to a supervisor. He would not let, so I waited a few minutes and I called and got a different person and I informed them that the person they were looking for no longer has this number and to stop calling me. He said he was a supervisor and he got nasty with me telling that I was the one they were looking for and he was going to send the cops to my place of employment. I laughed and I told him that I work for the police department and he called me a racial name and hung the phone up. THIS HAS GOT TO STOP!!!!

They had called one of our employees the day before and said they would spam our work the next day unless he paid debts which he did not have. Sure enough, we got about 60 calls from this number today. I fought back by spamming their phone line using an SMS Text to Voice bomber (available in the Android store). I sent them 100 messages and they stopped calling after that. The whole thing is a scam originating from India or Pakistan. They troll the internet for financial data and then call to extort you for money.

This same man calls our work sometimes 50 or more times a day. He says his name is Johnny Hunter and he repeatedly asks for the same employee. If I don't let him speak to that employee he threatens to call every two seconds. He harasses us and ties up our phone lines and needs to be stopped!!

We called the state Attorney General's office, and they said it's a scam from a foreign country and there's nothing we can do. It's infuriating!

Gosh yes!   These south Asian (india or pakistan)  scammers have been at it for some time now.  They have learned that calling a place of employment sometimes gets some results.  They have learned a new  catch word "human Resources'   and they think they can use the company to pressure the person they are trying to scam.
Just the usual low life maggots,  calling from a boiler room  in bollywood trying to extort a buck through threats of ones job.  The more that stand up to them and let them know that those idiots can't do anything but be beggers and thieves scamming from India, the sooner they will move on.

Just received a phone call from 980-263-2490 asking for a Roy McDaniels. I informed the individual that I may add you can barely understand because of his accent, that we did not have anyone by that name working for our company. He began to tell me that that was a lie and that he needed to speak to him about legal matters. I again stated he did not work for our company. The gentleman that asked to speak to a manager and I informed him I was the H.R. manager and I DO NOT have anyone by that name working for our company. At that time he began to argue, so I hung up. He immediately called back and began to get extremely nasty. Is there a report this types of harrasements?

Thanks for the advice to notify the FTC along with the link to file the complaint.  I originally called the local Sherriff's dept. not knowing what else to do.  After multiple calls from this number - the first when someone else at home answered my cell phone and the person calling gave them my entire SSN over the phone - 'Eric Bad' left a vmail threatening me saying he will 'call my place of business and talk to my mgr. and after that no one can help me, I will find you and I will take you to jail, you dumb lady'. Yeah, I'm not dumb enough to sit back and be threatened or to send them any money though!

Every time I get a call from one of these scam numbers I report them to the FTC and also to the State Attorney's office. I have reported them to the FBI online as well. I had one company call so much I had to get my company's chief security officer get involved because he said he was going to call until he got me fired. And he called so often that as soon as you hung up the phone it was ringing again. Please keep reporting them folks. Thanks for the information in your post.

I too have been receiving these calls, this guys name is Gary Parker. Same accent. He has called my work number 64 times, SIXTY FOUR!!! I had my HR manager talk to him to tell him to stop calling and he blantently told him he was not going to stop calling he was going to keep calling every 5 seconds. I have been to the police station, they've listened to the message on my cell phone and told me to call them back and tell them I don't want to talk to them that they need to stop calling me at work and at home. The guy that I got on the phone yelled over to "Gary" to "keep calling her work number every 5 seconds". He said that since I would not hear their information they were going to keep doing that. I am stopping back at the police after work to tell them how many more times they called after I left work to come see them earlier. I too DO NOT owe anyone any money, I pay my bills on time and I can only think they got my information from recently applying for a credit card online. GRRRRRR

This same idiot has called me at my job constantly .  My employer answered the call and basically told him to go to hell.  This is a scam ,I do not owe them a dime. He is clearly not american, he does sound like he is from the mid-east.  I told him to send proof of this so-called bill he refused saying I just owe it so pay it .  I am so sick of him and the harassment. Almost foorgot he clamed to be from the FBI and a police officer,LIAR  I told him it was against the law to represent himself as part of law enforcement. This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information from unscrupulous websites like the one you may have filled out an application with, and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

ABC News released an investigative report on this scam a year ago:

Extremely rude and unprofessional  we think it's a collection agency.  Like throwing racial slurs around.  In the background of the phone call there appears to be a large number of people like it's a phone bank.  After doing a reverse phone check the number appears to originate out of North Carolina.

I received two calls from this number at work. The caller said his name was Jackie Johnson and he was clearly not from this country because his accent, which was very thick, sounded like it was from Pakistan or India or somewhere in that region. Asked for me and since he obviously didn't hear me say my name when I answered,  I lied and said I wasn't there and took down the number. Not five minutes later he calls again and I again say I am not there and he wanted to know my schedule. When I told him I didn't know, he became rude and said that she (I) work for me and I don't know the schedule and I told him that she doesn't work for me she works for company and we can't give out that information. I am to call him back tomorrow. I don't think so.
